Property to be fenced and landscaped as indicated and as added in "red" on plans. �2. Landscape plan indicating type of plant materials, location �of hose bibs or sprinkler system and type of fencing to be ,} submitted for approval of the Planning Director at time of application for building permit. �3. Faithful performance bond in the amount Of $4.000 to be posted to insure landscaping, fencing and striping of parking area within three (3)months of completion of construction, or applicant may file written agreement to complete landscaping, fencing and strip-& of parking area prior to final building department clearance. 5. Landscaping shall be maintained in accordance with the approved landscape plan. 6. Trash container(s) to be located in areas approved by the fire department. Said containers to be provided with en:losures consisting of a concrete floor s,irrounded by a six-foot high solid wall or fence and having six-foot self -closing gates. The applicant is notified as part of this application that he is required to meet the following conditions in accordance with Ordinances of the City of Campbell. A. All parking and driveway areas to be developed in compliance with Section 9319 of the Campbell Municipal Code. B. Underground utilities to be provided as required by Section 9110.6 of the Campbell Municipal Code. C. Plans submitted to the building department for plan check shall indicate cle tly the location of all connections for underground utilities including water, sewer, electric, telephone and television cables, etc. D. Sign application to be submitted in accordance with the pro- visions o' ;he sign ordinance for all signs. Construct one-half street improvements on Almarida Drive frontage of development. J. Pay storm crainage fee in the amount of $5,057. K. The carports located on the southerly and westerly property lines shall comply with Ordinance requirements. a. Carports shall be 2') feet in length and have 9 foot clearance between supporting ec__mns. b. Supporting columns shall be located five feet from property lines. c. Parking stalls shall be provided with bumper guards. The applicant is notified that he shall comply with all applicable Codes or Ordinances of the City of Campbell which pertain to this development and are not herein specified. Commissioner Kleii, asked if the perking problem which was noted in the comment sheet had been solved. Hr. !:ee stated that the applicant has provided the required amount of parking. 'iowever, two spaces are located so as to detract from the ov,rall design appearance, the architectural review committee have recommended htha. the staffese and two spaces be deleted. these Commissioner Klein stated that he generally supports increasing the amount of parking for apartments. However, in this case he would nit oppose the minor deletion. STAFF RECOMMENDATION: Approval, subject to the following conditions: 1. Property to be fenced and landscaped as indicated and as added in "red" on plans. 2. STAFF DISCUSSION: The applicant has presented new elevation plans for the portion of the buildings fronting on Almarida and David as well as a new parking plan. The proposed construction is :ndicated as stucco with wood trim and a tile roof. The plan complies with all recreation and setback requirements. The parking as shown meets code requirements with two of the parking spaces indicated on Almarida Drive frontage in the 20 foot setback. Ordinance requirements provide for a 15 foot setback from street property lines for buildings Section 9319.B. (off-street parking design standards) sub -paragraph 6 on page 212-a reads as follows: "Tne Planning Commission may prohibit the location of parking facilities in requ!red front, side or rear yard when such location may be hazardous, incompatible with I 1 e "S" 70-57 Variant Investment, Inc. Page Two adjacent land uses, or found to impede tht excellence of development." This wording would tend to infer that parking in the front setback is acceptable unless denied. Staff is of the opinion that these two parking spaces located in the setback area across from Breuner's store will not be hazardous or incompatible with adjacent land uses or impede the excellence of the development. The applicant is notified as part of this application that he is required to meet the following conditions in accordance with Ordinances Of the City of Campbell: A. (See map attached). STAFF RECOMMENDATION: 1. Continuance. 2. That plans be revised to improve building appearance from the street and to indicate parking which meets ordinance requirements. STAFF DISCUSSION: In the staff's opinion the appearance of the building elevations adjacent to Almarida Drive and David Avenue should be improved to relieve the sameness along the street frontages. In addition, ten parking spaces along the David Avenue frontage have direct access to the street without providing the required 25 ft. backing space to the rear. The plans should either be redesigned to reduce the number of living units which relate to the spaces or redesigned to comyly with ordinance requirements.
