Chapt 21.20 Density Bonus Ord (2007)TITLE: Public hearing to consider amending Title 21 of the Campbell Municipal Code, Sections 21.20.010-21.20.090, Density Bonus and Affordable Housing Incentives, in order to comply with State Housing law.. RECOMMENDATION That the City Council takes the following actions: 1. Adopt a Resolution finding that the Environmental Impact Report dated July 26, 2001 provides full and adequate environmental review for the adoption of an updated.density bonus,ordinance to comply with state law. 2. Introduce an Ordinance for first reading amending Title 21 of the Campbell Municipal Code; Sections 21.20.010-21.20.090, Density Bonus and Affordable Housing Incentives, in order to comply with State Housing law. BACKGROUND In 1991, the City of Campbell adopted.a Density Bonus Ordinance in order to meet the State Density Bonus Law which required local governments to grant a density bonus of at least 25% above the general plan density range to a housing developer whose project of five or more units contained one of the following: 1. 20% of the units for lower -income households. 2. 10% of the units for very -low income households. 3. 50% of the units for senior citizens. In addition to. granting a density bonus to developers that meet the aforementioned requirements, the jurisdiction had to provide at least one other incentive or make written findings that the additional incentive was not necessary for affordability. Adoption, of an implementing ordinance by each local jurisdiction was required. In 2004, the Zoning Code, of which the density bonus is part of, was revised to accommodate the following: 1. Bring the Zoning Code into consistency with the General Plan 2. Modernize the language and make it easier to interpret by adding illustrations 3. Provide a new organizational format. In 2005, Senate Bill 1818 amended the State Density Bonus program. In addition to bringing the City's ordinance into compliance, staff took the opportunity to further clarify the requirements of the State Housing law and to more clearly define the standards for incentives and concessions including waivers or modification of development standards. PURPOSE This study session is to review current -State Law which requires that amendments be made to the Campbell Zoning Code pertaining to the Density Bonus, to review the Planning Commission's consideration of these matters and to review options for compliance. BACKGROUND The Planning Commission held two public hearings and one study session to discuss revisions to the City's Density Bonus Ordinance in order to comply with State Housing law. The first public hearing was held June 26, 2007. There were no comments from the public. After discussing basic points of the Density Bonus law as well as numerous possible concessions and incentives, the Planning Commission voted unanimously to defer decision to amend the Density Bonus Ordinance and requested a study session to discuss and propose specific concessions/incentives to be enumerated in Campbell's Density Bonus Ordinance (reference Attachments I & 2, Staff Report and Minutes). On July 24, 2007, a Planning. Commission Study Session was held and the Commission discussed the following items: • Definition of affordable incomes for very low, low and moderate income. • Number of affordable units produced by each city in Santa Clara County. • Reviewed specific data from the State" Density Bonus law. • Comparative density bonus concession data from other Santa Clara County cities.
