"S" 73-1 Application of Thomas MacIvor for approval of
MacIvor, T. two office buildings to be located on property
known as 1930 South Bascom Avenue in a C-2-S
zone. (See map and applicant's letter attached.)
STAFF RECOMMENDATION:
Approval, subject to the attached conditions.
STAFF DISCUSSION:
The applicant is proposing to construct two office buildings on
a parcel of property approximately 35,321 square feet in area. The
total ground floor coverage is 3,456 square feet and the total
building area is 9,856 square feet. The landscaping indicated is
7,097 and the Oruinance requirement of 10% would be 3,186. (The
applicant has figured the total area in his plans stating a total
of J,532 square feet being required.) The landscaping provided
actually indicates 22t.
Due to the layout of the buildings on site, the applicant has
provided parking at the ratio of one space for every 214 square
feet of floor area in the building. The attached letter is presented
to justify a reduction in parking from the normal one space per
each 180-200 square feet of floor area. A copy of the plot plan
is attached for your information.
The building materials are indicated as follows:
North side of "A" and --Anodized aluminum with solar bronze plate
South side of "B" windows and rough sawn redwood plywood, on
the first floor. The second floor is canti-
levered with 5/8 inch rough sawn redwood ply-
wood, anodized aluminum with solar bronze
plate windows.
South side of "A" and --First floor indicates 5/8 inch rouphsawn redwood
North side of "B" plywood siding, two windows, decorative double
door and precast concrete stairways to the second
floor. The second floor is cantilevered and
indicates 5/8 inch roughsawn redwood plywood,
a balcony, six windows, one double door and the
cantilevered ends showing on both sides with
three windows on either projection.
West side of "A" and ---First floor indicates three windows and an
East siue of "B" open area, precast concrete stairs. The second
story indicates 5/8 inch roughsawn redwood
plywood, 17 glassweld windows separated by the
same type of redwood.

The roof for the entire building is indicated as red clay tile with
a three foot high parapet wall of 5/8 ipch roughsawn redwood plywood.
The overall height is 27 feet.
A portion of the planter area at the rear of building "B" will have
to be reduced approximately two feet to allow for the required 25
foot wide aislefor the parking, stalls located at the rear of building
"B".
The overall concept is pleasing but the architectural advisor has
commented that the entrance side elevations of buildings "A" and "E"
is unacceptable. Staff has not made recommendation on the parking,
as the Ordinance gives the Commission the right to allow less spaces
or require mere spaces than required.
It should also be pointed out that there has been no area set aside
for any trash container(s) that the Fire Department may require.
CONDITIONS OF APPROVAL "S" 73-7
1. Property to be fenced and landscaped as indicated and as -added
ii. "red" on plans.
2. Landscape plan indicating type of plant material, location of
hose bibs or sprinkler system and type of fencing to be submitted
for approval of the Planning Director at time of applicatiun for
building permit.
J. Landscaping shall be maintained in accordance with the approved
Landscape plan.
4. Faithful performance bond in the amount of $2000 to be posted
to insure landscaping, fencing and striping of parking area within
three (3) months of completion of construction, or applicant mev
file written agreement to complete landscaping, fencing and striping
of parking area prior to final building department clearance.
5. Trash container(s) of a size and quantity necessary to serve the
development shall be located °n drea(s) approved by the Fire Depar-
ment. Unless otherwise noted, enclosure(s) shall consist of a
concrete floor surrounded by a solid wall or fence and nave self -
closing doors of a size specified by the Fire Department.
6. Entrance elevations should be modified to carry out consistency of
design and plans should be presented to the Planning Director for
approval.
The applicant is notified as part of this application that he is re-
quired to meet the following, conditions in accordance with Ordinances
of the City of Campbell.
A. All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell MunicinaJ Code. All parking spaces
to be proviued with appropriate concrete curbs or bumper guards.
B. Underground utilities to be provided as required by Section 20.16.070
of the Campbell Municipal Code.
C. Plans submitted to the building department for plan check shall
inuicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and television
cables. etc.
D. Sign application to be submitted in accordance with provisions of
the sign ordinance for all signs. No sign to be installed until
application if approved and permit issued by the Building Department
E. Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage, wet
garbage and rubbish produced within the limits of the Citv of
Campbell shall be made with Green Valley Disposal Company. This
requirement applies to dll single family dwellings, multiple
apartment units, to all commercial, business, industrial, manu-
facturing and construction establishments.

Addendum to Request for Variance
on Parking Requirements
Dear Mr. Kee:
Since my letter of March 6, 1973, I have
been informed by the contractor, Swenson
Construction Co., that they have submitted a
revised set of preliminary plans required for site
approval.
The changes reduced the overall gross area
of the two structures to 9,856 square feet rather
than the previous 13,312 square feet; thus the gross
area of the buildinjs has been decreased by 456 square
feet. Also, the laidscaped area has been increased
to twenty per cent (double the required area).
However, the revisions made did reduce the
parking spaces to forty-six, which averages out to
almost 214 square feet per building area to parking
space. I am informed that, if necessary, an additional
two or three spaces could be carved out of the land-
scaping or added to the rear, but not without
destroying the entire concept of planned aesthetics
and retention of two distinct structures upon the
premises.

and verified by an on -site inspection, that some portions of the

being maintained for the office development under your ownership.
This project was approved under proceedings known as "S 73-7",
wherein a 6 foot solid board fence was required around the
perimeter of your property, with the exception of the Bascom
Avenue frontage.
Condition 1 of the City's architectural approved required the

I am the owner of property at 1930 and 1932 S. Bascom
Avenue, Campbell, California, which is adjacent to your
store on Bascom Avenue, across from the Pruneya=d Shopping
Center.
Since you have extended your business hours on Fridays and
Saturdays to 3:00 AM, I have suffered three broken 4 x 7
plate glass windows, damage and stains from food and debris
repeatedly hurled against the buildings and windows, and a
pellet gun shot through a window. Additionally, every
Saturday and Sunday, I have to pick up the glass from the
bottles which are thrown at the buildings. Other
miscellaneous acts include damage to the fence between our
properties by your patrons who have knocked it over three
times. The fence, on one occasion, was knocked over into my
driveway damaging the plants as well as causing vehicles to
run into it. In all cases you have repaired it for which I
am thankful.
Your noon school crowd pelt the buildings with their excess
food preparations from your shop (mustard and ketchup) anrl
the sauce from Taco Bell. It would also be appreciated if
you could monitor the student crowd in your back parking lot
as well as the late evening Friday and Saturday customers.
While the problem of bad manners exhibited by your customers
is not entirely your fault, I would appreciated anything you
can do to lessen nr eliminate the problems.
Unless you can be responsible for those who come upon your
property, as far as acts upon your property, then it is, in

evidence of the amount in question ($1,000) being refunded.

I understand that you are the owner of the premises to
their rear, and that through the Carl Swensen organization,
as contractor, under the direction of the City of Campbell,
you have erected certain improvements on your property.
A problem has arisen with respect to grading of your im-
provements in that my client's eight foot fence has become
a four foot fence, and this makes access to his premises
from outsiders relatively easy. He has experienced acts
of vandalism, and because of the sensitive nature of his
business, he cannot let this continue.
You are further advised that plans and specifications for
your project, as approved by the City of Campbell, require
a six foot high, solid board fence, for the side and rear
yards of your project.
Unless this problem can be rectified forthwith, I have been
instructed to file an action for damages.

Dear Mr. Powell:
Your letter cf March 27, 1974, was reviewed with much
interest. The complainant's position that he wishes the
fence height increased so as to avoid possible theft of his
"juvenile" chairs is ludicrous and not a valid reason for
your imposing the additional hardship upon me. The fence,
by the complainant's own statements, started out as an 8
foot fence and he has continually filled in the area with
tanbark thereby creating his own "dangerous situation."
The condition for erection of fences applies only to areas
,there none now exist and not to pre-existing fences.
Also, in trying to be a good neighbor, I have not
complained about the noise and constant throwing of tanbark
and other debris over the fence. The smell and odors
from the rabbits is another situation with which I must cope.
I discussed the fence situation with Mr. Dimb'ey,
the Building inspector, and he agreed that the existing
fencing was satisfactory as it stood. In fact, most of the
people would object if we tried to raise it; more important
the aesthetic values of the project would be diminished
considerably if your suggestions were carried out.
Finally, since it appears from the surveyors stakes
that the complainant's fence is encroaching on my property
eight to nine inches, would you please direct them to remove
it so that I may consider complying with your request.

Dear Mr. Kee:
Please consider this letter as a request for a variance in the
parking requirements for the professional offices which I propose
to build on 1930 So. Bascom Avenue, Campbell, California.
From the inception, I wanted a building which would not only
conform to the general area, "Pruneyard Shopping Center," but one
which had aesthetic value as well. In order to do this, I directed
the architect to allocate as much ground to landscaping as possible
(it has almost twice the requiremEnt). Additionally, in order to
carry out my desire for a more desirable and aesthetic project, it
ns determined to put up two structures rather than erect one long
box car type," up against the south property line with a cement block
wall. This decision, of course, resulted in greater expense to me
for the buildings as well as the increase in the length of the
ingress and egress road because of the sweeping curves. I do not
mind paying this sum since it will result in a more pleasing combina-
tion of buildings and grounds. Since I believe we, the City and I,
have the same objectives in mind, viz., to have pleasant, well
planned,attractive professional buildings in the City of Campbell,
I feel I should be given some consideration in this area by allowing
me a variance on the parking requirement.
The exclusion from the gross area of certain non -useable
areas (including closets, wall and partition space, supporting
equipment areas, and other non -useable areas) should easily bring
the net useable floor space down below ten thousand (10,000) square
feet, by a good margin. Secondly, the use of the buildings should
be considered. Basically, they will contain attorneys (2 or 3),
and an insurance man, hopefully, a C.P.A., and such. Most all of
these people schedule their appointments so that we do not have the

problem of the public suddenly descending upon us as is the case
in other types of businesses. In my own case, I have conducted my
business on Bascom Avenue for over twelve years, and during all of
this time have never kept more than two or three chairs in my waiting
room. The in.urance company I have in mind, seldom sees more than
two people at a time, and so on. I appreciate the argument that
it is an unknown factor as to what client, load future tenants might
have, but I ao believe that if you made a study of professional
offices, my contention of a very light traffic flow would be borne
out. The alternatives, viz., making a box car structure, and using
the three thousand (3,000) extra square feet set aside for landscaping
for additional parking, results in a loss for both me and the City.
I want to be proud of my buildings, and I want the City to be proud
of them also. For this reason, I propose that a variance be granted
to allow me to build the project with the fifty parking places
designated, rather than change the structures or landscaping plans.
I believe some encouragement should be given to those who are willing
to spend a little more money on a project to make it an asset to the
City, rather than just a "box building" to bring in rents.
Finally, the granting of the requested variance would not be
contrary to the public interest, safety, health and/or welfare, nor
contrary to the intent or spirit of the parking ordiance. Additionally,
there would be no adverse effect on the master plan for the general
area, sitce I am creating structures and landscapes that are in
harmony with the master plan. None of the neighbors will suffer
as a result of the requested variance, nor will their properties
suffer detriment.
This matter is set for hearing on March 19, 1973, at your
council meeting. If you wish, I would be happy to meet with you,
in your office to further discuss the matter at your convenience.
