BEING A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CAMPBELL ADOPTING A NEGATIVE
DECLARATION (PLN2015-31) FOR THE 2015-2023 HOUSING
ELEMENT.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the City Council did
determine that the adoption of a Negative Declaration provides full and adequate
environmental review for approval of the 2015-2023 Housing Element.
The City Council finds as follows with regard to the Negative Declaration:
Environmental Findin
1. An Initial Study in accordance with CEQA (California Environmental Quality Act) has
been prepared for the 2015 — 2023 Housing Element, which provides documentation
for the factual basis for concluding that a Negative Declaration may be adopted since
no substantial evidence exists, in light of the whole record, that the project may have a
significant effect on the environment. The project consists of the 2015 — 2023 Housing
Element.
Evidentiary Findings
2. The Initial Study and Negative Declaration determined that the Draft 2015 — 2023
Housing Element is a policy -level amendment, and does not include any site specific
designs or proposals, and does not grant any entitlements for development.
Additionally, no zoning or General Plan designation changes are proposed.
3. The Initial Study and Negative Declaration are consistent with the City's current 2001
General Plan.
4. The City of Campbell provided a Notice of Intent to adopt a Negative Declaration to the
public via the Campbell Express and the County Clerk.
5. The City of Campbell initially circulated the Notice of Intent (NOI) to adopt the draft
Negative Declaration and Initial Study for a 30-day public review period between
September 24, 2014 to October 24, 2014; however, due to an error to not notice all
required agencies per CEQA and the State Clearinghouse, the NOI was recirculated.
6. The City of Campbell recirculated to all required agencies and the State Clearinghouse
the NOI to adopt the draft Negative Declaration and Initial Study, and provided a 45-
day public review period of the draft Negative Declaration and Initial Study pursuant to
the California Environmental Quality Act Guidelines. The 45-day public review period
was between December 9, 2014 and January 23, 2015.
7. No mitigation measures are proposed for the Initial Study and Negative Declaration.

8. The Negative Declaration reflects the independent judgment and analysis of the
Planning Commission.
Based upon the foregoing findings of fact, the City Council further finds and concludes
that:
1. No substantial evidence has been presented from which a reasonable argument could
be made that shows that the 2015 — 2023 Housing Element, as currently presented, will
have a significant adverse impact on the environment.
2. The proposed amendment is internally consistent with the goals, policies and actions of
the General Plan; and
3. The proposed amendment would not be detrimental to the public interest, health,
safety, convenience or general welfare of the City; and
4. The Custodian of the Record for the Mitigated Negative Declaration and Initial Study is
the City Clerk of the City of Campbell, located at 70 North First Street, Campbell,
California.
THEREFORE, BE IT RESOLVED that the City Council adopts a Negative Declaration
(PLN2015-31) (attached Exhibit A) for the 2015-2023 Housing Element.
