BEING A RESOLUTION OF THE. PLANNING
COMMISSION OF THE CITY OF CAMPBELL APPROVING
THE REINSTATEMENT (R 97-05) OF A PREVIOUSLh'-
APPROVED CONDITIONAL USE PERMIT TO ESTABLISH
A PEDIATRIC HOSPITAL ON PROPERTY LOCATED AT
3777 S. BASCOM AVENUE N AN R-3-S (HIGH DENSITY
RESIDENTIAL) ZONING DISTRICT. APPLICATION OF
MR. MICHAEL ZARCONE. FILE NO. R 97-05.
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as
follows with respect to application R 97-05:
1. The proposed use is similar to the use for which the site was designed, and which
operated previously on the site without detriment to the surrounding neighborhood.
2. The previous conditions of approval will continue as conditions of approval for the
proposed use, together with additional conditions of approval to revitalize the
landscaping.
3. The parking demand for the proposed use is similar to or less than that of the previous
use.
Based upon the foregoing findings of fact, the Planning Commission further finds and
concludes that:
I. The proposed project is consistent with the General Plan and the local zoning
ordinance, and;
2, The proposed project as conditioned will aid in the harmonious development of the
immediate area;
3. The establishment, maintenance or operation of the use applied for will not be
detrimental to the health, safety, peace, morals, comfort, or general welfare of persons
residing or working in the neighborhood of such proposed use, or be detrimental or
injurious to property and improvements in the neighborhood or to the general welfare
of the City.
4. The proposed site is of adequate shape and size to accommodate the yards, walls,
fences, screening, landscaping and other development features required in order to
integrate said use with uses in the surrounding area. The site will be maintained in
accordance with City laws and development standards.

The applicant is hereby notified, as part of this application, that heishe is required to

Campbell and the State of California that pertain to this development and are not herein
specified:
1. Aporoved Project: This approval is for a reinstatement of a previous Conditional Use
Permit (UP 88-01) and Modification (M 89-20) allowing construction and operation
of a hospital The proposed use shall substantially conform to the description in the
applicant's letter dated May 7, 1997, and the proposed plan with the plans approved
under the previous approvals, except as modified by the conditions herein.
2. Previous Conditions:
All conditions of approval of the original use permit as approved by Resolution No.
2520 for LT 88-01 shall remain in effect, except as modified by conditions herein.
3. Landscaping:
A. A landscaping plan including the originally approved landscaping plan, and those
changes proposed, shall be suomitted to the City Planning Division staff for
review and approval.
B. Barren areas. in which the landscaping has either died or significantly
deteriorated, shall be indicated for replanting in the landscaping plan.
C. New plants indicated on the landscaping plan shall be installed, and the irrigation
line, demonstrated as being fully functional, prior to occupancy of the facility.
3. Street Trees.
The applicant shall remove the existing shrub located in the most northerly tree well,
and plant a 15 gallon tree of the same variety as the other existing street trees. An
Encroachment Permit shall be obtained prior to commencement of this work, and the
replacement shall he planted and irrigated to meet the City Street Tree Planting,
Staking and Irrigation Details.
4. Underground Utilities:
All new on -site utilities shall be installed underground per Section 20.36.150 of the
Campbell Municipal Code. Applicant shall comply with all plans submittals,
permitting and fee requirements of the serving utility company.

5. Rooftop and on -site Mechanical Equipment:
Plans for any new equipment which has any portion outside the building, whether on
the ground, on top of or attached to the building, snarl be submitted to the City for
review and approval by the Building and Planning Divisions.

Any proposed exterior signs or sign changes shalt be submitted to the City Planning
Division for review and approval.
7. Trash Management:
The lids of all trash containers shall be kept closed except when .,ding or emptying
them. Arrangement shall be made for the timely removal of all trash.

Ms. Barbara Ryan, Planner 1, presented the staff report as follows:
• Applicant is seeking the reinstatement of the Conditional Use Permit to allow a hospital
use.
• Site is on the west side of Bascom Avenue, near White Oaks Road.
• Surrounding uses include high density residential to the north; offices to the south; single
family residential to the west (behind this project); wid commercial uses to the rsst (across.
Bascom Avenue).
• The site has been vacant for more than a year which is why the Use Permit needs to be
Reinstated.
• Hospitals are permitted within any zoning district with a Conditional Use Permit.
• Staff recommends approval with the condition that the landscaping be rejuvenated.
• SARC recommends approval.
• No CEQA review is required for this project.
Commissioner Lowe asked about the use of ambulances.
Ms. Barbara Ryan advised that the patients at this facility are long-term hospital patients who
have been under medical supervision for a period of time.
Commissioner Meyer -Kennedy presented the Site and Architectural Review Committee report
as follows:

Chairwoman Kearns opened the Public Hearing for Agenda Item No. 3.
Ms. Nancy Mee. 109 Bascom Court:
• Expressed concerns about ambulance u.eage, use of sirens and whethe• a quiet zone could
be established where sirens could be shut off as the ambulance approaches this site?
• Asked what hours of operation would be, shift changes, visiting hours, etc.
Commissioner Lowe asked about the original use of this building.

Ms. Barbara Ryan replied that it served as a long-term, post operative hospital.
Chairwoman Kearns asked for clarification about ambulances and anticipated traffic.
Ms. Barbara cyan replied that the applicant can best answer these types of questions. She
explained that thr is a long -tern care facility. There are not a lot of visitors. In fact the
facility plans to work with local seniors to establish a network of visitors for patients that
receive no visitors at all.
Mr. Michael Zarcone, Applicant:
• Advised that the patients coming to his facility are post injury or children born with birth
defects. Most children are tranefered from neo-natal intensive care units from local
hospitals.
• The majority of the children have no functionai family support and have minimal visits.
• T]u goal of the program is to get the children to a level where they can go into foster care.
• Ambulances will deliver the young patients during the day.
• No sirens will be needed.
There is no emergency room so there is no reason for ambulances utilizing sirens to deliver
patients.
• Staf. els are one nurse for every four to five children. This will result in about eight to
nine staff vehicles. The evening shift will end at 10:30 or 1 I p.m.
Commissioner Gibbons suggested that in the event of an emergency, an ambulance might be
needed.
Mr. Michael Zarcone said that it was possible but not likely nor often.
Ms. Nancy Mee, 109 Bascom Court:
• Stated that the previous occupants had their parking lot light on a timer.
• Right now lighting comes on at i 1 p.m, and is very bright and the timer is rot being used.
• Asked that the new tenants reutilize the timer.
Commissioner Lindstrom stated that this is a fair request and suggested that Ms Mee work
with the applicant.

• Applicant is seeking to construct a new single-family residence at 1 167 Steinway Avenue.
• The project site is located west of Peggy Avenue and is in the San Tomas Area
Neighborhood.
• Lot is .45 acres.
• Zoning is R-1-10.
• Applicant is proposing to rclr.^„ two small single-family residences and build a new
single family residence on the property.
• Proposed residence includes 4,700 square feet with a 620 square foot, three -car garage.
• This represents 15%coverage.
• Landscaping represents 75%.
• FAR is .24.
• In addition to the three -car garage, space for three cars will be available in front of the
garage.
• The General Plan calls for 3.5 units per acre.
• This project meets all requirements for the R-I-10 Zoning District and the San Tomas Area
Neighborhood Plan.
• Staff had concerns over the original subm,ttal due to the prominent garage and two-story
entranceway. Since that time, the applicant has revised his plans to address staffs

DISCUSSION
Atmlicant's Pr000sa:: The applicant is requesting Reinstatement of a previous Use Permit to allow
the use of an existing building, previously used by Recovery Inn as a post operative care facility
(see letter with Exhibits, Attachment 4). The proposed use is to he an acute care and subacute care
pediatric hospital. The care is aimed at weaning the children from dependency upon machines
such as tracheal tubes and ventilators so they may he placed in a more family -like environment.

Backgroun4
The previous Use Permit of Recovery Inn, granted in 1988. has expired as the facility has been
empty for over one year. The applicant is requesting to reinstate the previous approval with no
major changes other than that one of the two operating rooms is not planned to be used, and
limited surgical procedures will be less invasive.
ANALYSIS
General Plan Designation: The General Plan indicates a High Density Residential designation (21-
27 units per gross acre).
-Zoning Use Designation: The site is zoned R-3-S, (Multiple Family Residential). Section
21.72.120H of the Campbell Municipal Code permits a hospital, convalescent hospital, or
sanitarium in any zoning district subject to approval of a use permit. Approval of the previous use
found that the proposal would not be detrimental to the welfare of the neighborhood. The impact
of this proposed use should be slightly less, as the parking demand for subacute beds is lower than
for acute care beds. Therefore, the Commission should be able to make the same approval findings
for the proposed use.
Surrounding Neighborhood: High density uses border the property to the north, office uses to the
°ouch, and single-family residential uses to the west, behind the building. Across Bascom kvenue,
to the east, are commercial developments.
Site and Unit Design: The existing building is a warm colored stucco, with a concrete tile roof.
The massing has been divided into smaller connected forms, with a covered, gable entry. Parking
spaces front Bascom Avenue and the High Density residential to the north. Trash enclosures are
located against the rear fence line. No changes are proposed to the existing site layout or to the
exterior of the building.
Landscaping: As the site has been vacant for some time, an( the water supply turned off, those
plants which do not have a deep root structure have not survived. These are, for the most part,
groundcover, some shrubbery, and a street tree.
The applicant intends to restore the landscaping, and to add more color, especially at the entry,
and in those areas immediately outside the windows of the patients' rooms.
Site and Architecture Review Committee: The Site and Architectural Review Committee reviewed
this application et their meeting of July 10, 1997, and expressed support of the reinstatement of the
previous Use Permit.

In 1993, the Recovery Inn was licensed as an acute care hospital.
During its one year in operation it provided elective surgery and post
surgical hospitalization to its patients.
On Feb. 28th, 1997, Subacute Childr-_ns Hospital of Northern
Calif., Inc. assumed the lease of the Recovery Inn building. We are
currently working with the State Dept. of Licensing and Certification
to renew the acute care licensure. 'ihe plan is to restore the acute
care licensing status aid reopen the hospital as a dedicated pediatric
center for children who are recovering from catastrophic injury.
Our goal is to provide the same services that were performed by
the previous tenant with the exception that only one Operating Room
will be available and the limited surgical procedures will be less
invasive.

time of 7:30 p.m., or shortly thereafter, on Tuesday. July 22, 1997, in the City Hall

The applicant is requesting to re -open the former Recovery Inn as a Subacute Children's Hospital. Subacute C'hildren's Hospital of

No changes are proposed to the existing buildings, which were used by Recovery Inn for a year, but which have been un-occupied for
over a year. The site is just shun of one acre in size (42,699 sf) with a building of 14.454 s(

BEING A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF CAMPBELL,
APPROVING A MODIFICATION TO A PREVIOUSLY
APPROVED USE PERMIT 88-01 TO ALLOW A
SECOND OPERATING ROOM FOR THE FACILITY
LOCATED AT 3777 SOUTH BASCOM AVENUE, IN A
R-3-S (MULTIPLE -FAMILY RESIDENTIAL) ZONING
DISTRICT; APPLICATION OF MR. STEVEN
NIELSEN, FILE NO. M 92-06 UP 88-01).
After notification and Public Hearing as specified by law on the application of
Mr. Steven Nielsen, on behalf of Recovery Inn of Los Gatos, approving a
modification to a previously approved Use Permit to allow an additional
operating room, in a R-3-S (Multiple -Family Residential) Zoning District, as
per the application filed in the Planning Department on July 9, 1992; and, after
presentation by the City Staff, proponents and opponents, the hearing was
closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows with respect to File No. M 92-06 (UP W-10):
1. The proposed addition does not significantly change the character or
intensity of the existing use.
2. The presented building addition is consistent in design with the existing
building.
3. Adequate on -site parking has been provided.
Based upon the foregoing findings of fact, the Planning Commission further
finds and concludes that:
The establishment, maintenance, or operation of the modification to
the use applied for will not be detrimental to the health, safety, peace,
morals, comfort or general welfare of persons residing or working in
the neighborhood of such proposed use, or be detrimental or injurious
to property and improvements in the neighborhood or to the general
welfare of the City.
2. The proposed site is adequate in size and shape to accommodate the
yards, walls, fences, parking and loading facilities, landscaping and
other development features required in order to integrate said use with
uses in the surrounding area.
3. The proposed site is adequately served by streets of sufficient capacity to
carry the kind and quantity of traffic such use would generate; and,
4. The proposed use is compatible with the uses in the area.
Approval is effective ten days after decision of approval of the Planning
Commission, unless an appeal is filed.
Further, the applicant is notified as part of this application that he is required
to comply with the following Conditions of Approval:

'ACKGROUND
The Planning Commission in March of 1988 adopted Resolution No.
2520, allowing the construction of a 20-bed post -operative facility at this
location. On December 12, 1992, the Planning Commission approved
minor modifications to that approved project. The applicant, at this
time, is requesting approval of a modification to the previous approval
to allow a minor addition to the building.
GENERAL PLAN Aran TONING CONSISTENCY
A General plan Desi¢nation:
The General Plan designation of this site is High -Density Residential, 21
27 units per gross acre. The existing use was previously found to be
consistent with the residential designation on the General Plan.
B. Zoning Designation:
The site is zoned R-3-S (Multiple -Family Residential). The proposal is an
allowed use in this zoning district, subject to approval of a Conditional
Use Permit.

ProiectT Intensity: The proposed operating room addition represents a minor
square footage change of approximately 5 percent to the existing building. The
proposed addition dies not significantly effect the intensity of the use, nor the
existing circulation and on -site parking.
Architectural Design: The proposed addition maintains similar building
materials as well as design to the existing operating room facility. The
proposed addition will have a minimal visual impact to the existing facility as
proposed.
Parking and on -site Circulation: The presented site plan retains the 30 parking
spaces originally approved with the development. The proposed addition will
not significantly increase the parking demand for the proposed use.

Enclosed please find our completed application for a
modification of use permit 88-01. We are requesting
review of this package so we may proceed with a 668
square foot extension of the facility.
The extension will house a second surgical operating
room with an attendant "scrub" area and will attach to
the existing building next to the first operating room.
We will be submitting completed plans to the Office of
Statewide Health Planning and Development for a
building permit, and to the State Fire Mars.alles
Office for fire safety review and approval.
Architecturally, the extension will maintain
consistency with the "vocabulary" already established
in that the roofline will tte flat to match existing at
the point of connection, and the exterior wall finish
(stucco with a ceramic tile accent band) will continue
around the extension, minimizing the visual impact of
the extension as much as possible.
Based upon the concerns mentioned in your letter of
September 20, 1991, we have worked out an agreement
with the disposal company to leave the existing trash
enclosure as is, and are not pursuing a connecting path
to the adjacent medical office complex at this time.
Naturally, the overall square footage of the building
remains within allowable limits, and we are not
disturbing the existing parking layout, maintaining 28
regular and two handicap spaces which, based upon 1.5
spaces/bed x 20 beds, exceeds the minimum requirements
by five.

DR. H. KNOERNSCHILD, UP 88-01).
After notification and public hearing as specified by law .n the
application of Dr. Harvey Knoernschild for a Use Permit and approval of
plans to allow the construction of a 20-bed post -operative care facility
on property known as 3751 6 3777 S. Bascom Ave. in an R-3-S (Multiple
Family Residential) Zoning District, as per the application filed in the
Planning Department on February 24, 1988; and, after presenta'ion by the
Planning Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission
did find as follows:

1. The proposed project is an appropriate scale in relationship to the
adjacent developed uses.
2. The project is well designed and architecturally b'^nds into the

the City's General Plan.
Based on the above findings, the Planning (,ommission does hereby grant the
requested Use Permit, subject to the following conditions:
1. Revised elevations and/or site plan indicating relocation of
equipment and trash enclosure areas, provision of pavement treatment,
and revised parking layout to be submitted to the Planning Department
and approved by the Site and Architectural Review Committee upon
recommendation of the Architectural Advisor prior to application for
a building permit.
2. Property to be fenced and landscaped as indicated and/or added in red
on the plans. Landscaping and fencing shall be maintained in
accordance with the approved plans.
3. Landscaping plan indicating type and size of plant material, and
location of irrigation system to he submitted to the Planning
Department and approved by the Site and Architectural Review
Committee and/or Planning Commission prior to issuance of a building
permit.
4. Fencing plan indicating location and design details of fencing to be
submitted to the Planning Department and approved by the Planning
Director prior to issuance of a building permit.
5. Applicant to either (1) post a faithful performance bond in the
amount of $10,000.00 to insure landscaping, fencing, and striping of
parking areas within 3 months of completion of construction; or (2)
file written agreement to complete landscaping, fencing, and striping
of parking areas. Bond or agreement to be filed with the Planning
Department prior to application for a building permit.
6. Applicant to submit a plan to the Planning Department, prior to
installation of PG&E utility (transformer) boxes, indicating the
location of the boxes and screening (if boxes are above ground) for
approval of the Planning Director.
7. All mechanical equipment on roofs and all utility meters to be
screened as approved by the Planning Director.

indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and television
cables, etc.
12. Sign application to be submitted in accordance with provisions of the
Sign Ordinance for .11 signs. No sign to be installed until
application is approved and permit issued by Planning and Building
Departments (Section 21.53 of the Campbell Municipal Code).
13. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet
garbage and rubbish produced within the limits of the City of Campbell
shall be made with Green Valley Disposal Company. This requirement
applies to all single-family dwellings, multiple apartment units, to
all commercial, business, industrial, manufacturing, and construction
establishments.
14. Trash container(s) of a size and quantity necessary to carve the
development shall be located in ares(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist of a
concrete floor surrounded by a solid wall or fence and have
self -closing doors of a size specified by the Fire Department. All
enclosures to be constructed at grade level and have a level area
adjacent to the trash enclosure area to service these containers.
15. Applicant shall comply with all appropriate State and City
requirements for the handicapped.
16. Noise levels for the interior of residential units shall comply with
minimum State (Title 25) and local standards as indicated in the Noisc
Element of the Campbell General Plan.
17. The applicant is hereby notified that the property is to be maintained
free of any combustible trash, debris and weeds, until the time that
actual construction commences. All existing structures shall be
secured by having windows boarded up and doors sealed shut, or be
demolished or removed from the property. Sect. 11.201 S 11.414, 1979

BUILDING DEPARTMENT
18. Retaining walls at property lines are limited to a height of 15 inches
if constructed of wood.
