CASH DEPOSIT FOR FAITHFUL PERFORMANCE

Ashwini Simha is providing to the City of Campbell, a municipal corporation under the laws of the State of
California (hereinafter "City"), the sum of TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500.00) as a deposit for
the faithful performance of the following obligation:
Obligation: The submittal of landscaping & irrigation plans for new front -yard landscaping and installation of
said landscaping in compliance with Campbell Municipal Code Chapter 21.26 (Landscaping Requirements) and more
specifically the State of California Model Water Efficiency Landscape Ordinance (MWELO) Appendix D, for property
located at 378 Curtner Avenue, Campbell, California. In consideration of final clearance of Building Permit No.
BLD2018-001203 at this time without installation of the required landscaping, the aforementioned obligation shall be
completed no later than October 29, 2019.
Now, therefore, if Ashwini Simha shall submit the required landscaping & irrigation plans and install the
required front -yard landscaping and if she shall satisfy all claims and demands incurred under this agreement, and
shall fully indemnify and save harmless the City from all costs and damages which she may suffer by reason of
failure to do so, and shall reimburse and repay the City all outlay and expense which the City may in curing any
default, then this obligation shall be deemed satisfied and the full deposit shall be refunded.
If at such time, the City determines that Ashwini Simha has failed to satisfy the obligation set forth in this
agreement, she acknowledges and submit to forfeiture of the deposit provided herein. The submitted deposit
described within this agreement shall be used to cover all enforcement costs incurred by the City to abate the
violation (non-compliance with landscaping requirement). Should the enforcement costs incurred for the obligation
described above exceed the original cash deposit, the City reserves the right to collect additional monies from
Owners over and above the original cash deposit or lien the property for any uncollected balance pursuant to
Campbell Municipal Code Section 21.70.070 (Code Enforcement Fees).
In witness, the parties have executed this agreement as of April 29, 2019
