HPB Mins 09/25/20190V-C.AM Historic Preservation Board REGULAR MEETING MINUTES Wednesday, September 25, 2019 1 5:00 PM City Council Chambers, City Hall, 70 N First St., Campbell, California CALL TO ORDER The Historic Preservation Board meeting of September 25, 2019, was called to order at 5,00 p.m., in the Council Chambers, 70 North First Street, Campbell, California by Chair Foulkes, and the following proceedings were had to wit. ROLL CALL HPB Members Present: Michael Foulkes, Chair Yvonne Kendall, Vice Chair Susan Blake Laura Taylor Moore Todd Walter APPROVAL OF MINUTES HPB Members Absent None Staff Members Present: Daniel Fama, Senior Planner Corinne Shinn, Recording Secretary 1. Approval of HPB Minutes of August 12, 2019 Motion: Upon motion of Board Member Kendall, seconded by Board Member Walter, the Historic Preservation Board minutes of the meeting of August 12, 2019, were approved as submitted. (5-0) ORAL COMMUNICATIONS (ITEMS NOT AGENDIZED) None BOARD/STAFF ANNOUNCEMENTS, UPDATES AND REQUESTS Board Member Blake reported that another History Mystery came out on NextDoor in the past week. 2. Mills Act Program Update Staff will provide a status update on the Mills Act Program. Planner Daniel Fama: Reported that he had a recent conversation on the Mills Act with Board Member Moore and discussed this update on the Mills Act Program with Director Paul Kermoyan. Historic Preservation Board Minutes for September 25, 2019 Page 2 • Advised that the Mills Act Program Update will be split in half. For the first part, an intern would be secured to do research. He is looking at a grad student who lives nearby. Once the research on all the existing Mills Act Contracts is complete, he will prepare a report and take it to Council to evaluate how well the program is working. • Said that he would be adding an Update to the Mills Act as a work program item for staff and the Historic Preservation Board. Board Member Moore said it was not fair that the person who applied in June for a Mills Act Contract was put off until the review of the program could be completed. Planner Daniel Fama explained that the City Council put the brake on consideration of any new Mills Act Contracts until the evaluation of the Program is completed. Board Member Blake said she believes that the applicant came in prior to Council's decision to suspend any new Mills Act applications. Planner Daniel Fama said that Council is under no obligation to approve any more Mills Act Contracts. Board Member Blake pointed out that the latest applicant paid the filing fee. Planner Daniel Fama assured the Board that that applicant was provided with a full refund of fees and will be first in line when the program continues. Board Member Moore said again that it's not right. Planner Daniel Fama: • Said that it is his hope that the audit of the Mills Act Program will show that it is working properly. • Stated that if it is not so found, it will help staff and the Board to figure out how best to address whatever is not working correctly. • Advised that it is important to develop more specific criteria for granting a Mills Act Contract. Issues such as restoration versus routine maintenance must be evaluated. Board Member Moore pointed out that we only have seven Mills Acts Contracts now. Commissioner Kendall asked how the existing contracts would be measured for compliance with the intent of the contracts. Planner Daniel Fama: • Said that this is a program of importance with a time table. • Advised that the annual reports are submitted directly to the County. Unfortunately, the County has stonewalled us. They say that Tax Code prevents them from sharing the submittal information. • Added as a result the City will have to get their own information directly from the Mills Contract holders. Board Member Kendall said she was told by someone at the County that they don't look at the annual reports submitted for Mills Act Contracts. Historic Preservation Board Minutes for September 25, 2019 Page 3 Chair Foulkes advised that the Mills Act Contract will not be brought back before the Historic Preservation Board until the intern's research is completed. Board Member Moore asked what the intern would do. Planner Daniel Fama: • Said the intern would be contacting each of the property owners of homes with a Mills Act Contract with reporting questions. • Reminded that the Planning Commission did adopt a resolution supporting the ADU Ordinance including additional language regarding historic properties. Required Certified Local Government (CLG) Training The Board and staff will conduct a training session (webinar), provided by the California Preservation Foundation, as required to maintain the City's CLG certification.
