approval of a new wall mounted sign, on property
known as 2270 South Bascom Avenue, in a C-2-S
(General Commercial) Zoning District.

That the Planning Commission APPROVE the applicant's signing
request with the condition that the applicant reface the
existing free-standing sign, within one year of the Planning
Commission's approval, subject to the attached conditions.
DISCUSSION
&iPPLICANT'S PROPOSAL
The applicant seeks approval of a new wall sign to identify his
business. The proposed cabinet wall sign measures approximately
49 square feet and reads "Dick's Carpet and Linoleum." The
business is currently identified by three wall signs which will
be removed with approval of this proposal and a non -conforming,
free-standing sign along the Bascom Avenue frontage.

March 6, 1990, the Planning Director considered the
applicant's request for a new wall sign to identify his
business. Staff expressed a concern regarding the applicant's
proposal in that the existing free-standing sign, which
currently identifies the business is non -conforming due to its
height and area. The applicant, at this time, is requesting
that the Commission approve a new wall sign for this property
without briro the existing free-standing sign into conformance
with the present regulations. The applicant has indicated his
willingness to remodel this free-standing sign within the next
year.
On March 6, 1990, the Planning Director requested that the
applicant address the issue of bring the free-standing sign into
conformance in conjunction with this signing request. The
removal of the existing wall signs and the replacement of those

signs with a new cabinet sign is considered a desirable change
by Staff, however, Staff does not have authority to approve new
signages at this time without bringing the free -sanding sign
into conformance.
Staff is recommending that the Planning Commission approve the
applicant's request with the condition that the existing
free-standing sign be remodelled within one year of the Planning
o:imission's approval. The existing free-standing sign should
be remodelled in terms of its size, height and design, so that
it is archit cturally compatible to the building and does not
exceed the maximum allowable height or area prescribed by the
sign ordinance

height and area requirements specified by the Sign Ordinance. A
revised sign plan should be submitted addressing a redesign of this
free-standing sign to providing a maximum sign height of 14 feet and
maximum sign area of 50 square feet. The free-standing sign should
also incorporate architectural elements of the building so that the
sign can be found architecturally compatible.

PLANNING COMIISSION RECOMMENDATION
That the City Council uphold the decision of the Planning Commission
denying without prejudice S 84-39.
DISCUSSION
This item was continued from the City Council meetings of September 18
and October 16, 1984, in order that Staff could notify the owner of
Linoleum Dick's that his sign Is in violation of City code and that
application must be submitted. Staff has notified Linoleum Dick's for
the second time, however no application has been submitted nor has there
been any contact with Staff Staff is now taking actions to abate this
illegal sign. Because no application has been approved to allow the
Linoleum Dick's sign, it is recommended that the Planning Commission
recommendation be followed and the Goldmine sign (which is attached to
the freestanding Linoleum Dick's sign) be denied without prejudice.
Below is a description of the Goldmine sign request.
The applicant has erected a sign without obtaining a permit. Staff noti-
fied him of the violation and application was submitted.
The sign is an addition to an existing "Linoleum Dick's" freestanding
sign. It measures approximately 20 sq. ft. in area, is 12-112' off the
ground and reads "Gold Mine, Coins Jewelry Gems Gold Silver Buy -Sell".
This sign is located below the "Linoleum Dick's" sign which is approximately
64 sq. ft. in area and 20' high.
The "Linoleum Dick's" sign is nonconforming in terms of size and height.
Section 21.68.150(1) of the sign code states:
1) A minor change to a nonconforming, freestanding sign for a
commercial center which identifies two or more tenants may
be allowed without bringing the entire sign into conformance
as follows:
A. A change in copy of one of the tenants if the area of
the sign proposed for change is less than 25% of the
total freestanding sign area.

B. The total display area and the height of the freestanding
sign may not be increased.
The sign as proposed does not meet this criteria in that it is an in-
crease in the total display area.
At its meeting of August 14, 1984, the Planning Commission denied (without
prejudice) this application by a 5-8-1 vote. Attached for the Council's
review Ire the minutes from the August 14, 1984 meeting pertaining to
this item.
The applicant has since appealed the Commission decision. Attached

Architectural Review Committee. The Committee is recommending denial of
this request in that the sign is being proposed to be attached to an exist-

Vice Mayor Ashworth advi_.ed the Council that due to a
conflict of interest, he would not be voting on this
issue.
Planning Director Kee - Report dated Sept tuber 18, 1984.
Mr. Kee advised the Council that the Planning Ocimmmnission
is recamiending denial without prejudice for this
particular application, in that the sign as proposed does
not meet the requirements of the Sign Code, Section
21.68.150 (1).
Mr. Richard Aioy, 2270 B South Bescan Avenue, The Gold
Mine, spoke in favor of the proposed signage in that
his building front is set back lrum the street and does
not receive adequate visibility. Mr. Aloy requested
permission from the Council to allow his sign to ruin
until Linoleu_i Dicks sign is brought into conformance.
He added that he would comply with City requirements to
bring both signs into compliance.
Mayor Doetech suggested that staff meet with the property
owner and the owners of the Gold Mine to discuss alter-
natives, so that both signs eoul,: be brought into conformance.
Following discussion, M/S: Podgorsek, Kotowski - to continue
this item for thirty (30) days so that staff can meet
with the owners of Linoleum Dicks and the Gold Mine to
discuss alternative measures to bring both signs into
conformance and to report their findings to the City Council.
Motion adopted by a 4-0-0-1 vote, Councilman Ashworth
abstaining due to a oonflict of interest.

That the City Council uphold the decision of the Planning Commission denying
without prejudice S 84-39.
DISCUSSION
The applicant has erected a sign without obtaining a permit. Staff notified
him of the violation and application was submitted.
The sign is an addition to an existing "Linoleum Dicks" free-standing sign.
It measures approximately 20 sq.ft. in area, is 12-1/2' off the ground and
reads "Gold Mine, Coins Jewelry Gems Gold Silver Buy -Sell." This sign is
located below the "Linoleum Dicks" sign which is approximately 64 sq.ft. in
area and 20' high.
The "Linoleum Dicks" sign is nonconforming in terms of size, and height.
Section 21.68.150(1) of the sign code states:
1) A minor change to a nonconforming, freestanding sign for a
commercial center which identifies two or more tenants may
be allowed without bringing the entire sign into conformance
as follows:
A. A change in copy of one of the tenants if the area of
the sign proposed for change is less then 25% of the
total freestanding sign area.
B. The total display area and the height of the freestanding
sign may not be increase9.
The sign as proposed does not meet this criteria in that is is an increase
in the total display area.
At its meeting of August 14, 1984 the Planning Commmis3ion denied (without
prejudice) this application by a 5-0-1 vote. Attached for the-Cmacil's
review are the minutes from the August 14, 1984 meeting pertaining to
this item.

Commissioner Howard reported that this item was before the Site and Archi-
tectural Review Committee. The Committee is requesting a continuance in
order to clarify some information on the signage in front of the site,
and it is necessary for Staff to research past records. The situation
imalves the free-standing sign for Linoleum Dicks, which is nonconform-
ing and may be under the grandfather clause.

This item was continued from the meeting of July 10, 1984 in o,der that
Staff could investigate past Permits for the business and the date of
annexation by the City. Attached Cor the Commission's review is the
previous Staff Comment Sheet.
Research indicates that the property was annexed to the City in 1968.
The records indicate that no permits have ever been issued to the "GDldmine"
for signing at this address. A review of the photo sign inventory complete
in 1975 indicates no sign attached to the main "Linoleum Dicks" sign.
Staff again is recommending a denial of this application for the reasons
stated in the Staff Comment Sheet of .July 10, 1984.

C-2-S (General Commercial) Zoning District.
STAFF RhCOWENDATION
That the Planning Commission deny this application.
STAFF DISCUSSION
The applicant has erected a sign without obtaining a permit. Staff
notified him of the violation and application is now being submitted.
The sign is an addition to the existing "Linoleum (licks" freestanding
sign. It measures approximately 20 sq. ft. in area, is 12� feet off the
ground and reads "Gold INtine, Coins Jewelry Gems Gold Silver Buy -Sell."
This sign is located below the "Linolewm Dicks" sign which is approximately
64 sq. ft. in area and 20 feet high.
The "Linoleum Dicks" sign is nonconforming in terms of size, and height.
Section 21.68.150 (1) of the sign code states:
1) A minor change to a nonconforming, freestanding sign for a
commercial center which identifies two or more tenants may
be allowed without bringing the entire sign into conformance
as follows:
A. A change in copy of one of th,: tenants if the area
of the sign proposed for change is less n 25% of
the total freestanding sign area.
B. The total display area and the height of the free-
standing sign may not be increased.
The sign as proposed does rat meet this criteria in that it is an increase
in the total display area. Therefore, Staff is recommending denial.
