Bascom Avenue Dear Mr. Sockolov: Per our letter dated June 22, 1994, the City established a deadline of June 29 to have a final design submitted for the above -referenced project and July 15 to have construction completed. The City realizes that MTS has been working towards having the construction completed by the July 15th date. For that reason, the City is flexing the deadlines w stated below in the interest of completing this project. Kier & Wright has submitted a draft plan for the construction of the storm lateral for the above -referenced project. This plan is acceptable to the City provided revisions are made per the comments transmitted to Kier & Wright on July 11, .994. The City is requiring that the final plans and application for the permit be completed and submitted by Friday, lulu 15, 1994. Per the draft plan, a new manhole is required in the middle of the City's proposed 24" storm main. Per our conversation on Monday, July 11, the full cost of installing this manhole would be Tower Records' responsibility. The City will obtain a separate price to construct the manhole at the point of tie-in of the Tower Records storm lateral to the City's new 14" RCP mainline. If the price is agreeable to MTS, then MTS must reimburse the City for the full cost of constructing the manhole (cost plus 15 % overhead) prior to the construction of the manhole. If MTS desires to construct the manhole with the construction of their line, they may do so. Construction of your storm lateral must occur concurrently with or immediately after the construction of the City's line. Construction must be complete within three calendar days of the completion of the City's line. It will be the responsibility of MTS to coordinate the construction of their storm drain lateral with the City and with the other contractors working on the site. Construction of the storm drain lateral must not impact the construction of the City's Bascom Avenue Interconnect and Resurfacing project. If the construction is not complete within the timeframe established above, the City will assume construction of the project and MTS, Inc. will reimburse the City for all costs incurred in the construction of the storm line, including delay costs to the City's Bascom Avenue Interconnect and Resurfacing contract. Also, the plan comments returned to Kier & Wright include traffic control requirements, permitted lane closure times and damages for violation of traffic control requirements. These requirements allow for two lanes in the northbound direction to be closed from 7:00 pm to 7:00am and southbound 9:00pm to 10:00am. This indicates that the work will probably be performed at night. Please make sure that these requirements are passed on to your contractor. Per the Conditions of Approval, the cortr tion was to be made prior to May 11, 1994. This date has passed and construction of the City's Bascom Avenue Interconnect and Resurfacing project is now underway. The City has developed the following conditions for your storm drain to be constructed now that the May I Ith deadline has passed. These conditions must be met or - permit for on -site construction wall not be issued. Design Finalization: The Owner (NITS, Inc./Tower) will verify locations and depths of utilities where the potential for conflict exists prior to June 29, 1994. Complete design plans must be submitted to the City by this date. City Con unction: The City will rnnstru%:t a 33" storm drain line between two existing manholes as indicated on the attaLhed plan and reconstruct the upstream manhole at a greater depth tj accommodate ,our storm line. Owner Construction: Based on the preliminary design, Tower of Records will construct a 15" RCP storm drain line from the northeast corner of McBain and Bascom to the newly reconstructed manhole. The line must be constructed and trench restoration completed prior to July 15. 1994. The line must be installed in coordination with other work currently under progress on Bascom Avenue. The City will contribute the incremental cost of upsizing the line from 12" to 15" in diameter, estimated to be $3.00 per linear foot of pipe. OF A MODIFICATION TO A PREVIOUSLY -APPROVED SITE PLAN ALLOWING THE EXPANSION OF A PARKING AREA ON PROPERTY LOCATED AT 1920 S. BASCOM AVENUE. APPLICATION OF MS. After notification and Iiearing on the application of Ms. Diane Waters, Monigham & Associates Architects, on behalf of Tower Records, for a modification to a Condition of Approval to a previously -approved site plan allowing the expansion of a parking area on property located at 1920 S. M 94-01 Public Hearing to consider the request of Ms. Diane Waters, on behalf of Monighan & Associates Architects, for approval of a Modification to a previously approved site plan allowing the expansion of a parking area on property located at 1920 S. Bascom Avenue in a C-2-S (General Commercial) Zoning District. Mr. Tim Haley, Associate Planner, presented the staff report noting the following: • Applicant is seeking a modification to a previous Site & Architectural approval to expand the parking area adjacent to Tower Records. The project is an "L-Shaped" lot consisting of .8 acres and allow 74 parking spaces. The site was previously the location of two (2) two-story office buildings which have been demolished. • Surrounding uses include Tower Records, parking and single-family residential to the North; Commercial and single-family residences to the South; single-family residences to the East and Commercial to the West. • The Zoning of the site is C-2-5 (General Commercial) and a parking facility is a permitted use in that zoning subject to approval of a Site & Architectural approval. • Applicant is seeking approval of a driveway leading south to Fewtrell Drive. Staff recommends denial of this request on the basis of safety and to avoid commercial traffic on Fewtrell. • The proposal includes 27% of the site as landscaping. Staff has recommended the expansion of the landscape strip at the rear of the site from four feet to eight feed to be planted with screening type trees and along Bascom Avenue. • The City Engineer has recommended that the storm drains be tied into the City's storm drain system which will involve connection across Bascom Avenue. • Staff recommends appro. A of this application with the recommended increase in landscape and the a"mination of the o iveway connection to Fewti e11. Planning Commission Minutes of March 8, 1994 Page 3 Commissioner Alne presented the Site and Architectural Review Committee position as follows: • SARC concurrea with the staff's landscaping recommendation. • SARC expressed concern for the potential costs to the applicant to meet the requirement for storm area drainage hook up particularly if that requirement also was extended to include the existing Tower Records site. • SARC decided that the issue of the driveway extending south to Fewtrell was one which the whole Commission needed to consider rather than the SARC Committee representatives. Gary Kruger, Traffic Engineer. • Upon evaluation by City staff, the maior reason for not installing the driveway through to Fewtrell is for concerns of public safety. The area already experiences regular rear end accidents as drive through traffic for the restaurant ends up stranded in traffic due to overcrowding. • The City will be changing the signal at Bascom and Campbell to allow more time for u-turn traffic which will increase when the lest -turn lane onto McBain is permanently closed as planned during upcoming street improvement plan for S. Bascom Avenue. • i.ddit;onally, a barrier is planned for Fewtrell to help limit through traffic similar to that installed on McBain to limit Tower Records traffic on that residential street. Chairman Perrine opened the Public Hearing on item No. 1. Public Hearing re Item No. 1 Bret Mitchell, Manager of Tower Records, 3685 S. Bascom Avenue. • Tower Records handles 39,000 transactions each month or -oughly 1,300 per day. • Most of their customers come to Tower from the North (Hamilton Avenue) the direction that will be impacted by the closure of the left turn lane onto McBain. • Fears for future "hue and cry" that Tower is causing accidents o,t S. Bascom. • Believes that the barriers on Fewtrell would eliminate any increase of cot.imercial traffic on Fewtrell that the driveway would cause. Chairman Perrine inquired of Mr. Mitchell whether the business owners (Der Weinerschnitzel and Taco Bravo) were supportive of the driveway as proposed to which Mr. Mitchell replied "yes " Planning Commission Minutes of :March 8, 1994 Page 4 Mr. James F. Veteran, 127 Memory Lane, CampLell. • Discussed his concerns regarding the lack of completion of the wall installed in 1991 separating the residences directly behind Tower Records from the parking area. Specifically, he states that the joints are very obvious and not blocked. Said that while from his side the wall is six feet tall, from the parking lot which is at a higher level, the wall is actually only five feet tall. He regularly has to pick up debris thrown over the fence into his yard. • Expressed his support of the expansion of landscaping in the rear of the lot from four feet to eight feet and is himself growing a hedge to help screen his yard from the parking lot. Commissioner Lindstrom inquired whether the applicant was in agreement with the landscaping demands to which the applicant replied he was. Commissioner Alne stated that both the business owner and the City Engineer made valid arguments for their positions but that he intended to support the position of the City Traffic Engineer who was responsible for evaluating the overall impact of the driveway on the immediate vicinity. Commissioner Lowe inquired whether the local neighbors were notified of the potential driveway to which Mr. Tim Haley replied that all residents within 300 feet of the project site were notified by mail. MOTION: On motion of Commissioner Meyer -Kennedy seconded by Commissioner Lowe, the Planning Commission unanimously moved to close the Public Hearing. (6-0-0). General Plan: The Land Use Element of the General Plan indicates a commercial land use for this property. The proposed use is consistent with a commercial land use designation. DISCUSSION Project Circulation. The applicant's proposal is providing a through driveway and a north/south access through the site to adjacent commercial developments. Staff is recommending that the proposed connection to the south of the site be eliminated in that it may encourage additional commercial traffic on Fewtrell Avenue. During recent public hearings regarding the improvement of Bascom Avenue with medians, residents of Fewtrell h,ve expressed significant concerns regarding additional through traffic caused by the commercial uses along the Bascom Avenue frontage. Although this proposed connection to the adjacent restaurants would improve access to the Tower Records operation by allowing left turn movements into the Taco Bravo parking area, staff feels that the potential for commercial traffic on Fewtrell is not desirable. Consequently, this circulation connection is not recommended. Landscaying: The applicant is providing approximately 27 percent of the site as landscaping. A majority of the buffer areas provided are along the southern and easterly boundary of the proposed parking area Staff is recommending that the rear planting area along the residential properties be increased from 4 feet to 8 feet to provide ample space for screening types of trees to grow along this portion of the project. This recommendation may be accommodated with the introduction of additional compact spaces along the rear of the proposed project. Staff additionally has recommended the introduction of trees along the Bascom Avenue frontage and the installation of a tree well along the Bascom Avenue frontage consistent with the streetscape standards and the provision of a larger landscape area behind the sidewalk of 25 feet versus 20 feet to Staff Report -- Planning Commission Meeting of March 8, 1994 1920 S. At the Site and Architectural Review Committee, the applicant expressed concern regarding the cost of this requirement. SITE AND ARCHITECTURAL REVIEW COMMITTEE The Site and Architectural Review Committee at its meeting of February 24, 1994, recommended approval of the applicant's proposal subject to e conditions recommer ded by staff with the exception of the requirement to eliminate a connection to the adjacent drive-th*u restaurant.
