The staff has reconmended approval of the requested adjustment in the
side yard setback to allow the construction of a second -story addition.
The Commission has the authority to reduce the side yard setback requirement
on existing single family residences to a minimum of five feet. The appli-
cant has submitted a letter signed by nine neigh tbors stating that they
have no objection to the proposed addition. However, the neighbor who
lives closest to the proposed addition did not sign the letter. The staff
has contacted the residents to the south and advised that this request was
on file and would be considered at this meeting. No objection has been
received from them.
Commissioner `amuelson advised that he lives next door and he signed the
'
petition. He advised that the owner at 2167 Abbey Lane had constructed a tur
story addition about a year ago and there is one other house on the block
with the two-story addition. The p--perty located to the south of the sut-
ject property is exceptionally large with a substantial back yard. He
did not see how this addition would bother the adjoining property owner.
Commissioner Hebard questioned the side the two-story addition Is to be on.
M,. Sanx,elson advised that it would be to the south.

Commissioner Samuelson stated that the house to the south faces Rincon
Avenue and has a very large back yard. I`
Commissioner Hebard moved that the request of Rex Miller for an adjust-
ment In the side yard setback from nine feet to six feet be approved,
seconded by Comnissioner Stewart and unanimously adopted.

Miller, Rex in the side yard setback requirement from nine feet to
six feet to allow the addition of a second story to
an existing residence located at 2182 Alibey Lane
in an R-I Zone. (See attached map, cortractor's
statement and petition).
STAFF RECOMMENDATION:
Approval

The applicant is requesting an adjustment in the side yard setback requirement
to allow a second -story addition.
The Planning Commission has the authority to reduce the setback requirement
on existing single family residences to a minimum of five feet. It is the
staff's opinion that the construction of the addition would be in keeping
with past reductions of side yards.
The applicant has submitted a letter signed by nine neighbors stating that
they have no objection to the proposed addition. However, it should be noted
by the Commission that the neighbor who lives closest to the proposed addition
did ro: sign the letter. However, the staff his advised the residents of the
property to the south that this request was on file and would be considered
at the Miy Ist meeting of the Planning Commission. No objection has been
expressed as of this writing.
