Tanaka on 1,ehalf of Ross Sockolev ai.d Tower Records for approval of plans to construct a record store to C•�1b1�7 be located at 1900 South 'Bascom Avenue in a C-2-S Zone, subject to the follow- ing conditions: 1. Property to be fenced and landscaped.as indicated and as added in "red" on plans. 2. Landscape plan, indicating type of plant material, location of hose bits or sprinkler system and type of fencing to he submitted for approval of the Planning Director at time of application for building permit. 3. Landscaping shall be maintained '.a accordance with the approved landscape plan. 4, raithful performance bond in the amount of $5,000 to be posted to insure landscaping, fencing and striping of parking area within three (3) months of completion of construction, or applicant may file written agreement to complete landscaping, fencing and striping of parking area prior to final building department clearance. 5. All mechanical equipment located on roofs shall be screened as approved by the Planning Director. 6. Internal traffic circulation to be approved by City Engineer. The applicant is notified as part of this application that he is required to meet the following conditions in accordance with Ordinances of the City of Campbell. A. All parking and driveway areas to be develoled in compliance with Section 21.50 of .the Campbell Municipal Code. All park- ing spaces to be provided with appropriate concrete curbs or bumper guards. B. Underground utilities to be provided as required by Section 20.16.070 of the Campbell Municipal Code. C. Plans submitted to the building department for plan check shall ind)cate clearly the location of all connections for underground utilities, including water, sever, electric, telephone and television cables, etc. D. Ordinance No. 782 of the Campbell Municipal Code stipulates that any contract for the collection and disposal of refuse, garbage, wet garbage, and rubbish produced within the limits of the City cf Campbell shall be made with Green Valley Disposal Company. This requirement applies to all single family dwellings, multiple apartment units, to all commer- cial, business, industrial, manufacturing, and construction establishments. F. Trash container(s) of a size and quantity necessary to serve the development shall be located in area(s) approved by the Fire Department. Unless otherwise noted, enclosure(s) shall consist of a concrete floor surrounded by a solid wall or fence and have self -closing doers of a size specified by the fire department. G. Applicant shall meet all State requirements for the handi- capped. FIRE DEPARTMENT H. Provide automatic fire extinguishing system. I. Provide one hour fire separation between shops and trash area. J. Provide "2ABC" fire extinguishers. PUBLIC WORKS DEPARTMENT K. Agreement and bonding for construction of balance of street improvements. L. Process and file a parcel map. M. Segregate assessments for L.I.D. N18. N. Pay storm drainage area fee at $765 per acre. Tanaka on behalf of Ross Sockolov Tower Records and Tower Records for approval of plans to construct a record store to be located at 1900 South Baswm Avenue in a C•2-S Zone. (See map attached). STAFF RECOMMENDATION: I. Continuance in order that revised site plans can be submitted. 2. If approved, subject to the attached conditions. STAFF DISCUSSION: The applicant is proposing to construct a 11,000 square foot building on a parcel containing 41,768 square feet. The resulting coverage would be approximately 27i. The building is a contemporary design of slunpstone concrete block. Arched windows approximately 12 feet wide appear on the front and south elevations. iParking is provided at a ratio of one space for each 190 square feet of gross floor area. Landscaping is indicated on IIx of the net area. It was the opinion of the Architectural Advisor and Staff that the! building is too close to McBain Avenue. It is indicated as 10 feet from Bascom Avenue, 4 feet from McBain Avenue and becomes tangent to the property line on the corner. It is the staff's opinion that the building should not be closer than 10 feet to the McBain Avenue property line. This would necessitate a shift of the building 6 feet to the south and a redesign of the parking area. COA)ITIONS OF APPROVAL - "S" 75-1 Tower Records 1. In particular, the complaint cites that the noise is being generated in the early morning hours - 1:00 to 3:00 a.m. While we recognize your needs as a business operator to maintain a clean facility, it is important to note that your store is located adjacent to a residential neighborhood. Conflicts such as this are not uncommon where differing land uses abut one another, and in cases like this we ask that you do whatever you can to alleviate this noise problem. At the time the application for Tower Records was processed in 1975, the ordinance requirement for parking at a commercial establishment was one parking space for each 150 square feet of gross fluor area. Based on this requirement the proposed retail floor area of 11,061 sq.ft. would have -required a total of 74 spaces. As you may be aware, the Planning Commission has the authority to modify the ordinance requirement. At that time, the Commission was routinely approving parking ratios for commercial developments that ranged from 1:150 to 1:200. Tower Records was approved with a total of 60 parking spaces, resulting in a ratio of 1:180. The parking requirement for commercial developments was subsequently changed to 1:200, based on the gross floor area. With this in mind, the Tower Records facility exceeds the current parking requirement for a commmrclal building. This is apparently a situation where the successful nature of the business generates more parking demand than the parking provided. After discussing the parking issue with the City Attorney, it appears that the City cannot re -open the issue of parking requirements for this development. The project was approved as a retail use under the provision of the C-2-S Zoning District (General Commercial). As such, a Use Permit was not required. It is the opinion of the City Attorney that the only avenue open to the City regarding parking for Tower Records would be to declare that the business constitutes a nuisance. We asked a nurse for the name of a nice shopping center which we could go to. we could purchase a gift for the ill brother. She directed us to the Prune Yard. I dropped my wife off at Berry Hill and then vent to park, which happened to be across from the T owcr record at o re. I decided to run into Tower while my wife shopped About hour later I ret urned to find that ■y car was gone! I assumed that it had been stolen, and noticed a young lady nearby with ■ hand-held radio. I asked for her assistance ■nd she informed ■e with a smile on her face that she had had my ear towed awsyl She proceeded to inform me that because I had left to go to Tower that she was authorized to call a tow truck outl She said proudly that she had watched me go across the street, then quickly called Bob's Towing because "we know we have to work fastl" She also said that I was "just the kind of person she watches for". I protested because my wife was shopping, and she curtly told me that since she didn't see my wife she didn't care what I said. She called a cab for me (how thoughtful) and the cabbie told me that this same procedure had occurred at least fifteen times that week! He drove me to Bob's Towing and they informed me that it would cost me $60.00 in CASH to take the car. Luckily, I was able to pay that fee in cash, walked around the carto look if there were scratches, and took off. I then went back to the Prune Yard to pick up my wife who was extremely anxious, drove back to the hospital, parked my car and -behold- I could not open the doorl (I have a new, Toyota LE Camry and it is all electrically locked.) I had to crawl into the back to get out the door, then I discovered that neither of the front doors would open from the outside, nor would the windows go down. I went to a phone in the hospital, called Bob's Towing and asked them what they had done to cause this damage. He informed me that they had to break into my car Iit is a front - wheel drive) in order to tow it away! I asked him what he intended to do about the damage.He put me on "hold" and never came back on the line. By this time it was 4 p.m. and I had to get back to Redding, which is a S hour trip. Duggan City Manager Subject: Bascom Avenue Traffic improvements - Statue Update To date, the following actions have boon taken with regard to the Bascom Avenue traffic improvements between Campbell Avenue and Campisi Way: - Lighting in the area of the crosswalk has been increased. - Special traffic enforcement was conducted during the holiday season, and pedestrian safety education handouts were distributed in local retail businesses, - A letter was sent to the management of Tower Records to encourage their acquisition of additional parking resources. A response has been received indicating a willingness to cooperate. As ouch, a meeting with representative snould be scheduled in March, 1989. (City Manager) - Design of a temporary pedestrian signal was completed in January. GAB Construction will proc*ed.with installation on February 27, with activation of the signal scheduled for March 9, 1983. The total cost of this project will be between $30,000 and $35,000. (Public Works) - A scope of work has been pieparad to allow retention of a traffic consultant to conduct a circulation study of this area. On March 7, 1989, the City Council will be asked to execute a $10,000 contract with DKS for provision of thee* services. (Public Works) - A pedestrian improvement plan is being prepared b; the traffic engineering staff in conjunction with volunteer assistance. Data for this report is now being collected. Upon completion, this report will include a set of criteria for *stabllshsw_nt of pedestrian crossings and improvements. A scope of work will be prepared by mid -March to retain assistance in analyzing current deficiencies relative to the established criteria, and to recommend improvement proposals for immediate and future implementation. BASCOM AVENUE, PARKING FOR TOWER RECORDS DISCUSSION: Pursuant to our meting of December 14, 1988. regarding the recent accident in front of the Tower Records store, please find the following information. At the time the application for Tower Records was processed in 1975, the ordinance requirement for parking at a comercial establishment was one parking space for each 150 square feet of gross floor area. Based on this requirement the proposed retail floor area of 11,061 sq.ft. would have required a total of 74 spaces. As you my be aware, the Planning Comission has the authority to modify the ordinance requirement. At that tine, the Comissfon was routinely approving parking ratios for commercial developments that ranged from 1:150 to 1:200. Tower Records was approved with a total of 60 parking spaces, resulting in a ratio of 1:180. The parking requirement for commercial developments was subsequently changed to 1:290, based on the gross floor area. with this in mind, the Tower Records facility exceeds the currant parking raquirsmnt for a commercial building. This is apparently a situation where the successful nature of the business generates more parking demand than the parking provided. After discussing the picking issue with the City Attorney, it appears that the City cannot reopen the issue of parking requirements for this development. The project was approved as a retail use under the provision of the C-2-S Zoning District (General Commercial). As such, a Use Permit was not required. It is the opinion of the City Attorney that the only avenue open to the City regarding parking for Tower Records would be to declare that the business constitutes a nuisance.
