The City Council of the City of Campbell does ordain as follows: SECTION ONE: That the City of Campbell hereby designates the residence and property known as 76 Alice Avenue in an R-1-H (single Family Residential/Historic Overlay) Zoning District, as an Historic Landmark, as per the application of Mr. and Mrs. George Maxwell. SECTION TWO: This Ordinance shall become effective thirty days following its passage and adoption, and shall be published once within fifteen days upon passage and adoption in the San Jose Mercury News, a newspaper of general circulation in the City of Campbell, County of Santa Clara. Approve the Negative Declaration that has been prepared for this appl—ation. 2. Designate the property located at 76 Alice Avenue as an Historic Landmark. The subject property is located in the Alice Avenue Historic Overl-.ry Zoning District that was established by the City Council in March, 1987. At this time the owners of the property are requesting that an Historic Landmark" designation be approved for their home which was built in the early 1920's. (See attached Historic Resources Inventory). ZONING AND GENERAL PLAN CONSISTENCY The proposed Historic Landmark designation is consistent with the R-1-H (Single Family Residential/Historic Overlay) Zoning District, and with the Land Use Element of the General Plan which designates "Low Density Residential" land use for the site. MAJOR ISSUES None. Chairperson Perrine read the Application into the record. Staff Presentation: Gloria Sciara, Planner I, presented the Staff Report noting the staff recommendation to adopt a resolution approving the Historic Landmark designation and Zone Change. Commissioner Alne asked staff to explain the process relating to Historic Landmark designation. Ms. Sciara explained that the Applicant applied to the Historic Preservation Board for the designation and then the City has to initiate the Zone Change. The Public Hearing on ZC 90-05 was opened. Commissioner Christ asked if the barn, also located on the property would be part of the Historic Designation. APPLICANT'S PROPOSAL The property owners of the residential property located at 76 Alice Avenue has requested designation of their home as a Historic Landmark under the Historic Landmark provisions of the Historic Preservation Ordinance. Zoning Designation: The site is designated for R-1-H (Single -Family Residential/Historic Overlay) Zoning District. This Historic District was created by the City Council on March 3, 1987, to help preserve the character of the Alice Avenue neighborhr,od. B. General Plan Designation: The site is designated Low -Density Residential, less than 6 units per gross acre. The proposal is consistent with the General Plan and is developed at 3 units per gross acre. SIGNIFICAvCB: The architectural style can be categorized as Provincial Period Revival c. 1920-41) and is one-story wood framed house finished with stucco, wood shingled hipped roof, with a front gable. The exterior treatment consists of triple case -type windows with square pane glass in the front gable and three rectangular sash hung windows in the northwest front facade. HISTORIC SIGNIFICANCE: The residence was constructed in approximately 1922 and owned by Mr. George E. Hyde, owner of a canning and fruit dehydrating plant, in Campbell. Alice Avenue was created in 1915 on a portion of the site of the fruit drying yards owned by the Hyde Company. The residential subdivision was called the Hyde Residential Park after George and Alice Hyde. The property was later owned by Mr. Lee Saunders an early weightmaster and receiving foreman for the J. C. Ainsley Company. In 1958, the property was acquired by Mr. George Maxwell. Mr. Maxwell was the first full-time Fire Chief for the City of Campbell and served the City from 1958 until 1972. Staff recommended that this application be withdrawn from the agenda until the pending issues are resolwd. -noticed and brought Once these issues are settled, the application could be re back for the Board's consideration. Boardmembers Gass, Johnson, and King indicated that they did not feel comfortable going ahead with the landmark designation at this time due to the pending litigation and other issues mentioned. Chairperson Hers opened the public hearing and asked if anyone in the audience wished to speak for or against this application. There being no one, the public hearing was closed. Chairperson Herz asked, for the record, if Mr. Tolesano had discussed the issue of landmark designation with the staf. Ms. Coats and Mr. Stafford indicated that he had not. M/S Johnson/Gass: It was moved that the Historic Preservation Board ramove this application from the agenda until such time as the lawsuit and legality of the lot split have been resolved. HPB 90-05 Public Hearing to consider the application of Mr. and ZC 90-05 Mrs. George Maxwell to have their property located at 76 Alice Avenue designated as an Historic Landmark. It was noted that the home is loc-,.ted in the Alice Avenue Historic Zoning District, and that the current application is for designation of the property as a local historic landmark. STAFF RECOMMENDATION That the Historic Preservation Board adopt a resolution incorporating the attached findings, recommanding that the City Council designate the Saunders -Maxwell House at 76 Alice Avenue as an historic landmark, STAFF DISCUSSION: The property owners of the residential property located at 76 Alice Avenue have submitted a request to have their property designated as an Historic Landmark in the City of Campbell. The property is located in the Alice Avenue Historic District. PROJECT SITE: The site is currently developed with a one story wood frame house with a stucco finish. The house has a hip roof with wood shingles and a gable in the front. The estimated date for construction of the residence is 1922. HISTORIC SIGNIFICANCE: Alice Avenue was created in 1915, on a portion of the site of the fruit drying yards owned by the George E. Hyde Company. The residential subdivision was called the Hyde Residential Park, after George and Alice Hyde. The property was owned by Mr. Lee Saunders, an early weighmaster and receiving foreman for the J.C. Ainsley Company. In 1958, the property was acquired by Mr. George Maxwell. Mr. Maxwell was the first full-time Fire Chief for the City of Campbell and served the City from 1958 to 1792. Boardmember Johnson expressed the concern of the other boardmembers that they felt they had continued this hearing from previous meetings because of earthquake damage, and the Building Department had recommended doing nothing until the repairs have been made. There was no urgency in this matter, and if the Board wished to continue to for one more month, there would be no problem. Public Hearing was opened. Mr. James E. Tolosano, 1222 Harriet Ave., Campbell. Mr. Tolosano, son of the applicant, addressed the Board. He reported that the status of his lawsuit with his mother could take quite some time and he asked the Board to consider postponing this application for as long as possible. The Board clarified his questions as to what a Historic Landmark actually entails, and its procedures. He was encouraged by Museum director Coats to stop by the Museum where she would c'••e him information which would enable him to better understs.id the procedure. No other speakers were present. Board Discussion; Boardmember King suggested we take matter off calendar until legal matter could be clarified. Mr. Stafford suggested continuing the hearing for one more month which would enable Mr. Tolosan, to bring to the Board any new information on the law suit. Should no resolution take place at the next meeting, he recommended supporting Boardmember King's suggestion to take the mattes off calendar and re -noticed when it became appropriate.
