Bascom Avenue Mr. Paul Ncmkoong, on behalf of Campbell Billiards has been advised and has submitted an applicat:on for a modification to a previously approved conditional use permit to allow the sale of beer and minors at his billiard establishment In 1995 under proceedings known as M 95-05, the Planning Commission adopted Resolution No. 2976 approving the same request with the exception that he had requested extended business hours to i a.m. on Fridays and Saturdays in 1995. In 1995 the City Council did not amend Chapter 5.28 of the C. M.0 allowing both minor, and the sale of beer within the same establishment nor recommend extended business hairs. As such, it appears that the applicant has comply witn all of the conditions as stipulated in Planning Commission Resolution No, 2976. The recent amendments to Chapter 5.28 would now permit the applicant to sell beer and allow minor within his establishment consistent with the planning Commission's approval. There appears to be no benefit in miurninp this issue to the Planning Commission, in that the conditions and location of this business have not changed since the 1995 approval. The Planning Commission did provide for a six month review in the event of complaints and does have the ability the consider revocation of the use permit if issues arse. If neither of you concur, please let me know at your earliest convenience so that I can continue to process this inquest. It has peen scheduled for the first Planning Commission meeting in January. CA 95008 408 177-o886 November 25, 1998 City of Campbell Planning Commission Re: ModVication of Conditional Use Permit (UP 93-04) Dear Commission Members I am requesting a modification to the above permit to comply with the rcccntly adopted amendment to the Pool and Billiards Hall ordinance under Chapter 5.28.030 of the Campbell Municipal Code which includes a provision that permits minors under the age of 21 years to enter and/or play billiards in billiard halls where on -premises alcoholic beverages are offered. I have operated a billiard room in Campbell for over 9 years. The current change in the Municipal Code provides us with the ability to better serve adults, those under 21, large and small company outings, convention groups, fraternal organizations, etc. It will keep step with all the other South Bay cities. Currently I do not sell beer on a regular basis but only when a private corporate outing, with everyone being over 21, and no minors are allowed into the facility, can this happen. So currently, those adults who want to play billiards and have a beer arc going elsewhere. We are not competitive in the corporate outing or convention group market at this time Ixrause of the prior code. My current Use Permit permits the sale of beer. The requested modification will not generate any additional traffic. Our hours of operation will remain the same, which is from noon to 2 a.m. daily. I do anticipate adding I to 2 employees to better serve and manage the consumption of alcohol. Beer sales will be incidental to retail and pool table rental time sales. At this time, no' bar" is being planned. We currently sell toad such as burgers, fries, hotdo,�s, other snack foods, soft drinks, etc. from noon to 1:30 a.m. daily. Management and sale of alcohol: Only those over 21 will be served. Employees will be• trained to indentify all patrons under 10 by requesting California ID cards and/or Driver's licenses. The employees will attend a training session at the local ABC office. All beverages including soft drinks will be sold in clear containers or beer in beer Ix) tles so our statt can identit -�' at is being consumed. Training by the ABC will also assist employee% on ho" to idenify if someone is becoming intoxicated. In all cases, no one will be served any alcoholic beverage if he/she is intoxicated, or shows any sign of becoming intoxicated. Any patron who is questionable as a driver will be driven home or transpor- tation arranged to get them home. Any customer who creates a disturbance, intoxicated or not will be asked to leave and if there is no compliance, then the police will be called. I Groups of patrons that are minors will be designated to play in the East section of the billiard room and adults and adults with minors in the West side. This will help focus our attention to the "alcohol service" side of the room. We are able to see the entire West side of our room from anywhere employees are working. Ownership and management will have no tolerence of employees who do not follow the guidelines in selling and serving alcoholic beverages.
