we are requesting a variance to allow proper constriction
of an addition to our house. We have a growing f!.mily with
five children, and our present living space is a-Jeely

For example, we need space for study areas and Ludy
materials for the children, particularly as thej progress
to high-school and college levels.
In order to provide this space in a quiet atmosphere with

Keeney for a side yard variance from 10 feet
to 8 feet to allow a second -story addition over
their garage located at 2167 Abbey Lane in an
R•-1 Zone
Chairman Scott asked Mr. Kee for his comments.
Mr. Kee stated that the staff has recommended approval of the
\` Y request. The use would not be detrimental to the area and
this request for variance la similar to other variances that
have been granted by the Commission.
Chairman. Scott declared the public hearing open and asked if
anyone wished to be heard in support or opposition to the request.
Mr, Keeney, applicant, stated that he has had no objections from
h.s neighbors and the addition would not violate the intent of
the Campbell Code.
Commissioner Paul moved that the public hearing be closed,
seconded by Commissioner Stewart and unanimously adopted.
Resolution Commissioner Paul moved that Resolution
No. 112E No. 1128 be adopted approving V 71-9, application
of Mr. and Mrs. Clare G. Keeney. Motion seconded
by Commissinner Alexander and adopted by the
following roll call vote:
AYES: Commissioners: Paul, Stewart, Nebard, Alexander, Pack,

RESOLUTION NO. 1128
PLANNING COMMISSION
CITY OF CAMPBELL, CALIFORNIA
After notification and public hearing as specified by law
on the application of Clare G. Keeney for variance to allow
construction of a second -story over the garage within eight
feet of a side property line as per application filed in the
office of the Planning Department on August 13, 1971, and after
presentation by the Planning Director, proponents and opponents,
.the hearing was closed.
After due consideration of all evidence presented, the
Planning Commission did find as follows:
1. That the granting of the variance as requested
will not be detrimental to th. health, peace,
morals, comfort or gencra'1 welfare of pel.sons
residing in the area, or injurious to property
and .improvements in the district in which it
Is located.
The Planning Commission does hereby approve the variance
as requested.
SAID VARIANCE TO BECOME VALID ON SEPTEMBER 30th, 1971.
PASSED AND ADOPTED this 20th day of September, 1971, by
the following roll call vote:

STAFF RECOMMENDATION:

STAFF DISCOSSION:
The applicant is pronosing to construct a second -story addition
over an existing, garage. The addition will not decrease anv of
the open space cf the lot, but increase the area of the house
by anproximatel• 675 square feet. The code requires that the
building be one half the height from the side proper'• line. The
existing garage is eight feet from the property line and the
addition would require the garage to be aprroximately ten feet
from the property line.
Staff is of the opinion that the use applied for will not be
detrimental to the health, safety, Deace, morals, comfort or
general welfare of persons residing or working in the neighborhood
of such proposed use, or he detrimental or injurious to property
and improvements ?- the neighborhood or to the general welfare
of the City.
