The Planning Commission meeting of March 9, 1999, was called to order at 7:30 p.m., in the
Council Chambers, 70 North First Street, Campbell, California by Chairman Jones, and the
following proceedings were had, to wit:

APPROVAL OF MINUTES
Motion: On motion of Commissioner Lowe, seconded by Commissioner
Gibbons, the Planning Commission minutes of February 23, 1999,
were approved. (6-0-0-1; Commissioner Kearns abstained.)

Chairman Jones read Agenda Item No. 1 into the record.

Shelgrin, S.
Public Hearing to consider the application of Ms. Sharon
Shelgrin, on behalf of Computer Training Consultants, for
approval of a Modification (M 99-01) to a previously-approved
Conditional Use Permit (UP 98-12) for a computer training
school on property located at 144 N. San Tomas Aquino Road
in a C-2-S (General Commercial) Zoning District. This project
is Categorically Exempt. Planning Commission decision final,
unless appealed in writing to the City Clerk within 10 days.
Ms. Aki Irani, Planner I, presented the staff report as follows:
The applicant is seeking approval of a Modification to a Use Permit to allow a computer
training school within a 3,400 square foot space located on the northeast comer of West
Campbell Avenue and San Tomas Aquino Road.
· The original Use Permit was approved by the Commission in September 1998, establishing
Hardtke World of Baseball.
· This computer training school has already been established on this site and the applicant is
seeking approvals once staff became aware of the use.
· The proposal is consistent with the C-2-S (General Commercial) zoning designation and with
the General Plan designation.
· The tenant space will be separated into four training areas, two offices, a break room and a
reception area. The proposal is for up to 45 students.
· Staff finds the parking consistent with the needs of this use and recommends approval.
Commissioner Gibbons stated that the parking for this use is longer-term parking.
Ms. Aki Irani advised that there is parking to the rear of this space that the landlord has made
available for this use.
Commissioner Gibbons asked whether the building will be handicapped accessible.

Ms. Aki Irani advised that the Building Department has added Conditions of Approval to cover
the American's With Disabilities requirements.
Chairman Jones opened the Public Hearing for Agenda Item No. 1.
Ms. Sharon Shelgrin, Applicant, 144 N. San Tomas Aquino Road:
· Advised that she purchased this business five years ago.
· Informed that she would like to see her maximum student load increased to 65.
Commissioner Francois asked how many students were enrolled at this time.
Ms. Sharon Shelgrin replied three.
Chairman Jones asked staff what impact an increase to 65 students might have on the
requirements for restroom facilities.
Commissioner Gibbons added that the Building Department Conditions do not specify the
required number of restroom facilities.
Chairman Jones asked for clarification from staff.
Ms. Sharon Fierro advised that staff has no information about this number of students because
this evening is the first time Ms. Shelgrin mentioned that number of students. She added that 45
was the applicant's number from her business plan and was the basis upon which staff analysis
was made.
Commissioner Gibbons advised that the square footage determines the occupancy load of a
tenant space and the occupancy load dictates the number of restrooms that must be provided.
Suggested adding a condition to allow no more than 70 students if that occupancy load is allowed
by the Building Code.
Mr. William Seligmann, City Attomey, advised that the number of facilities is determined based
upon the maximum occupancy. The Commission can strike out any reference to maximum
occupancy from the Conditions of Approval.
Commissioner Francois stated that this site has "tons of parking" and suggested that the use not
be restricted beyond those restrictions imposed by occupancy loads.
Commissioner Kearns advised that in time the Lucky's space will also be occupied.
Chairman Jones added that parking has never been a problem at this site even when it was fully
leased.
Chairman Jones closed the Public Hearing for Agenda Item No. 1.

Upon motion of Commissioner Lowe, seconded by Commissioner Francois,
the Planning Commission adopted Resolution No. 3221 granting a
Modification to a previously-approved Conditional Use Permit to allow a
computer training school on property located at 144 N. San Tomas Aquino
Road, by the following roll call vote:
AYES: Francois, Gibbons, Hernandez, Jones, Kearns, Lindstrom,
Lowe
NOES: None
ABSENT: None
ABSTAIN: None
is final in 10 days unless appealed in writing to the City Clerk.
REPORT OF THE COMMUNITY DEVELOPMENT DIRECTOR
The written report of Mr. Steve Piasecki, Community Development Director, was accepted as
presented.
Commissioner Kearns asked what was scheduled for the next meeting.
Ms. Sharon Fierro, Senior Planner, advised that the Lucky's space at this same shopping center
was leased by a furniture store which is seeking additional signage. This signage request will be
on the agenda for March 23.
ADJOURNMENT
The Ptanning Commission meeting adjourned at 8:10 p.m. to the Planning Commission meeting
of March 23, 1999, in the Council Chambers, City Hall, 70 North First Street, Campbell,
