BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CAMPBELL
APPROVING A HISTORIC LANDMARK DESIGNATION FOR THE RESIDENCE AND
PROPERTY KNOWN AS 76 ALICE AVENUE IN AN R-1-H (SINGLE FAMILY RESI-
DENT�AL/HISTORIC OVERLAY) ZONING DISTRICT. APPLICATION OF MR. AND
MRS. GEORGE MAXWELL, HPB 90-03.
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That the City of Campbell hereby designates the residence and
property known as 76 Alice Avenue in an R-1-H (single Family
Residential/Historic Overlay) Zoning District, as an Historic Landmark, as per
the application of Mr. and Mrs. George Maxwell.
SECTION TWO: This Ordinance shall become effective thirty days following
its passage and adoption, and shall be published once within fifteen days upon
passage and adoption in the San Jose Mercury News, a newspaper of general
circulation in the City of Campbell, County of Santa Clara.

PLANNING COMMISSION RECOMMENUATION
The Plannitg Commission recommends that the City Council take the
following actions:
1. Approve the Negative Declaration that has been prepared for
this appl—ation.
2. Designate the property located at 76 Alice Avenue as an
Historic Landmark.
The subject property is located in the Alice Avenue Historic Overl-.ry
Zoning District that was established by the City Council in March,
1987. At this time the owners of the property are requesting that an
Historic Landmark" designation be approved for their home which was
built in the early 1920's. (See attached Historic Resources
Inventory).
ZONING AND GENERAL PLAN CONSISTENCY
The proposed Historic Landmark designation is consistent with the
R-1-H (Single Family Residential/Historic Overlay) Zoning District,
and with the Land Use Element of the General Plan which designates
"Low Density Residential" land use for the site.
MAJOR ISSUES
None.
Planning Commission and Historic preservation Board Actions:
On May 23, 1990, the Historic Preservation Board adopted Resolution
No. 22 by a 5-o-0 vote recommending that the Planning Commission and
the city Council take the necessary actions to designate this property
as an Historic Landmark.

BEING A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF CAMPBELL RECOMMENDING DESIGNATION OF
THE PROPERTY LOCATED AT 76 ALICE AVENUE AS AN HISTORIC
LANDMARK ZC 90-05/HPB 90-03)
After notification and Public Hearing as specified by law on the
application filed by Mr. and Mrs. George Maxwell for designation of
their residential property at 76 Alice Avenue, in an R-1-H
(Single -Family Residential/Historic overly) Zoning District, as an
Historic Landmark in the City of Campbell, and after testimony by
proponents and opponents the hearing was closed.
After due consideration of all evidence presented, the Planning
Commission did find as follows:
1. This residential structure is representative of the historic
character of the Alice Avenue Historic District.
2. The 1)uilding is in good condition and has not been altered
significantly.
3• Designation of this structure as a landmark will emphasize the
importance of the Alice Avenue Historic District to the
Community.
Based upon the above findings, the Planning Commission of the City of
Campbell does hereby recommend that the City Council take action to
designate the property at 76 Alice Avenue, Campbell, California, as an
Historic Landmark.

Chairperson Perrine read the Application into the record.
Staff Presentation: Gloria Sciara, Planner I, presented the Staff
Report noting the staff recommendation to adopt a resolution approving
the Historic Landmark designation and Zone Change.
Commissioner Alne asked staff to explain the process relating to
Historic Landmark designation.
Ms. Sciara explained that the Applicant applied to the Historic
Preservation Board for the designation and then the City has to initiate
the Zone Change.
The Public Hearing on ZC 90-05 was opened.
Public Comment:
There were no public comments.

UNANIMOUSLY APPROVED.
Commissioner Christ asked if the barn, also located on the property
would be part of the Historic Designation. In response Ms. Sciara
stated that she felt it would be included as an accessory structure.

District. This Historic District was created by the City
Council on March 3, 1987, to help preserve the character of
the Alice Avenue neighborhr,od.
B. General Plan Designation: The site is designated
Low -Density Residential, less than 6 units per gross acre.
The proposal is consistent with the General Plan and is
developed at 3 units per gross acre.

ARQUI. SIGNIFICAvCB: The architectural style can be
categorized as Provincial Period Revival c. 1920-41) and is
one-story wood framed house finished with stucco, wood shingled
hipped roof, with a front gable. The exterior treatment
consists of triple case -type windows with square pane glass in
the front gable and three rectangular sash hung windows in the
northwest front facade.
HISTORIC SIGNIFICANCE: The residence was constructed in
approximately 1922 and owned by Mr. George E. Hyde, owner of a
canning and fruit dehydrating plant, in Campbell. Alice Avenue
was created in 1915 on a portion of the site of the fruit drying
yards owned by the Hyde Company. The residential subdivision
was called the Hyde Residential Park after George and Alice
Hyde.
The property was later owned by Mr. Lee Saunders an early
weightmaster and receiving foreman for the J. C. Ainsley
Company.
In 1958, the property was acquired by Mr. George Maxwell. Mr.
Maxwell was the first full-time Fire Chief for the City of
Campbell and served the City from 1958 until 1972.

Mr. Stafford reviewed the staff report which had been prepared for this
application, and noted that the concerns raised by the Board at the last
meeting regarding a lawsuit between the applicant and her son and the legality
of the subdivision were still unresolved. Staff recommended that this
application be withdrawn from the agenda until the pending issues are resolwd.

Once these issues are settled, the application could be re back for the Board's consideration.
Boardmembers Gass, Johnson, and King indicated that they did not feel
comfortable going ahead with the landmark designation at this time due to the
pending litigation and other issues mentioned.
Chairperson Hers opened the public hearing and asked if anyone in the audience
wished to speak for or against this application. There being no one, the public
hearing was closed.
Chairperson Herz asked, for the record, if Mr. Tolesano had discussed the issue
of landmark designation with the staf. Ms. Coats and Mr. Stafford indicated
that he had not.
M/S Johnson/Gass: It was moved that the Historic Preservation Board ramove
this application from the agenda until such time as the
lawsuit and legality of the lot split have been resolved.
At that time, the item could be renoticed for hearing
before the Board. Passed 5-0-0.
2. HPB 90-05 Public Hearing to consider the application of Mr. and
ZC 90-05 Mrs. George Maxwell to have their property located at
76 Alice Avenue designated as an Historic Landmark.
Mr. Stafford rev',.ewed the staff report for this application. It was noted that
the home is loc-,.ted in the Alice Avenue Historic Zoning District, and that the
current application is for designation of the property as a local historic
landmark.
Chairperson Herz declared the public hearing open, and asked if anyone in the
audience wished to speak for or against this application. There being no one,
the public hearing was closed.
M/S Johnson/Gass: It was moved that the Historic Preservation Board adopt
Resolution No. 22, recommendiig that the Planning
Commission and the City Council take the steps necessary
to designate the property at 76 Alice Avenue as an
Historic Landmark in the City of Campbell. Passed 5-0-0.
MISCELLANEOUS:
Chairperson Herz indicated that the date for the next study session has not
been set at this time, and that she would let staff know once a date has been
set.

HP1 90-03 Public Hearing to consider the application of Mr. and Mrs. George
ZC90-05 Maxwell to have their property located ALt 76 Alice Avenue,
Marnll,G. is an 1-1-H (Single Family Resida tial/distoric) Zoning District,
designated as an Historic Landmark.
STAFF RECOMMENDATION
That the Historic Preservation Board adopt a resolution incorporating the
attached findings, recommanding that the City Council designate the
Saunders -Maxwell House at 76 Alice Avenue as an historic landmark,
STAFF DISCUSSION:
The property owners of the residential property located at 76 Alice Avenue have
submitted a request to have their property designated as an Historic Landmark
in the City of Campbell. The property is located in the Alice Avenue Historic
District.
PROJECT SITE:
The site is currently developed with a one story wood frame house with a stucco
finish. The house has a hip roof with wood shingles and a gable in the front.
The estimated date for construction of the residence is 1922.
HISTORIC SIGNIFICANCE:
Alice Avenue was created in 1915, on a portion of the site of the fruit drying
yards owned by the George E. Hyde Company. The residential subdivision was
called the Hyde Residential Park, after George and Alice Hyde.
The property was owned by Mr. Lee Saunders, an early weighmaster and receiving
foreman for the J.C. Ainsley Company. In 1958, the property was acquired by
Mr. George Maxwell. Mr. Maxwell was the first full-time Fire Chief for the
City of Campbell and served the City from 1958 to 1792.

Staff Presentation
Mr. Stafford called attention to the following:
City Attorney advised, based on information provided by
applicant, enough information was available to proceed with
application.
Boardmember Johnson expressed the concern of the other boardmembers
that they felt they had continued this hearing from previous meetings
because of earthquake damage, and the Building Department had
recommended doing nothing until the repairs have been made.

Mr. Stafford brought their attention to Condition of Approval 11
wherein no permits would be issued by the Building Department until
applicant satisfied all their requirements. He also reported that
after speaking to applicant, the engineer's report is not completed
at this time. There was no urgency in this matter, and if the Board
wished to continue to for one more month, there would be no problem.
Public Hearing was opened.
Mr. James E. Tolosano, 1222 Harriet Ave., Campbell. Mr. Tolosano,
son of the applicant, addressed the Board. He reported that the
status of his lawsuit with his mother could take quite some time and
he asked the Board to consider postponing this application for as
long as possible.
The Board clarified his questions as to what a Historic Landmark
actually entails, and its procedures. He was encouraged by Museum
director Coats to stop by the Museum where she would c'••e him
information which would enable him to better understs.id the
procedure.
No other speakers were present.
Board Discussion;
Boardmember King suggested we take matter off calendar until legal
matter could be clarified. Mr. Stafford suggested continuing the
hearing for one more month which would enable Mr. Tolosan, to bring
to the Board any new information on the law suit. Should no
resolution take place at the next meeting, he recommended supporting
Boardmember King's suggestion to take the mattes off calendar and
re -noticed when it became appropriate.
HIS Johnson/Gass Motion to continue Public Hearing on HPB 90-02 to
the next regular scheduled meeting of the Historic
Preservation Board of May 23, 1990. Passed
5-0-0-0.

1. Santa Clara County
Chairperson Herz reported the Santa Clara County Board of
Supervisors gave $300,000 to Campbell to assist in the move of
the Ainsley house to its new location, which would become the
Museum. She also reported that careful consideration would be
given to the house -movers, so that no damage would be caused.

Vice Chairperson Johnson reported on the Campbell Historic
Museum Association. She noted there was a lot of non visual
activity taking place, more of a "housecleaning" nature to get
ready for the commitment they will be facing, once the Ainsley
house is moved. Reorganizing/restructuring board committees,
restrPhaseuItandnwill bewaddressingpecial Councilund andraiser Board on1ll Mayi8th to
give report, which will be a preliminary study.
She also reported the new Controller is Jane Meyer.
History of Campbell Book. Should be ready from printer
sometime in late June or early July.
In a previews meeting, it had been suggested that reports from
both of the above Boards be sent to the other. Vice
Chairperson Johnson reported this had now been *tone.

Alice Avenue was created in 1915 on a portion of the site of the fruit drying yards
owned by George E. Hyde Company, a canning and fruit dehydrating plant occupying
17 acres in Campbell. The land was originally owned and utilized by Fleming's
Fruit Oryer (1887); sold to Frank Buxton's Dryer (1890) and again sold to Campbell
Fruit Grower's Union (1892) which owned and controlled the drying yards and packing
house until its sale to George Hyde in 1909. The residential subdivision "Hyde
Residential Park" although George
and Alice Hyde (the street's namesake) resided there too.
Lee Saunders was an early weighmaster and receiving foreman for J.C. Ainsley
Packing Company, Campbell. G% Maxwell purchased the house in 1953. Maxwell
was the first full-time fire chin Campbell, replacing volunteer chief, Jack
Scott, and serving from 1958 to 1972.
