Wm. Flagg's to construct a William Flagg's Restauraiit on property
Restaurant known as 1555 South Bascom Avenue in a C-2-S
(General Commercial) Zoning District. (See map attached)
STAFF RECOMMENDATION:
Approval, subject to the attached conditions.
STAFF DISCUSSION:
The applicant is proposing to construct a 5,000 square foot restaurant
building on a 43,000 square foot lot. The resultant site coverage would
be approximately 12%.
Building materials are indicated as split -faced biuck walls with a metal
roof.
Parking is being pro,,ided at a ratio of one space for every two seats,
which exceeds the zoning code requirements of one space for every three seats
The site plan indicates that 7,000 square feet, or 19%, of the net lot area
will be landscaped. Staff is of the opinion that the four existing poplar
trees located along the southerly property line shcild be maintained, even
though this would reduce the number of parking spa :es by four.
Additionally, staff is of the opinion that the existing opening in the
fence along the westerly property line should be maintained to insure access
to the rear of the adjoining property and to the creek channel.
CONDITIONS OF APPROVAL

i. Applicant to sign an agreement, or provide an easement which is satis-
factory to the Ci ,y Attorney that the fence openinq, along the westerly
property line, will be maintained in an open and unobstructed marner.
2. Property to be fenced and landscaped as indicated and as added in
red on plans.
3. Landscape plan indicating type of plant material, location of hose
bibs or sprinkler system and type of fencing to be submitted for approval
of the Planning Director at time of application for building permit.
4. Landscaping shall be maintained in accordance with the approved
landscape plan.
5• Faithful performance bond in the amount of $3,000 to be posted to
insure landscaping, fencing and striping of parking area within three
(3) months of completion of construction, or applicant may file
written agreement to complete landscaping, fencing and striping of
parking area prior to final building department clearance.
6. All mechanical equipment located on roofs shall be screened as
approved by the Planning Director.
The applicant is notified as part of this application that he is required
to meet the following conditions in accordance with Ordinances of the City
of Campbell.
A. All parking and driveway areas to be developed in compliance with
Sertion 21.50 of the Campbell Municipal Code. All parking spaces I

to be provided with appropriate concrete curbs or bumper guards.
B. Underground utilities to be provided as required by Section 20.16.070
of the Campbell Municipal Code.
C. Plans submitted to the building department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and television
cables, etc.
D. Sign application to be submitted in accordance with provisions of
the sign ordinance for all signs. No sign to be installed until
application is approved and permit issued by the building department.
E. Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage,
wet garbage and rubbish produced within the limits of the City of
Camp�ell shall be made with Green Valley Disposal Company. This
requirement applies to all single family dwellings, multiple apartment
units, to all commercial, business, industrial, manufacturing, and
construction establishments.

Commissioner Pack reported that the Architectural
Lyle, Jim
Review Committee recommends approval of the
application of Jim Lyle for approval of plans to
construct a six -unit residential development on
property known as 150 and 164 West Rincon Avenue
in a R-2-S (Medium Density Residential) Zoning
District subject to the conditions recommended
by staff and an added condition No. 7 to read:
Carport structure and window treatment shall
be subject to approval of the Planning Director.
The applicant is in agreement with the conditions. Commissioner
Hebard asked if the concerns of the Architectural Advisor had been
satisfied, and Commissioner Pack replied that they we-e.
Commissioner Samuelson moved that "S" 76-7 be approved subject to
the recommended conditions and the addition of condition, 7, seconded
by Commissioner Pack and unanimously adopted.

21.48 of the Campbell Municipal Code.

COMMUNICATIONS Mr. Kee retorted that the only communications
received relate to specific items on the agenda
and would '.,e read when the appropriate item is
considered.
ARCHITECTUF.A_L APPROVALS
Commissioner Pack reported for the Architectural Review Committee.
"S" 74-36 Application of Daniel A. O'Kicfe for approval of
O'Kiefe, Daniel A. modifications to a previously approved site plan
for a body shop which was constructed on property
known as 261 McGlincey Lane in a M-1-S (Light
Industrial) Zoning District.
Commissioner Pack reported that the committee recommends denial
without ;rejudice in accordance with the staff recommendation. The
applicant was not present at the committee m0eting.
Mr. Kee advised the applicant was notified of the morninP and eveninr
meeting times and a copy of the staff report was sent to him.
Vice Chairman Dickson retorted that the committee reviewed the modi-
fications to the previously approved plan and it is their opinion
that the parking layout is unworkable. The committee was in agree-
ment with the staff rucenmendotion of denial without prejudice-

AGREEMENT
To induce the City of Campbell to permit the construction
of a Wm. Flagg's restaurant at 1555 South Bascom Avenue,
Campbell, California, Wm. Flagg's Restaurants, a limited
partnership, hereby agrees with the City of Campbell that
during the period during the term of the Lease Agreement
dated January 6, 1975, between Robert Keesling, David M.
Keesling, Walter R. Keesling, Mona M. Keesling and Betty
B. Voytek, as Lessor and Wm. Flagg's Restaurants, as
Lessee, a copy of the short form of which is attached
hereto as EXHIBIT "ONE", in which Wm. Flagg's Restaurants
is entitled to possession of the leased premises described
therein, Wm. Flagg's Restaurants will maintain the area
shown in red on the attached EXHIBIT "TWO" in an open and
unobstructed manner.
It is also agreed by the parties hereto that the provisions
of this Agreement shall be specifically enforceable. The
reason for this provision is that damages would not be an
adequate remedy for breach of this Agreement, because the
purpose of this Agreement is to provide emergency access
for city fire fighting and other equipment.

THAT the Lessor, in consideration of the rent to be paid and the. covenants
to be performed by the Lessee as set forth in that certain Lease Agreement between

hereunder, it shall have the option to extend the term hereof for two additional
five year periods upon the terms and provisions set forth in the Lease Agtional.
2. All signs, furniture, fixtures and equipment located in the improvements
on said real property shall be and remain personal ptoperty, no matter how affixed,
and shall at all times remain toe property of Lessee.
The sole purpose of this instrument is to give notice of the aforesaid Lease
Agreement and all its terms, covenants and conditions to the same extent as if
said Lease Agreement were fully set forth herein.

1. Applicant to sign an agreement, or provide an easement which is satis-
factory to the City Attorney that the fence opening, along the westerly
property line, will be maintained in an open and unobstrc •.ed manner,
2. Property to be fenced and landscaped as indicated and as added in
red on plans.
3. Landscape plan indicating type of plant material, location of hose
bibs or sprinkler system and type of fencing to be submitted for approval
of the Planning Director at time of application for building permit.
4. Landscaping shall be maintained in accordance with the approved
landscape plan.
5. Faithful performance bond in the amount of $3,000 to be posted to
insure landscaping, fencing and striping of parking area within three
(3) months of completion of construction, or applicant may file
written agreement to complete landscaping, fencing and striping of
parking area prior to final building department clearance.
6. All rrchanical equipment located on roofs shall be screened as
approved by the Planning Directo-.
The applicant is notified as part of this application that he is required
to meet the following conditions in accordance with Ordinances of the City
of Campbell.
A. All parking and driveway areas to be developed in compliance with
Section 21.50 of the Campbell Municipal Code. All parking spaces
to be provided with appropriate concrete curbs or bumper guards.
B. Underground utilities to be provided as required by Section 20.16.070
of the Campbell Municipal Code.
C. Plans submitted to the building department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, sewer, electric, telephone and television
cables, etc.
D. Sign application to be submitted in accordance with provisions of
the sign ordinance for all signs. No sign to be installed until
application is approved and permit issued by the building department.
E. Ordinance No. 762 of the Campbell Municipal Code stipulates th.,c
any contract for the collection and disposal of refuse, garbage,
%,,t garbage and rubbish produced within the limits of the City of
Campbell shall tx• made with Green Valley Disposal Company. This
requirement applies to all single family dwellings, multiple apartment
