Commissioner Alexander reported that the Architectural Review \ Committee recommended that the Commission as a whole loot. at the proposed change to the plan. The applicant was not present at the Architectural Review committee meeting that morning. Chairman Scott asked if anyone wished .o be heard on the matter. Mr. Kee s*ated that he had talked to Mr. Blair and he and some of the other neighbors had expressed tiro main concerns in opposition to the change. They believed that the fence should be open, rather than a closed fence along, the north property line. The second concern was that they did not like the building that close to the property line. The reason the applicant is requesting the change is that there is a an existing curb opening on Bascom Avenue at this location and also there is an electrolier in the middle of the driveway as proposed. The fire department has recommended the elocation of four parking spaces in order to have maneuverability of fire trucks. Commissioner HeLard asked Mr. Alexander why the Architectural Review Committee recommended that the application come before the Commission as a whole. Mr. Alexander stated t-..at the applicant has asked for the change to suit himself and the neighbors have objected. Also, the fire department has made certain requests and the applicant was not present at the meeting. Inasmuch as the applicant is not present tonight, he did not think that he was very concerned about what happened. Commissioner Paul asked Mr. Kee if the four parking, spaces are removed, what is that going to do to the parking plan? Mr. Kee stated that they would not be removed - they could be relocated. 1/ut Commissioner Paul stated that if the building is -moved, the driveway and electrolier willhave to be moved. Mr. flehard stated that this application was approved last year and asked if thin condition existed at that' time. Mr. Kee said that it did. Commissioner Alexander moved that "S" 71-61 be denied. Motion seconded by Commissioner Paul and unanimously adopted. Chairman Scott advised that the applicant may appeal the decision to the City Council. (See map, applicant's letter attached). STAFF RECOMMENDATION: Denial. If approved, staff recommends the attached conditions. STAFF DISCUSSION: On September 20, 1971, the Planning Commission approved the plans of Alan Rubnits for a 56-unit apartment complex on this site. At that time the plans indicated a driveway adjacent to tLe northerly property line with the apartments on the southerly side which is adjacent to the Bohnett School located in the City of San Jose. There is an existine residence on the property to the north which is zoned C-2-S and the owners of that parcel were concerned ahout the apartments being, adjacent to their property and blocking_, their view when previous consideration was given. The original approval would leave good visibility and would in no way obstruct the view from this property. The portion of the school property which abuts the apartment units is primarily landscaping and should not create any noise problem for the residents of the three apartment buildings located on the front of this lot. The fire department has stated m the revision that there will be a problem of maneuverability of fire trucks which will require the removal of three covered parking spaces and one open parking space. (See attached man). STAFF RECOMMENDATION: Approval, subject to the following conditions: STAFF DISCUSSION: The applicant proposes to construct a 56-unit apartment complex on a panhandle type parcel of property which contains appro.:imately 1.8 acres. The only street frontage would be on Bascom Avenue where the 80' wide "panhandle" meets the street. The resulting density is about 31 units per acre. The southerly propertv line of some 528 feet is juxtaposed to the Bohnett School (K-6) in San Jose. The other sections of the parcel abuts C-2-S, R-3-S and county agriculture (A). The applicant states that the complex w;.11 be in the moderate rental range and will be for adults only. There are to be Sixteen studio units, 34 cne-bedroom units and six two -bedroom units in all. The complex will consist of six, two-story buildings with a resawn redwood and stone facing and a flat roof. Parting meets the code requirement as does the open space and recreation space.
