Approval of the tentative subdivision map TS 91-02 for 875
Apricot Avenue is recommended for approval with the following
conditions:
Compliance with all applicable Codes and Ordinances of the
City of Campbell and the State of California which pertain
to this development.
Provide a copy of the preliminary title report.
Dedicate additional right-of-way to widen Apricot Avenue to
30' from centerline.
Sidewalk and improvements within the public right-of-way are
not correct as shown on tentative map. Street improvements
will be constructed as directed by the City Engineer.
Submit street improvement plans, pay fees, post surety and
deposits as needed to obtain the encroachment permit
required for all work within the public right-of-way as
directed by City Engineer.
Provide grading and drainage plans for review by City
Engineer.
Pay park dedication fees of $9,096 (2 new units @ $4,548
each.)
Code, Covenants 6 Restrictions (CC&R's) to be approved by
City Engineer to insure provisions for maintenance of
buildings and common area.
Installation of a sanitary sewer system to serve all lots
within the subdivision in conformance with the proposed
plans of the West valley Sanitation District No. 4.
Sanitary sewerage service to be provided by District No. 4.
Installation of a water distribution system to serve all
lots within the subdivision In conformance with the plans of
the San Jose Water Works. Water service to be provided by

the City Hall Council Chambers, 70 North First Street, Campbell, California,
for a Public Hearing to consider the following proposed projects:
1. Puoiic Hearing to consider the application of Mr. Chester Mallory for
approval of a Use Permit to allow a second -story addition to an existing
non -conforming single-family residence, on property located at 1073
Lucot Way, in a R-1-10 (Single-family Residential) Zoning District.
APN: 406-24-034, File No. UP 91-08. This project is Categorically
Exempt, therefore no environmental action is needed.
2 Public Hearing to consider the application of Mr. James Chen for
approval of a Tentative Subdivision, for property located at 875 Apricot
Avenue, in a PD (Planned Development) Zoning District. APN: 412-12-
001. File No. TS 91-02. This projeO is Categorically Exempt, therefore, no
environmental action is needed.
3. Public Hearing to consider the request of Mr. Marvin Bamburg for a one
year extension of a previously approved Site and Architectural Permit to
allow the construction of a professional office building on properties
located at 1830-1836 East Hamilton Avenue and 1670 Grace Avenue, in a
PO (Professional Office) Zoning District. APN: 288-25-060, 061, and 062.
File No. R 91-04 IS 89-14). A Negative Declaration was previously
granted for this project.
4. Public Hearing to consider the application of T. C. Residential South Bay
Associates, Inc., for a Planned Development Permit to construct a 348
unit multiple -family residential project on a 12.4 acre site, located at 500
Railway Avenue, in a PD (Planned Development) Zoning District.

The only concern the Traffic division would have regarding this area is that it is
already a very congested area with many housing units and limited parking.
Parking in this area is already a problem and expanding to more units will increase
the parking problem.
The other problem that may arise is the entrance exit points for the units.
Traffic entering onto Union Ave. may Increase the number of collisions on that street,
and Apricot Ave. is about tapped out for the amount of traffic it can handle.
I don't have answers to these problems, however they should be discussed
prior to granting approval of this project.

We hereby state that we are the owners of, or have some right, title
or interest In and to the real property included in the subdivision shown
within the distinctive border on this map; that we are the only persons
whose consents are necessary to pass clear title to said property; and we
hereby consent to the making of said subdivision, and that we hereby offer
for dedication to public use all streets and portions of streets not previously
existing as shown on the map within said subdivision, and also dedicate to
public use easements for any and all public uses under, upon and over
said streets and said portions thereof.
We also hereby dedicate to public use easements for any and all public
service facilities including wires, conduit, gas, water and heat mains, and all
appurtenances thereto under, upon or over lot 5 (Common Lot) which is
hereby delineated and designated a public service easement (PSE). The
said easement to be kept open and free of buildings and structures of any
kind except public service structures, lawful fences,unsupported roof
overhangs and second story building and balcony overhangs and irrigation

construction of private roads, sidewalks, patio slabs, recreational facilities, or

exclusive use of the owners of Lot 5, their successors and assigns heirs and
visitors covered by the appropriate covenants, conditions and restrictions, for
recreation, utilities, drainage, ingpress, egress and emergency access.
The private drives contained within this tract are not offered nor
accepted for dedication for plblic street purposes.
