3595, 3645, and 3675 S. Bascom Avenue.
Chairman Dickson asked Mr. Kee for his comments.
Mr. Kee advised that the proposed annexation is composed of 7.47 acres and i;
presently zoned R-1-8 in the County. The Land Use Element of the General Plan
reflects this area for high density residential. The proposed zoning of R-3-S
would conform to this density. The prezoning is required before the Council

STAFF DISCUSSION:
This item was continued from the meeting of July 5, 1977 In order that the
applicant could meet again with the Santa Clara Valley Water District.
Staff has been advised by the applicant that the nwners have reached
an agreement with the Santa Clara Valley Water District, and therefore,
Is withdrawing his request.
A denial would remove this item`rom the agenda.

Commissioner Vierhuus reported that the Site and Architectural Review Committee
had met with the applicant, but due to the many ramifications of this application,
the committee felt the entire Commission should be involved in the discussion.
Chairman Dickson asked Mr. Kec for his comments.
Mr. Kee stated that this application has been approved by the Planning Commission
with Condition No. 1 stating: "Grading plans and fence details to be approved by
the Santa Clara Valley Water District."
The Water District has advised that the applicant is required to provide: (1) a
23' - 0" easement across the rear of the property; (2) a 14' - 0" wide double -
swing gate in the rear fence (3) an ingress/egress easement to Bascom Avenue for
flood control purposes.
The applicant is requesting relief from the Condition No. 1 for reasons wh':h
include:
1. The District does not need this right-of-way for maintaining cna creek,
because they have an existing 30' road easement just west of the one
being requested.
2. Granting the right-of-way was not specifically Indicated as a condition
of "S" approval granted on the subject property.
3. In his opinion, the requirements of the Water District puts an unreasonable
restriction on the owners of this property that other owners of property

Commissioner Campos arrived at 7:55 and was seated.
Mr. Alan DeGrange, 15780 Shannon Road, Los Gatos, representing the doctors operating
the emergencyanimal clinic came forward and stated that he was requesting they be
allowadto have their Building Permit and then they would work with the Water District
to most their requirements.
Commissioner Pack asked Mr. Kee if the easement would interfere with the
parking requirement.
Mr. Kee stated that the three parking spaces could be maintained in the
easement.
Mr. Bill Carlson, Division Manager from Santa Clara Water District,was present
and stated that the Water District's desire was to have access only and It
would not disturb the parking.
Commissioner Mebavd stated in the future perhaps the Water District and staff
could work more closely together on applications such as this, working out
conditions to alloy a more smoothly running procedure.
Commissioner Pack also suggested that steps be taken to unify the procedures
on easements and right-of-ways.
Commissioner Mebard moved that this request for relief from Condition 1 of
"S" 76-42 be continued for 30 days in order that the applicant can resolve this
problem with the Water District, seconded by Commissioner Vierhus and unanimously

STAFF RECOMMENDATION:
That the Planning Commission make a determination after hearing the
evidence of the applicant and the Santa Clara Valley Water District.
STAFF DISCUSSION:
On January 4, 1977, the Planning Commission approved plans to construct a
new emergency animal clinic on property known as 1657 South Bascom Avenue.
Condition No. I of that approval stated: "Grading plans and fence deta!ls
to be approved by the Santa Clara Valley Water District."
The Water District has advised the staff that the applicant is required to
provide: (1) a 23'-0" easement (east of the top of the bank) across
the rear of the property; (2) a 14'-O" wide double -swing gate in the rear fence;
and (3) an ingress/egress easemert to Bascom Avenue for flood control purposes.
(Letter dated May 19, 1977 attached).
The applicant has advised the staff that, in his opinion, the requirements of
the Water District "puts an unreasonable restriction on the owners of this
property that other owners of property in the area otherwise enjoy. Should
we lose the right to park on the easement (three spaces) in the future, the
function of the facility..... would be severely impaired." (Letter dated
May 25, 1977 attached).
At a meeting on June 1, 1977, a representative of the Water District indicated
that the grading and fencing plans would not be approved unless the easements
were provided.
The applicant is requesting relief from the Condition No. 1 for reasons which
Include:
I. The District does not need this right of way for maintaining
the creek, because they have an existing 30' road easement
just west of the one being requested.
2. Granting the right of way was not specifically indicated as
a condition of the "S" approval granted on the subject property.

Staff is of the opinion that the Commission should evaluate its conditions
of approval after hearing testimony from the applicant and a representative

We have received the site plan for the Emergency Animal Clinic
on Bascom Avenue, adjacent to Los Gatos Creek, File S 76-42,
sent to us on April 25.
The site is not subject to flooding from the 18 flood on Los
Gatos Creek. The enclosed marked plan shows the easement for
the channel and an ingress and egress right from Bascom Avenue
that are required from this site for flood control purposes.
We request that these rights of way be transferred to this
District. Please make arrangements with Mr. Donald Lawrie of
our Real Estate Division at extension 261.
In accordance with District Ordinance 75-6, the owner should
show any existing well(s) on the plans and inform us regarding
their proposed use. Please contact Mr. Zozaya on extension 379
for information about well permits.
It would be desirable to incorporate the site's drainage into
an existing storm drainage system. If a storm drain outfall
into the creek is necessary, please design it to serve the
general area to minimize the number of future outfalls needed.
Please submit outfall struc'ire details for our review and
issuance of a permit prior to advertising for construction.
Design guides for outfalls will be furnished upon request.
Storm drainrge should not be designed to go over the creek bank.

We have received a copy of a letter directed to you bj Mr. John
L. Richardson of the Santa Clara Valley Water District in which the
District requests an easement near the rear of the above mentioned
property. The easement begins at the top of the bank which is twenty
to twenty-five feet within the property line and extends twenty-three
feet further into the lot.
While the District does not presently object to the development
which will occur within the requ6sted right of way and we have no
objection to granting the District access to the bank for maintenance
and repairs, we feel that the request for the right of way puts an
unreasonable restriction on the owners of this property that other
owners of property in the area otherwise enjoy.
Should we lose the right to park on the easement in the future,
the function of the facility planned for the site would be severely
impaired. Consequently, we would like to meet with you at your
earliest convenience to discuss any appeal procedures which may be

"S" 76-42 Commissioner Samuelson reported that the Architectural
DeGrange, A. Review Committee met with the applicant and recommends
approval of the application of Allen DeGrange for

a C-2-S (General Commercial) Zoning District subject to
1 the following conditions:
1. Grading plans, and fence details to be approved by the Santa Clara Valley
Water District.
2. Property to be fenced and landscaped as indicated and as added in "red" on
plans.
3. Landscape plan indicating type of plant material, location of hose bibs or
sprinkler system and type of fencing to be submitted for approval of the
Planning Director at time of application for building permit.
4. Landscaping shall le maintained in accordance with the approved landscape
plan.
5. Faithful performance bond in the amount of 63,000 to be posted to insure
landscaping, fencing, and striping of parking area within three (3) months
of completion of construction, or applicant may file written agreemant to
complete landscaping, fencing and striping of parking area prior to final
Building Department clearance.
6. All mechanical equipment located on roofs shall be screened as approved by
the Planning Director.
7. Applicant to provide documentation that the building will be constructed
of materials which will insure that no sound exceeding 65 decibels shall be
audible on the exterior of the building.
The applicant is notified as part of this application that he is required to meet
the following conditions in accordance with Ordinances of the City of Campbell.
A. All parking and driveway areas to be developed in compliance with Section
21.50 of the Campbell Municipal Code. All parking spaces to be provided
with appropriate concrete curbs or bumper guards.
B. Underground utilities to be provided as required by Section 20.16.070 of the
Campbell Municipal Code.
C. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities, including
water, sewer, electric, telephone and television cables, etc.
D. Sign application to be submitted in accordance with provisions of the sign
ordinance for all signs. No sign to be installed until application is
approved and permit issued by the Building Department.

E. Ordinance 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage,
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.
F. Trash container(s) of a size and quantity necessary to serve the development
shall be located in area(s) approved by the Fire Department. Unless other-
wise noted, enclosure(s) shall consist of a concrete floor surrounded by a
solid wall or fence and have self -closing doors of a size specified by the
Fire Department. All enclosures to be instructed at grade level.
G. Applicant shall -P-1 all State requirements for the handicapped.
PUBLIC 'IRKS DEPARTMENT
H. Obtain excavation permit for street tree installation.
I. Pay storm drainage area fee @ $765 per acre.
J. Provide grading and drainage plan for review and approval of City Engineer.

received and Mr. Kee reported that there had not been any reports of any complaints
from the neighbors.
Commissioner Vierhus asked if the existing structures would be removed.
Mr. Kee stated that the plans before the'Comnission indicate that the temporary
structures will be removed.

STAFF DISCUSSION:
The applicant is proposing to construct a 4,100 square foot animal clinic on
a 16,600 square foot lot. The resultant building coverage of the lot would
be approximately 25%.
Building materials are indicated as concrete block walls with redwood trim
and fiberglass shingle roofing.
The applicant is providing twelve parking spaces, which would result in a
ratio of one space for every 344 square feet of building. Staff is recom-
mending that an area at the rear of the building designated for future use
be utilized for five additional parking spaces for staff. This area would
be serviced by a twelve foot driveway.
The site plans indicate that approximately 16% of the net lot area will be
landscaped.
The Architectural Advisor is of the opinion that the building has a simple
straight -forward design.

Emergency Animal Clinic
We propose to construct new facilities for the Santa Clara
Valley Veterinary Emergency Clinic. The existing clinic is
located in 9 house on the site. New facilities are appropriate
baceuae of the expanding need for emergency services and the existing
building is inadequate. There will be no change in activities other
then serving an expanding need. An average of less than 2
doctors will be working at the clinic at any one time. Working
hours are weeknights between 6 pm and 8 am, and weekends and
holidays.
We feel that the new structure will enhance the area and upgrade
the services provided the people of Santa Clara valley.

TREATMENT CAPACITY ON LAND
DEVELOPMENT APPROVALS PURSUANT TO
DEVELOPMENT OF APN '.1.980;L 1 $
Please take notice that no vested right to a building permit
shall accrue as the result of the granting of any land development
approvals, and applications. Pursuant to the adoption of ordinance
9.045 by County Sanitation District No. 4 of Santa Clara County,
the agency providing the above described parcel(s) with sewer
service, if the District's Manager and Engineer makes a deter-
mination that the issuance'of a sewer connection permit to a
building, or proposed building, on the above described property,
will, in his opinion, cause the District to exceed its ability to
treat adequately the wastewater that would result from the issuance
of such connection permit, then said permit may not be issued,
and, hence, no building permit may be issued by this agency.
If the sewer connection permit is issued, it may contain sub-
stantive conditions designed to decrease the wastewater associated
with any land use approval.

Dear Mr. Kee:
As a Condition of Approval for the above named project, we are
'to provide documentation that the building will be constructed
of materials that will insure that no sound exceeding 65 decibels
shall be auditle on the exterior of the building". To meet that
condition we are submitting the following calculations for your
review.
Based on tests made by our acoustical consultant on a previous
project, noise levels produced by several barking dogs confined
within a building could reacE 90 dBA (Edward L. Pack, Project
No. 7072). These tests were made in a local animal hospital.
Please note that the function of this clinic differs from that
of a normal pet clinic in that no animals will be boarded and due
to the cost of using the facility, only seriously ill or injured
animals will be housed in the Ward. Therefore, it is unlikely
that the sound level will ever reach the 90 dB level used in the
calculations.
1. Exterior walls are 8" thick concrete block, fully grouted,
STC= 48. The wall will provide approximately 48 d8 of attenuation
or 23 dB more than required to reduce animal noises to 65 dB at
the building exterior.
2. Exterior doors are sold core wood with complete sound seals
and closers, STC= 29. The doors will provide approximately 29 d8
attenuation or 4 dB more than is required.

3. Roof consists of 2 x 6 rafters with }" plywood sheathing under
asphalt shingles. The rafter space is filled with fiberglass
insulation. The ceili'.g is 3/4" acoustical tile over J" gypsum
board. The STC for the roof assembly exceeds 42 which is .msee
than sufficient.
4. Exhaust duct at Ward is a 16 inch diameter duct lined with
1 inch thick sound absorbent material. Noise reduction with
liner is approximately 1.05 dB per foot so that the 26 foot long
duct will provide a reduction of 27 dB which is sufficient. An
addendum will be issued deleting one 300 CFM grille and increasing
the remaining to 600 CFM so that the duct is uninterrupted for e
distance of 26 feet.

of-way along the rear of the subject property. A copy of Mr. Defrange's request
Is attached.
As you are aware, on January 4, 1977 the Planning Commission approved pions to construct
a now emergency animal clinic on the subject property subject to condition 1 which
states: "Grading plans and fence details to be approved by the Santa Clara Valley
Water District.
It Is our understanding, based upon statements made at the June 1, 1977 staff meeting
that your agency Is requiring the 23'-0" easement prior to approval of the grading
plans and fence o.otalls.
Please be advised that any comments which your agency wishes to make regarding this
request to remove condition /1 of the approval for "S" 76-42 should be sent to
the Planning Office prior to June 27, 1977.

Dear Planning Commissioners:
We respectfully request that the 23' right of way "required" by
the Santa Clara Valley Water District on the above Subject not
be a condition of our getting City approvals due to the following:
1. The District does not need this right of way for maintaining
the creek, because they have an existing 30' road easement just
west of the one being requested.
2. Granting the right of way was not specifically indicated as
a condition of the 'S' approval granted on the Subject property.
3. This is the first demand for additional property along Los
Gatos Creek in Campbell to be made by the Santa Clara Valley Water
District. Accepting this "requirement" will set a precedent that
will have a detrimental effect on many property owners in Campbell.
4• Acceptance of this demand would deny the owner's of the Subject
property rights now enjoyed by other property owners along Los
Gatos Creek.
The ownership of the Subject property has not changed. They are
local practicing veterinarians who wish to upgrade their services
to the community.
For the reasons stated above, please do not place additional restric—
tions on the Subject property.

Dear Mr. Kee:
We have received a copy of a letter directed to you by Mr. John
L. Richardson of the Santa Clara Valley Water District in which the
District requests an easement near the rear of the above mentioned
property. The easement begins at the top of the bank which is twenty
to twenty-five feet within the property line and extends twenty-three
feet further into the lot.
While the District does not presently object to the development
which will occur within the requested right of way and we have ri
objection to granting the District access to the bank for maintenance
and repairs, we feel that the request for the right of way puts an
unreasonable restriction on the owners of this property that other
owners of property in the area otherwise enjoy.
Should we ose the right to park on the easement in the future,
the function of the facility planned for the site would be severely
impaired. Consequently, we would like to meet with you at your
earliest convenience to discuss an,, appeal procedures which may be
open to us.

We have received the site plan for the Emergency Animal Clinic
on Bascom Avenue, adjacent to Los Gatos Creek, File S 76-42,
sent to us on April 25.
The site is not subiect to flooding from the 18 flood on Los
Gatos Creek. The enclosed marked plan shows the easement for
the channel and an ing_ess and egress right from Bascom Avenue
that are required from this site for flood control purposes.
We request that these rights of way be transferred to this
District. Please make arrangements with Mr. Donald Lawrie of
our Real Estate Division at extension 261.
In accordance with District Ordinance 75-6, the ow.ier should
show any existing well(s) on the plans and inform us regarding
their proposed use. Please contact Mr. Zozaya on extension 379
for information about well permits.
It would be desirable to incorporate the site's drainage int,3
an existing storm drainage system. If a storm drain outfall
into the creek is necessary, please design it to serve the
general area to minimize the number of future outfalls needed.
Please submit outfall structure details for our review and
issuance of a permit prior to advertising for construction.
Design guides for outfalls will be furnished upon request.
Storm drainage should of be designed to go over the creek bank.

Dear Mr. Kee:
As a Condition of Approval for the above named project, we are
to provide documentation that the building will be constructed
of materials that will insure that no sound exceeding 65 decibels
shall be audible on the exterior of the building". To meet that
condition we are submitting the following calculations for your
review.
Based on tests made by our acoustical consultant on a previous
project, noise levels produced by several barking dogs confined
within a building could reach 90 dBA (Edward L. Pack, Project
No. 7072). These tests were made in a local animal hospital.
Please note that the function of this clinic differs from that
of a normal pet clinic in ;,hat no animals will be boarded and due
to the cost of using the facility, only seriously ill or injured
animals will be housed in the Ward. Therefore, it is unlikely
that the sound level will ever reach the 90 dB level used in the
calculations.
1. Exterior walls are 8" thick concrete block, fullgrouted,
STC= 48. The wall will provide approximately 48 d8 y of attenuation
or 23 dB more than required to reduce animal noises to 65 d8 at
the building exterior.
2. Exterior doors are solid core wood with complete sound seals
and closers, STC= 29. The doors will provide approximately 29 dB
attenuation or 4 dB more than is required.

3• Roof consists of 2 ; 6 rafters with z" plywood sheathing under
asphalt shingles. The rafter space is filled with fiberglass
insulation. The ceiling is 3/4' acoustical tile over I' gypsum
board. The STC for the roof assembly exceeds 42 which is more
than sufficient.
4. Exhaust duct at Ward is a 16 inch diameter duct limed with
1 inch thick sound absorbant material. Noise reduction with
liner is approximately 1.05 dB per foot so that the 26 foot long
duct will provide a reduction of 27 dB which is sufficient. An
addendum will be issued deleting one 300 CFM grille and increasing
the remaining to 600 CFM so that the duct is uninterrupted for a
distance of 26 feet.

Due to manufacturing limitations, we have changed the 8 x 4 x 16
slump block on the Sruth and East walls of the above named project
to sandblasted 8 x 4 x 16 integral color, standard smooth face
block. The use of "Spectra -Glaze" on the interior face of some
block precludes the use of a slump block, but the glazed block is
a bid alternate and should it be rejected by the Owner the South
and East walls will be the previously approved slump block.
Since there way no objection to the use of 8 x 8 x 16 smooth face
block indicated on our original submittal of January 4, 1977, we
don't anticipate any problems with this change. Should you have
any objections please contact us at your earliest convenience.

Please be advised that the Planning Director has approved as minor
modifications, the twelve changes outlined on your revision list
and indicated on your re:<sed site plan and elevations.
Additionally, please be advised that your landscape plan has
been approved as indicated in red on the plans. A copy of our standard
landscape agreement has been enclosed for your convenience in the event
that you wish to use this option rather than posting a faithful per`orm-
ance bond (See condition N5).
A copy of your revised plans has been sent to the Santa � ara Valley
Water District for comment. The S.C.V.W.D. has previously indicated
that chain link fence should :e installed along the right-of-way in
accordance with the enclosed >heet 17. Any other type of fence would
have to be installed off the district right-of-way. It is the recom-
mendation of the City of Campbell that r solid board fence - identical

or sprinkler system and type of fencing to be submitted for approval
of the Planning Director at time of application for building permit.
4. Landscaping shall be maintained in accordant, with the approved
landscape plan.
5. Faithful performar.,:e bond in the amount of $3,000 to be posted to insure
landscaping, fencing, and striping of parking area within three (3) months
of completion of construction, or applicant may file written agreement
to complete landscaping, fencing and striping of parking area prior to
final building department clearance.
6. All mechanical equipment located on roofs shall be screened as approved
by the Planning Director.
7. Applicant to provide documentation that the building will be constructed
of materials which will insure that no sound exceeding 65 decibels shall
be audible on the exterior of the building.
The applicant is notified as part of this application that he is required
to meet the following conditions in accordance with Ordinances of the City
of Campbell.
A. All parking and driveway areas to be developed in compliance with Section
21.50 of the Campbell Municipal Code. All parking spaces to be provided
with appropriate concrete curbs or bumper guards.
B. Underground utilities to be provided as required by Section 20.16.070 of
the Campbell Municipal Code.
C. Plans submitted to the building department for plan check shall indicate
clearly the location of all connections for underground utilities, including
rater, sewer, electric, telephone and television cables, etc.
D. Sigr application to be submitted in accordance with provisions of the
sign ordinance for all signs. No sign to be installed until application
is epproved and permit issued by the Building Department.
E. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, wet garbage,
and rubbish produced within the limits of the City of Campbell shall be
made with Green Valley Disposal Company. This requirement applies to all
single family dwellings, multiple apartment units, to all commercial,
business, industrial, manufacturing, and construction establishments.

Code of the City of Campbell, the undersigned hereby makes zpp'ication for approval
of the attached plans.
I. The said improvements will be located o.i land described as follows:

2. The nature and purpose of the proposed improvements are:
(The applicant should attach a written statement setting forth any

Planning Ccmnission, one by the City Engineer, one by the Fire Department,
and one returned to the applicant.

6. The City of Campbell requires installation of all utilities, including
electric, telephone and television cables to be underground.
