OWNER'S STATEMENT
We hereby state that we are the owners of, or have some right. title
or interest In and to the real property included in the subdivision shown
within the distinctive border on this map; that we are the only persons
whose consents are necessary to pass clear title to sold property; and we
hereby consent to the making of said subdivision. and that we hereby offer
for dedicc 'on to public use all streets and portions of streets not previously
existing c._ shown on the map within said subdivision, and also dedicate to
public use easements for any and all public uses under, upon and over
said streets and said portions thereof.
We also hereby dedicate to public use easements for any and all public
service facilities including wires. conduit, gas, water and heat mains, and all
appurtenances thereto under, upon or over lot 5 (Common Lot) which is
hereby delineated and designated a public service easement (PSE). The
said easement to be kept open and free of buildings and structures of any
kind accept public service structures, lawful fences.unsupported roof
overhangs and second story building and balcony overhangs and irrigation
lines. Areas designated "PSE" may be paved, planted, or improved by the
construction of private roads, sidewalks, patio slabs, recreational facilities, or
fences.
Sold Lot 5 is not offered for use to the general public but is intended for
exclusive use of the owners of Lot 5, their successors and assigns heirs and
visitors covered by the appropriate covenants. conditions and restrictions, for
recreation, utilities. drainage. ingress, egress and emergency access.
The private drives contained within this tract are not offered nor
accepted for dedication for public street purposes.
Contained within the PSE are private storm drainage and private sanitary
sewer facilities. The maintenance, repair, and/or replacement of private
storm and private sanitary facilities shall be the sole responsibility of the
property owners as determined by the appropriate covenants, conditions and
restrictions.
