APPLICATION OF MR. JAMES CHEN. FILE NO. R 94-02 (PM 92-03) After public notification, as specified by law, for the application of Mr. James Chen, S.C.T. Development Inc., for approval of a reinstatement of a previously -approved Tentative Parcel Map allowing the creation of five lots on property located at 875 Apricot Avenue, as per the application filed in the Planning Department on April 7, 1994, and after presentatian by the Planning Director, the City Council did find, with regard to File No. PM 94-01: 1. The proposed map is located in a Planned Development Zoning District and is consistent xvith the approved Planned Development Permit , 2. The General Plan designates this area as High Density Residential ( 21 to 27 per gross acre). The proposed project will be developed at 14 units per gross acre. Bawd on the foregoing findings of fact, the City Council further finds and concludes that, subject to the imposed conditions: 1. This Tentative Parcel Map, together with the provisions for its design and improvement, is consistent with the General Plan of the City of Campbell. Further, the applicant is notified as part of this application that he is required to comply with all applicable Codes and Ordinances of the City of Campbell and the State of California that pertain to this development and are not Krein specified. 1. Four lots will be developed with townhomes and the fifth lot will be developed as a common drive to reach to development. • Lot is 12,600 square feet. • The previous map was approved by the Planning Commission and City Council but lapsed in August 1993. • Staff recommends reinstatement with the additional condition to file and process a parcel map. • This matter will be forwarded to the City Council as the lots are located on a private street. Commissioner Alne inquired which of the five lots woi,ld be utilized as the common driveway. The proposed Tentative Map would allow the creation of townhome lots which are accessed by way of a private drive. The Subdivision Ordinance of the City requires that the City Council approve the creation of lots without frontage on the public street. Consequently, this map is before the Commission at this time. GENERAL PLAN AND ZONING CONSISTENCY A. General Plan Designation: This site is designated for high density residential (21.27 units per gross acre). The proposed development would be developed at 14 units per gross acre which is consistent with the General Plan designation. & Zoning Designation: The project site is currently zoned P-D (Planned Development). The map is consistent with the approved Planned Development Permit for this property. The proposed map indicates the creation of lot on a private driveway. 5. Ordinance 1823 requires that exceptions to subdivision access for lots not having frontage on a public street be approved by the City Council upon recommendation of the Planning Commission. GENERAL PLAN AND ZONING CONSISTENCY A. General Plan De jgnation: The site is designated for High Density Residential, at 21 to 27 dwelling units per gross acre. The proposal is for 14 units per gross acre, which is consistent with the General Plan and would be allowed in this zoning district. B. Zoning Designation: The site is zone for PD (Planned Development). The map is consistent with the approved Planned Development Permit. RECOMMENDATION/SUMMARY The proposal is consistent with the General Plan and Zoning District.
