After public notification, as specified by law, for the application of Mr. James
Chen, S.C.T. Development Inc., for approval of a reinstatement of a
previously -approved Tentative Parcel Map allowing the creation of five lots
on property located at 875 Apricot Avenue, as per the application filed in the
Planning Department on April 7, 1994, and after presentatian by the Planning
Director, the City Council did find, with regard to File No. PM 94-01:
1. The proposed map is located in a Planned Development Zoning District
and is consistent xvith the approved Planned Development Permit

2. The General Plan designates this area as High Density Residential ( 21 to
27 per gross acre). The proposed project will be developed at 14 units per
gross acre.
Bawd on the foregoing findings of fact, the City Council further finds and
concludes that, subject to the imposed conditions:
1. This Tentative Parcel Map, together with the provisions for its design
and improvement, is consistent with the General Plan of the City of
Campbell.
Further, the applicant is notified as part of this application that he is required
to comply with all applicable Codes and Ordinances of the City of Campbell
and the State of California that pertain to this development and are not
Krein specified.
1. Revd Plan: Revised site plan indicating location of fire hydrant to be
submitted to the Planning Department and approved by the Planning
Director upon recommendation of the Fire Department prior to

BACKGROUND
The Planning Commission and City Council previously approved a Zone
Change from R-3-S (Multiple Family Residentia') to PD (Planned
Development) for this development. A Planned Development Permit was
approved allowing the construction of four townhomes on th,z project site. e
condition of that approval required the applicant to process and file a parcel
i' map. The City Council previously approved the Tentative Parcel Map
allowing the creation of the five lots. This approval expired on August 6,
1993,
ZQNING AND GENERAL PLANV CONSISTENCY
Zoning Designation: The project site is currently zoned PD (Planned
Development). The presented map is consistent w.th the approved Planned
Development Permit for this property.
General Plan Designation: This site is designated as High Den=ity Residential
(21-27 units per gross acre). The proposed development would be developed
at 14 urits per gross acre which was found to be consistent with the General
Plan density range at the time of project approval.

After notification and Public Hearing as specified by law on the application of
Mr. James Chen, on behalf of S.C.T. Development, Inc., for reinstatement of a

In 1990, the applicant requested approval of a zone change from R-3-S(Multiple
Family Residential) to PD (Planned Development) and approval of a Planned
Development Permit. The request was approved by th, City Council on October
16, 1990 with a 5-0 vote.
At this time, the applicant has requested approval of a Tentaw,e Parcel Map. The
Flanning Commission, at its meeting of July 9, 1991, approved Resolution 2762
with a 6-0-1 vote, recommending approval of Tentative Parcel Map PM 91-03.

• The previous map was approved by the Planning Commission and City
Council but lapsed in August 1993.
• Staff recommends reinstatement with the additional condition to file
and process a parcel map.
• This matter will be forwarded to the City Council as the lots are located
on a private street.
Commissioner Alne inquired which of the five lots woi,ld be utilized as the
common driveway.

Committee had reviewed this application to which Mr. Haley replied they
had not.

A condition of that approval required the applicant to process and file a parcel
map. The Planning Commission and City Council previously approved a
parcel map allowing the creation of the five lots. This Tentative Parcel Map
approval expired on August 6, 1993.
The proposed Tentative Map would allow the creation of townhome lots
which are accessed by way of a private drive. The Subdivision Ordinance of
the City requires that the City Council approve the creation of lots without
frontage on the public street. Consequently, this map is before the
Commission at this time.
GENERAL PLAN AND ZONING CONSISTENCY
A. General Plan Designation: This site is designated for high density
residential (21.27 units per gross acre). The proposed development
would be developed at 14 units per gross acre which is consistent with
the General Plan designation.

After public notification, as specified by law, for the application of Mr. James

Chen for approval of a Tentative Parcel Map to allow construction of four
townhomes, located at Assessor's Parcel Number 412-12-001, 875 Apricot
Avenue, as per the application filed in the Planning Department on May 30,
1991; and after presentation by the Planning Director, the Planning
Commission did find, with regard to File No. PM 91-03:
1. The proposed map is consistent with the Planned Development Permit.
2. The General Plan designates this area as a High -Density Residential
District, 21 to 27 units per gross acre. The proposed project is for 14 units

STAFF RECOMMENDATION
That the Planning Commission take the following action:
1. ADOPT Resolution incorporating attached findings recommending
the City Council approve PM 91-03 subject to the attached conditions.
Environmental statement: This project is Categorically Exempt from the
environmental review process, hence no
environmental action is necessary.
APPLICANTS PROPOSAL
The applicant seeks approval to allow the creation of five lots. Four of the
lots will be developed for townhomes and one lot will be developed as
a common driveway.

2. Conditions of Approval of PD 90-04 required the applicant to process
and file a Parcel Map.

3. Tentative Parcel Map for PD 90-04 has been submitted for approval.
4. The proposed map indicates the creation of lot on a private driveway.
5. Ordinance 1823 requires that exceptions to subdivision access for lots
not having frontage on a public street be approved by the City Council
upon recommendation of the Planning Commission.
GENERAL PLAN AND ZONING CONSISTENCY
A. General Plan De jgnation:
The site is designated for High Density Residential, at 21 to 27 dwelling
units per gross acre. The proposal is for 14 units per gross acre, which is
consistent with the General Plan and would be allowed in this zoning
district.
B. Zoning Designation:
The site is zone for PD (Planned Development). The map is consistent
with the approved Planned Development Permit.
RECOMMENDATION/SUMMARY
The proposal is consistent with the General Plan and Zoning District. Staff
recommends that the Planning Commission adopt resolution recommending
approval to the City Council for the creation of five lots located at 875 Apricot
Avenue, subject to the Conditions of Approval.
