Dear Ms. Davis,
The Planning Division has granted a Zoning Clearance (PLN2019-92) for a new outdoor dining
area and associated dining furniture for an existing restaurant (Patxi's Pizza) located in Suite 405,
pursuant to Campbell Municipal Code Chapter 21.40 (Zoning Clearances) and Part V, Section B
(Outdoor Dining Guidelines) of The Pruneyard Master Use Permit. The approved outdoor
seating area shall be constructed in conformance with the approved outdoor seating plan (copy
enclosed), stamped as received by the Campbell Planning Division on May 14, 2019. This
approval is subject to compliance with the following requirements pursuant to the Master Use
Permit:
1. Heaters shall be limited to electric or natural-gas models only; propane heaters are
prohibited.
2. The quantity of outdoor seating shall not exceed 30% of the business's total (indoor and
outdoor) seating capacity.
3. Use of the outdoor seating area shall be in conformance with the Conditional Use Standards
(Part IV, Section H) specfied for "Alcohol Service Ancillary to a Restaurant" and applicable
General Performance Standards (Part IV, Section I).
