Commissioner Christ reported that this application was considered by the
Site and Architectural Review Committee. In that concerns expressed in
the Staff Comment Sheet were adequately addressed at the Site Committee
meeting, the rommittee is reco—er.li—I approval.
Mr. Jacobsen noted that Spoons has peen very successful, and would like to
enlarge their waiting area and vestibule. Revised plans indicate the
removal of proposed awnings, the addition of a patio area as previously
approved, and the removal of proposed seating in the patio area. Mr.
Jacobsen continued that Spoons is willing to do anything to indicate that
this is a waiting area only --that it is just to relieve the entryway for
waiting customers.
Mr. Kee stated that Staff is recommending approval; however, Staff would
like the revised plans to come back to the Planning Director for approval.
Commissioner olszewski expressed a concern that there are tables in the
waitina area, which would allow it to be used as a lounge, which could
increase the existing parking problem.

Commrssicner Christ noted that Spoons has stated they are willing to post
signs in the area, and will not serve food or drink in this area. They
did feel that it would be difficult to step someone from taking a drink
into the area while waiting for a table. The Committee felt that not
eervinq in this area, as we)1 as the area not being enclosaA, would help
to keep it for wait i-1 opt`
Commissioner Dickson noted that Staff has made an observation that parkinq
is a major problem, and asked if there were any recommendations to
alleviate this problem.
Mr. Kee indicated that Staff has ne recommendations on this issue. This
is a similar situ -,Lion to Tower Records, in that it is a very successful
retail operation. The parking is provided .., a ratio indicated in the
Zoning Ordinance.
Mr. Jacobsen stated that perhaps something might be worked o� with the
adjacent Creekside Offices during the office complex's off h.urs; and, h,
wo'.:ld ask Spoons management to look into the possibility.

STAFF RECOMMENDATION
1. That the Planning Commission deny the applicant's request.
2. If approved, subject to the condition that the applicant meet all
the conditions of the Building and Fire Departments.
STAFF DISCUSSION
As the Planning Commission may recall, at its meeting of October 9, 1984
it approved plans to allow an outdoor patio/seating area adjacent to the
bar. The patio was proposed to accommodate 16 seats and would he
surrounded by a 4'8" split -face block wall. At this time, the applicant
is proposing to modify the patio by adding a structure to support a fixed
and roil -back awning and to eliminate the inside planting area, thus
increasing the patio area by approximately 60 sq.ft. Lights, fans, and
infrared patio heaters would also be added.
Secondly, the applicant is proposing to enclose an 11' x 7' area at the
entrance to the restaurant so as to accommodate additional inside waiting
space.
As the Commission may recall, at the time the patio addition was applied
for, a concern was expressed regarding inadequate parking for the
restaurant. However, at that time the restaurant was fairly new and it
was believed that once the initial "newness" of the restaurant wore off
that the parking would be adequate. However, Staff's observations of the
restaurant have indicated that parking is still a major problem. At lunch
and dinner time the parking lot is full and many customers are parking in
the adjacent 1nt at Creekside Business Mall. In light of the parking
problem, Staff cannot support any modifications to the restaurant which
would encourage more customers. Staff would recommend that the applicant
submit a proposal to alleviate the parking problem prior to any
modifications of the restaurant.
It should be noted that Staff and the Architectural Advisor are cf the
opinion that the design of the improvements themselves are acceptable.

Staff has previously expressed a concern regarding the expansion of this
use in light demand

the recently open
restaurant operation at this location has been rather
successful, consequently facilities have been fully utilized. Staff,

adequate for the
proposed seating in the regular operation of this
restaurant.

(formerly Flagg's and Jolly Rogers) into a Spoons Restaurant.
The applicant at this time is requesting approval of a minor modification to
allow the addition of a patio/seating area adjacent to the existing bar towards
the rear parking area. The proposed outdoor patio would accomodate 16 additional
seats and would be surrounded by a 418" split -face block wall.
The additional seating would bring the total seating to 168 seats for this res-
taurant. The provided parking on site indicates 64 parking spaces or a ratio
of 1 parking space for every 2.63 seats. The provided parking satisfies the
parking code requirement of 1 space per 3 seats with a restaurant use, however,
Staff is of the opinion that no additional seating should be approved unless
additional parking is provided.
Section 21.50.030 of the Zoning Ordinance states:
"Off-street loading spaces shall he provided in amounts and locations
as required by the Planning Commission. Loading space shall be
sufficient to accommodate the largest vehicle which may be used for
loading on the premises.
The Planning Comnissi, shall have authority to adjust these re-
quirements for a specific use at a specific location to require either
a greater or lesser number of parking spaces when it determines that
circumstances are such as to warrant an adjustment. For all uses not
specified in this section, parking spaces shall be provided as re-
quired by the Planning Commission. (Ord. 1191 S;, 1978: Ord. 1019
S1, Exhibit A, (part) 1976; Prior code S9319 (C))."

Staff is of the opinion that due to the usage of the current parking facilities,
that the P-an.ing Commission should not permit an expansion of this use unless
additional _.rking is provided.
Additionally, Staff expresses a concern that the proposed design reduces the
amount of landscaping on site and also provides a rather unattractive addition
to the rear elevation of this restaurant. A raised planting area between the
porposed wall and the parking area would be recommended.

discussed, the City is willing to approve your charity fund raising
c ent on a ONE TIME BASIS only this year. Next year, it will be
your responsibility to apply for all needed permits in a timely
manner.
The following conditions were agreed to at our meeting:
1. The Police Department will monitor the live band with a

Item 33.
The existing site is rather flat and level witn no outstanding grade
changes. The existing restaura.it presently includes, kitchen facilities,
public restrooms, and bar and dining areas (164 total seating capacity).
The existing parking area is constructed of asphalt paving and concrete
curbs and wheel stops. The existing lanscaping includes various planting
and sodded areas directly adjacent to the existing building and along the
north, south and west property lines.

The adjacent properties are as follows:
Front east - Heavily wooded lot with a 2-story single family residential
structure, as well as a multi -story commercial project under construction
adjacent to the residential property on two sides (north and east), located
on the east corner of Hamilton Avenue and Bascom Avenue.
Left side (south) - This commercial site contains a "Chevron" Service
Station, located on the west corner of Hamilton Avenue and Bascom Avenue.

Addition of a 'Waiting' patio ad acent to the bar of the existing Spoons
Restaurant, which will include the following:
All exterior - Patio area with tiled surface to match that of the existing
building entrance.
Wood benches to provide seating for waiting customers.
4'-8" high split -face block wall (to match existing) enclosing
Patio from the parking area.
Raised planter area along block wall within the patio.
Addition of the proposed patio would provide an extra waiting area for the
existing restaurant and would help to alleviate congestion of waiting customers
at entrance to building (inside & outside) during peak business hours.
