to allow construction of a carport on property
located at 190 Adler Avenuc, Chairman Klein
declared the public hearing open.
Mr. Ilogan stated the applicant proposes to develop the property
with a 6-unit town house type development and an additional foot
and a half is required on the southeast corner of the property
to allow the construction of the carport. Mr. Hogan presented
slides showing the subject property, lie stated there would be
approximately 60 feet between th^ proposed apartment building and
the apartments to the rear. The proposed carport will have a
recreation deck an the roof.
Commissioner Lyons wanted to know if the apartment dwellers to the
rear had registered complaints that people would be able to look
down on them and Mr. Hogan stated that apartment dwellers do not
have the benefit of being notified of what is being proposed as
architectural reviews are not a public hearing and notices are
not posted as they are for variances, use permit, etc.
Commissioner Scott questioned the adequacy of design of the
carport roof to support a number of people, if the rooftop were
to be used for recreational purposes. Mr. Hogan advised the
architectural approval would come after the variance and that
question would be considered at that time.
Commissioner Grim stated it would be interesting to know if a
6-unit apartment could be built without a variance on this size
lot.
Mr. Ilogan stated it could be done - was a matter of reducing
room sizes or bachelor -type apartments.
Chairman Klein asked if anyone wished to speak for or against
the granting of this variance.
Mr. Leo Bianchi, 21470 Celombus Avenue, Cupertino, developer,
stated they diseover.d they have two additional feet along the
side of the building and will be able to meetthe recreation
requirements. The parking has been placed to the .rear in order
to provide landscaping to the front.

Commissioner Grim moved that the hearing be closed, seconded

by Commissioner pack and carried by unanimous vote.
Commissioner Lyons moved t':at Resolution No. 857 be adopted,
approving Variance No. 68-6 subject to the following conditions:
1. The applicant is to submit plans for architectural approval.
2. Variance shall become void on May 16, 1969 if construction
not begun in accordance with "S" approval.

WHEREAS public hearing has been held in the manner specified
by law on )e application of Allan pe Grange, on behalf of
Leo Bianchi, for variance from 5 feet to 3 feet 5 inches on the
westerly property line setback to allow the construction of a
carport to be constructed at 190 Adler Avenue.
Wt1F.RFAS after oral present..tion by the Planning Director,
proponents and opponents, the hearing was closed; and
WHEREAS after discussion of all evidence pres nted, the
Planning Commission did find as follows:
1. That the narrow width of this property would restrict
good ilevelopment of the property without variance.
2. That the strict application of the ordinance requirerients
would result in unnccessary hardship and results incon-
sistent with the general intent of the Ordinance.
3. That the granting of thi application is necessary
for the preservation and enjoyment of substantial
property rights of the petitionzr.
NOW, 111FREFORE, BE IT RLSOLVED that the Planning Commission
of the City of Campbell does hereby grant the requested variance
subject to the following conditions:
1. The applicant is to submit plans for architectural
approval.
2. Variance shall become v)id on May 16, 1969 if con-
struction not bogun in accordance with "S" approval.
Said variance to become valid on the 16th day of May, 1968.

The applizant's statement reads as follows: "Request variance
of side setback from 5'-0" to 316" (plan indicated 5") at south-
east corner of property; with this approved variance, required
parking can be obtained at rear of lot, therefore providing more
desirable landscaping and spacious area around proposed town house."
This property is zoned R-:-S and contains 10,000 square feet.
The remaind^r of the area is zoned and/or developed with multiple
residential ..uildings.
The applicant proposes to construct 6 town house apartments
The sketch submitted with the application indicates that the
required parking and recreation area can he provided. Plans for
"S" approval are not submitted at this time.
If approved, Staff has prepared the necessary Resolution which
is attached for adoption.
