Banfield, L. to the sideyard setback to allow a second story addition
within 518" of the side property line on property known
as 1209 Abbott Ave., in an R1-9 (Single Family Residential)
Zoning District.
STAFF RECOWENDATION
That the Planning Commission grant a 518" sideyard setback for a two story
residential addition, subject to the attached conditions.
STAFF DISCUSSION
As the Commission may recall at the meeting of February 28, 1984, it granted
a 2 foot variance to the required 5 foot sideyard setback to allow a one-
story addition on this property. The variance was needed because an existing
storage y line and the
applicant uplannedilingetosconstruct the eaddition et of etotthe house de t3'9" from this
property line.
At this time the applicant wishes to change his plans and rronstroct a two-
story addition. The addition is proposed to be setback 5'8" from the side
property while the code would require an eight foot setback. The variance
for the existing storage structure situated 3 feet francne property line would
remain effective.
As the Commission may recall, the subject property line is adjacent to a
flood control channel, hence there is no neighboring stnicture adjacent to
it. The applicant has obtained the signatures of other nearb, property
owners stating that they are not opposed 'o the setback or ,Wition.
Staff is of the opinion that the S'8" setback for the two story addition
would not be detrimental to the health, safety or general welfare of
persons residing in the reighborhood or the City, and therefore approval is
recommetmded.
CONDITIONS OF APPROVAL
1. Applicant to meet all requirements imposed by the Santa Clara Valley
Water District.
2. Applicant to obtain all necessary permi's from the Building Department.
