STAFF REL'Ohr£NDATION: That the Planning Commission adopt a resolution approving this application, subject to the attached conditions. The applicant is requesting a 2 ft. variance to the required S ft. side yard setback requirement. Currently a storage building exists within 3 ft. of the side property line and the appli=ant wishes to construct an addition to the house which would be setback 3'!," from the side property line. Attached is a letter from the applicant outlining his reasons for the variance. Staff is of the opinion that a h..rdship unique to the property exists. Es- sentially the triangular configuration of the property makes it difficult to make reasonable use of the property while maintaining the required setbacks. The variance would not be detrimental to the immediate area or the City as a whole. For these reasons Staff is recommending approval of the variance. This application has been routed to the Santa Clara Valley Water District which owns the adjacent flood control channel to the north. Per telephone discussion the district indicated that it would have some requirements re- garding the footings of the addition closest to the flood control channel, hence condition of approval 81. Also, the applicant should be aware that the storage building in the rear will have to be structurally attached to the new addition because it is setback only 4'4" from the proposed addition, hence condition 02. CONDITIONS OF APPROVAL: 1. Applicant to meet all requirements of the Santa Clara Valley Water District. 2. Storage building in rear to be structurally attached to room add':ion. 3. In order to do this we need to apply for a variance because our new addition and existing building are to close to the side yard set -back code. We feel that we Nave an unusual and unique situation Ind that we would be suffering a great hardship if denied this proposal. There are several reasons for our unusual circumstances. First, our property and home are smaller than the other lots and homes in the same general area. Most of the homes are at least a h acre, if not more. Second, and one of the biggest problems is that the lot is triangular in shape. In order to keep our addition running parallel to our existing house, we cross over the side -yard set -back codes. Ii our lot was sumewhat of a square shape this wouldn't happen. Third, part of our lot was taken by the San Jose Flood Control, causing our lot to have less footage down the side -yard where the addition is proposed. We probably would not have had •o apply for for the side -yard variance if this had not happened. We feel this variance would cause no hardship upon our neighbors or to the San Jose Flood Control.
