BEING AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CAMPBELL ADOPTING, PLANS, ELEVATIONS AND DEVELOPMENT
SCHEDULE FOR THE PLANNED DEVELOPMENT ZONE ESTABIISHED
BY ORDINANCE NO. 10730F THE CITY OF CAMPBELL.
(Application of James M. Thorne and Cabak Associates).
The City Council of the City of Campbell does ordain as follows:
SECTION ONE: That the Zoning Map of the City of Campbell is hereby
changed and amended by adopting the attached "Exhibit A" entitled "Plans and
Elevations," "Exhibit B" entitled "Development Schedule," and "Exhibit C"
enti*led "Map of said Property," as per application of Mr. James M. Thorne
and Cabak Associates for approval of plans, elevations, and development
schedule to construct a commercial building on property known as 1820 South
Bascom Avenue in a Planned Development Zoning District. Copies of said exhibits
are on file in the office of the Planning Department.
Said approval subject to the following conditions:
A. Revised site plan indicating modified circulation pattern to be
approved by the City Engineer and the Planning Director.
B. Revised easterly elevation to be approved by the Planning Director.
C. Applicant to provide one 12'-0" by 20'-0" parking stall for the
handicapped.
D. Property to be fenced and landscaped as indicated and as added in
"red" on plans.
E. Landsczpe plan indicating type of plant material, loca'ion of hose
bibs or sprinkler system and type of fencing to be submitted fo approval of
the Planning Director et time of application for building permit.
F. Landscaping shall be maintained in accordance with the approved
landscape plan.
G. Faithful performance bond in the amount of $3,000 to bo posted to
insure landscaping, fencing and striping of parking area within three (3) nlor.ths
of completion of construction, or applicant may file written agreement to complete
landscapinc, fencing and striping of parking area prior to final Building
Department clearance.
H. All mechanical equipment located on roofs shall be screened as approved
by the Planning Director.
I. East elevation of the building shall be modified architecturally to
the satisfaction of the Planning Director and Architectural Advisor.

J. All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell Municipal Code. All parking spaces to be provided
with appropriate concrete curbs or bumper guards.
K. Underground untilities to be provided as required by Section 20.16.070
of the Campbell Municipal Code.
L. Plans submitted to the Builuing Department for plan check shall indicate
clearly location of all connections for underground utilities including water,
sewer, electric, telephone .nd television cables, etc.
M. Sign application to be submitted in accordance wit:i provisions of the
sign ordinance for all signs. No sign to be installed until application is
approved and permit issued by the Building Department.
N. Ordinance No. 782 of the Campbell Municipal lode stipulates that any
contract for the collection and disposal of refuse, garoa�,, w9t garbage,
and rubbish produced within the limits of the City of Campbell shall be made
with Green Vdlley Disposal Company. This requirement applie, to all single
fam`ly dwellirgs, multiple apartment units, to all commercial, business, industrial,
manufacturing, and construction establishments.
0. Trash container(s) of a size and quantity necessary to serve the develop-
ment shall be located in area(s) approved by the Fire Department. Unless otherwise
noted, enclosure(s) shall consist of d concrete floor surrounded by a solid wall
or fence and have self -closing doors of a size specified by :he Fire Department.
Al,enclosures to be constructed at grade level.
P. Applicant shall meet all State requirements for the handicapped.
PUBLIC WORKS DEPARTMENT
Q. Close off the proposed drivevay on Ridgeley Drive rearest the intersection
of Bascom Avenue.
R. Make the proposed driveway and existing driveway to remain on Bascom Avenue
two-way.
S. RE -move two existing driveways on Bascom Avenue not proposed for use by this
development.
T. Process and file a parcel map.
U. Pay storm drainage area fee at $765/net acre.
V. Enter into an agreement and post bond for construction of balance of street
improvements on Ridgeley Drive and modification of street improvements of Bascom
Avenue.
N. Provide grading and drainage plan.
X. Obtain an excavation permit.
FIRE DEPARTMENT
Y. Provide one "2A-IOBC" fire extinguisher for each 50 feet of travel.
Z. Final plans to have trash enclosure locations spotted on drawings.
The applicant is notified that he shall comply with all applicable Codes or
Ordinances of the City of Campbell which pertain to this development and are
not herein specified.

RECOMMENDATION:
That the City Council adopt the attached Ordinance approving plans, elevations
and development schedule to allow construction of a commercial building on
property known as 1.820 South Bascom Avenue if action is taken to approve
ZC 77-1.
CISCUSSION:
Zone Cha. e: The applicant is proposing to rezone 36,000 square feet (0.82
acres of and from C-2-S and R-i to PD (Planned Development/Commercial).
P. rezoning to PO would:
1. Allow for the review of the zone change and subdivision map in
the shortest possible time period.
2. Provides assurances to the City that development of this area will
be as one project rather than as a series of unrelated fragmented
projects.
Development: The applicant is proposing to construct a 11.800 square foot
commercial development on four parcels of land (the combined area is
approximately 35,800 square feet). The proposed structure will cover
approximately 33 percent of the 0.82 acre site.
The proposed development will be consistent with the Council Policy for develop-
ment along Bascom Avenue in that it will be oriented towards the commercial
street, rather than the residential street (Ridgeley Drive).
Building materials are indicated as split -faced block with bronze glass in
bronze anodized aluminum frames and painted cement walls with a metal roof
screen along the west and south elevations.
The applicant is providing 59 parking spaces, which will result in a ratio V

with the parking ratio for similar developments which have received recert
approval.

STAFF RECOMMENDATION:

STAFF DISCUSSION:
Zone Change:

We request that the property described in this submittal be
rezoned from C-S-2 and from R-1 Zoning to a single PD zone :or the
following reasons:
1. To facilitiate the development of a commercial facility
which will occupy the present four parcels.
2. To allow us to apply for "S" approval concurrently with filing
a parcel map, rather than subsequent to filing such a map,
rezoning the R-1 parcel to a C-S-2 parcel and then applying
for "S" approval.
The result of the city's favorable response to this request will
be a single parcel of land zoned PD facing Bascom Ave. capable of
being developed with a buildinq use and type allowable in a C-S-2
zone in accordance with the City of Campbell Master Zoning Plan.
No commercial property would face on to the residential street,
Ridgley Ave.
The intended development would be compatable with other structures and

Commissioner Vierhus stated that he owns property 1GJ feet from the subject
property and he asked the City Attorney if, according to the Conflict of Interest
Law, he should disqualify himself on this application.
City Attorney advised the Copmossion to go ahead with the application and he
would respond to Commissioner Vierhus.
Chainion Dickson asked Commissioner Pack for the repurt of the Architectural
Review Committee.
Commissioner Pack advised that the committee met with the applicant and recommends
approval subject to conditions outlined in the staff report and with the added
condition No. 9 to road: 9. east elevation of the building shall be modified
architecturally to the sat sfaction of the Planning Director and Architectural
Advisor.

Commissioner Pack advised that trees will be put in some of the wells in the
parking area. One driveway has been closed off and the driveway along Bascom
Avenue is going tc be widened to accommodate the ingress and egress.
City Attorney Dempster advised Commissioner Vierhus that he could see no reason
why he would have a conflict on interest regarding this application.
Mr. Kee briefly described the proposal and reviewed the site plan with the
Commission. There will be a masonry wall betweer the residential development
to the east and there will be five (5) tree wells for landscaping on the north
siao of the wall.
Commissioner Vierhus asked how high the masonry wall will be.
IMr. Kee replied that it would be six feet in height, and this is a standard
I procedure where commercial development is adjacent to residential development.
The building would sit back 70 feet from Bascom Avenue.
Commissioner Vierhus asked how deep the building will be.
Mr. Kee replied that it will be 84 feet in depth and there will be 5 feet of
landscaping between the building and Ridqeley Drive.
Chairman Dickson declared the public hearing open and asked if anyone in the
audience wished to speak for or against the application.
Mr. Lewis Marcus, San Mateo, stated that he is one of the developers and that
they are happy to receive the approval recommendation of staff and the
Architectural Review Committee. They will accept the recommendations and conform
to all the requirements, including the added condition No. 9.
Commissioner Pack asked Mr. Marcus to describe the type of tenants that will
occupy the buildings.
Mr. Marcus stated that they have negotiated with a savings and loan company,
a clothing store, and a wallpaper siore.
There being no one else wishing to Se heard, Commissioner Hebard moved that
the public hearing be closed, seconded by Commissioner Pack and unanimously adopted.
RESOLUTION NO. 1579 Commissioner Campos moved that Resolution No. 1579 be
adopted recommending that the City Cuuncil adopt an
ordinance approving ZC 77-2. application of Mr. James M.
Thorne, and Cabak Associates, for a change of zoning from
C-2-S and P-1 to P-D on property known as 1820 S. Bascom
Avenue, seconded by Commissioner Hebard and adopted by
the following roll call vote:
AYES: Commissioners: Hebard. Campos, Vierhus, Pack, Samuelson, Lubeckis,
and Dickson.
NOES: Commissioners: None.

The Planning Commission shall have authority to adjust these
requirements for a specific use at a specific location to require
either a greater or lesser number of parking spaces when it determires
that circumstances are such as to warrant an adjustment. For all

Section 20.16.010 Standard Improvements - General
All improvements hereinafter mentioned shall not be less than
those set forth in the "Standard Specifications of the City of
Campbell", adopted by Ordinance of the City Council, copies of which
are on file in the office of the City Engineer.
Section 20.16.020 Sane - Streets and Highways
Alstreets and highways shall be graded and surfaced to widths
and grades approved by the City Engineer. The subdivider shall
improve the extension of all subdivision streets, highways, or
public ways to the intercepting paving line of any county road,
city street, or state highway.
Section 20.16.030 Sage - Structures
Structures for drainage, access and/or public safety shall is
installed as deemed necessary by the City Engineer. Such structures
shall be designed and plated to locations and grades approved by
the City Engineer.
Section 20.16.040 Same - Curbs and Gutters
Curbs and gutters shall be installed to locations and grades
approved by the City Engineer.
Section 20.16..050 Same - Sidewalks
SiWw`W ks shafl be installed to locations and grades approved
by the City Engineer.
Section 20.16.060 Same - Sanitary and Storm Sewers
Sanitary sewer facilities shall be installed to serve each lot
and to grades and sizes approved by the City Engineer.
Storm sewers shall be installed to provide for reiroval of surface
and storm waters from local or neighborhood drainage areas as
directed by the City Engineer. Payment of a fee for the purpose
of defraying the actual or estimated costs shall be required as a
condition of approval of the final subdivision map. The specific
fee shall be determined from the resolution of the Council for
the specific drainage element of the Master Drainage plan. adopted
pursuant to Section 654GO of the Government Code of the State of
California. Said resolution shall also provide for credits against
said fee fo. 3ctual facilities constructed within the public right-
cf-way dr easement by the subdivider as a condition of approval
of the final subdivision map.
_Section 20.16.070 Utilities
Utilityiaci ties adequate to supply communication, electrical.,
Cap, water, and fire protection service to each lot of the subdivi-
sion shall be constructed and installed within the subdivision.
1. All utility distribution fnciliti.e.+ (includin; but not
limited to electrical communication and cable television
lines) installed in and foe the purpose of supplyinn service
to any subdivision or development shall be placed underrround,
except for the folliwinv.
(a) Equipment appurtenant to underground facilities,
such as surface -mounted transformers, pedestal-
mounted terminal boxes and meter cabinets, and concealed
ducts.
(b) Metal poles supporting electrical transmission lines,
and the electrical transmission lines of the voltage
carried by such lines i more than 12 kilovolts and
such lines are net connected to any distribution line
situate within the subdivision and do not in any way
serve any part of the subdivision.
(c) Poles supporting street lights and the electrical
lines within said poles.
2. On subdivisions of four (4) lots or less and on develop-
ments on single lot building sites, where no subdivision
is involved, ttiie Planning Director, with the concurrence
of the City Engineer, may authorize the substitution of
overhead facilities and appurtenances in lieu of under-
ground facilities. The City Engineer and Planning
Director stall use the following factors in determining,
if the substitution is equitable to all parties concerned:
(a) The future potential number of buildin; sites, in
both the involved subdivision or lot and in
surrounding areas.
(b) The estimated cost of underground facilities as
compared to standard wooden pole overhead facilities,
per lot and in the aggregate.
(c) Compatibility with surroundings as to:
(1) Type of existing facilities.
(2) Type of probable future facilities.
(3) Other pertinent environmental features.
The subdivider or developer may appeal th^ decision of the
Planning Director and City Engineer in the manner set
forth in Section 20.20.060.
3. The subdivider is responsible for complying with the
requirements of this section, and shall make the
necessary arrangements with the utilities companies
involved for the installation of said facilities.
4. The Planning Commission may waive the requirements of this
