the quality of the environment, substantially
reduce the habitat of a fish or wildlife species,
cause a fish or wildlife population to drop below
self sustaining levels, threaten to eliminate a
plant or animal community, reduce the number or
restrict the range of a rare or e.idangered plant
or animal or eliminate important examples of the
major Feriods of California history or prehistozy?

b. Does the project have the potential to achieve
short-term, to the disadvantage of long-term,
environmental goals? (A short-term impact on
the environment is one which occurs in a rela-
tively brief, definitive period of time while
long-term impacts will endure well into the
a 0
future.)
c. Does the project have impacts which are indiv-
idually limited, but cumulatively considerable?
(A project may impact on two or more separate
resources where the impact on each resource
is relatively small, but where the effect of
the total of those impis on the environment
is significant.)

d. Does the project have environmental effects
which will cause substantial adverse effects
on human beings, either directly or indirectly?

Attention Martin Woodworth, Planner I
Dear Mr. Kee:
We have reviewed the preliwinary plan for a proposed addition to the Banfield
residence at 1209 Abbott Avenue, File V84-01, sent to us on February 2.
Smith Creex runs adjacent to the northerly property line and is a concrete
"U" Frame section channel with adequate capacity and contained within an
adequate chain link fenced right of way.
No footing details were shown, therefore minimum building setback from the
channel right of way line is 8 feet. The setback could be reduced if the
building footings extend below ground. The typical section marked on the
enclosed copy of one of the plans may be used to compute the reduction.
The District's right of way fence should be labeled as chain link with a note
specifying that any fence removed or damaged due to construction is to be
replaced in kind and in accord with Section 80 of State Specs.
In accordance with District Ordinance 75-6, the owner should show any existing
well(s) on the plans and inform us regarding their proposed use. Please
contact Mr. David Zozaya at 265-2600, extension 382, for information about
well permits.
Because it can affect the operation and maintenance of the channel, g—ading
adjacent to the right of way should be done in accordance with District Detail

RELIC HEARING HELD BEFORE THE
PI. -,;ING OMISSION ON 2/28/94.
RE$. N0. 2264 APPROVING 2'
VARIANCE TO SIMARD SETBACK
TO ALLOW ADDITION. (VOTE:5-0-2)
- ITEM NO. 8
STAFF C044ENT SHEET - PLMING COWISSION DIEEIING OF FEBRUARY 28, 1984
V 84-01 Public hearing to consider application of Mr. Lorin
Banf_ ld, L. Banfield for a 2 ft. variance to the required S ft.
side yard setback requirement to allow an addition to
a house on property known rs 1209 Abbott Ave. in a
R1-9 (Single Family Residential, 9,000 sq. ft. mini-
mum lot size) Zoning District.
STAFF REL'Ohr£NDATION:
That the Planning Commission adopt a resolution approving this application,
subject to the attached conditions.
The applicant is requesting a 2 ft. variance to the required S ft. side yard
setback requirement. Currently a storage building exists within 3 ft. of the
side property line and the appli=ant wishes to construct an addition to the
house which would be setback 3'!," from the side property line. Attached is
a letter from the applicant outlining his reasons for the variance.
Staff is of the opinion that a h..rdship unique to the property exists. Es-
sentially the triangular configuration of the property makes it difficult
to make reasonable use of the property while maintaining the required setbacks.
The variance would not be detrimental to the immediate area or the City as a
whole. For these reasons Staff is recommending approval of the variance.
This application has been routed to the Santa Clara Valley Water District
which owns the adjacent flood control channel to the north. Per telephone
discussion the district indicated that it would have some requirements re-
garding the footings of the addition closest to the flood control channel,
hence condition of approval 81.
Also, the applicant should be aware that the storage building in the rear
will have to be structurally attached to the new addition because it is
setback only 4'4" from the proposed addition, hence condition 02.
CONDITIONS OF APPROVAL:
1. Applicant to meet all requirements of the Santa Clara Valley Water District.
2. Storage building in rear to be structurally attached to room add':ion.
3. Applicant to obtain all necessary permits from the Building Department.
RRRRRR
feet to our now existing 840 square foot home. In order to
do this we need to apply for a variance because our new
addition and existing building are to close to the side
yard set -back code.
We feel that we Nave an unusual and unique situation
Ind that we would be suffering a great hardship if denied
this proposal. There are several reasons for our unusual
circumstances.
First, our property and home are smaller than the
other lots and homes in the same general area. Most of
the homes are at least a h acre, if not more.
Second, and one of the biggest problems is that the
lot is triangular in shape. In order to keep our addition
running parallel to our existing house, we cross over the
side -yard set -back codes. Ii our lot was sumewhat of a
square shape this wouldn't happen.
Third, part of our lot was taken by the San Jose Flood
Control, causing our lot to have less footage down the
side -yard where the addition is proposed. We probably
would not have had •o apply for for the side -yard variance
if this had not happened.
We feel this variance would cause no hardship upon
our neighbors or to the San Jose Flood Control. In fact
our neighbors would look. forward to the great improvement
to the reighborhood.
Thank you for c.ny consideration you can give to this
matter.
Sincerely,
The Banfield Family
