ARCHITFCTURAL APPROVALS
S 79-17 Continued application of Mr. Steve Sundeen and
Sundeen, S. Martha's Vineyard, Inc., for approval of plans
for a restaurant to be located on property known
as 1475 S. Bascom Avenue in a C-2-S (General
Commercial) Zoning District.
Commissioner Kasolas reported that the Site and Architectural Review Committee
discussed this item at this morning's meeting, and since the applicant requested
to make a presentation to the full Commission, the Committee is recommending
that this matter be referred to the full Commission this evening. He noted
that the applicants are approximately 10 percent off on the number of parking
spaces needed; however, they feel because of the unusual circumstances (office
use during the daytime hours only) that there will not be a parking problem.
Mr. Kee gave background information on this application, noting that the
applicant has increased the size of the restaurant from 5,000 s.f. in the
original approval to the 8,800 s.f. which is the subject of this application;
additionally, the number of seats has increased from the 150 as originally
approved for the restaurant to the 265 currently being proposed for the
restaurant, lounge, and we.iting area. He noted that, in staff's opinion,
24 additional parking spaces would be required to satisfy a use of this
intensity; one of the nrimary concerns was the available parking between the
hours of 11 a.m. ind 6 p.m.

Commissioner Pack inquired if any consideration had been given to possibly
placing landscaping areas for future conversion to parking area if needed.
Mr. Kee responded that some discussion had taken place regarding a condition
such as that; another possibility discussed was to add a condition which
would read "Applicant to enter into ar agreement with the City, providing
that applicant would reduce seating capacity should, in the opinion of the
Planning Commission, a parking problem occur." Mr. Kee noted that a
condition such as that might work.
Commissioner Vierhus mentioned that another consideration discussed was
that the Traffic Engineer could make a recommendation as to the parkino
situation after a period of time to the Planning Commission, and if a
problem did exist some solution could be worked out.
Commissioner Meyer inquired if consideration had been given to the impact
of the resultant added traffic on Bascom Avenue.
Mr. Kee noted that it had been discussed only to the extent that this was
one of the worst intersections in the county and would probably get worse.
Mr. Helms noted that at the time of the original approval it was indicated
to the applicant that it might be necessary to ,ns`,11 a median barrier to
limit the ingress and egress of the development, and that might still be the
case.
Mr. Bill Long, 1999 S. Bascom Avenue, Suite 1050, appeared before the
Commission. He reported that he is one of the owners of the building
and at the present time it is approximately b5 percent leased. He
explained that the restaurant in question would accommodate mainly the
tenants of the building; there would not be a commercial center which
would attract persons not intending to eat at the re^taurant. He noted
that since the majority of the person; using the restaurant would no
doubt be tenants, who are already parked, it was felt that the added
Parking would probably not be needed.
Mr. Kenneth Rodrigues of Habitech explained the parking situation. He
also noted that this would not be a shopping center, therefore its use
(office building( would not generate as much traffic as a project such
as the Pruneyard or Factory. With this in mind, 't was fel: that the
number of parking spaces proposed would be adequate for thc• development.
Mr. O'Hearn, representing the applicant, noted that at this morning's
meetina a possible solution was discussed which was a condition to limit
the capacity of the restaurant during the hours of 11 a.m. to 1 P.M. and
5 p.m. to 6 p.m.
Much discussion ensued regarding the enforcement of such a condition.
The Commission was in consensus that this might not be the best solution.
Mr. O'Hearn also discussed the possibility of valet parking with the
Commission.

Commissioner Dickson. expressed concern about the workability of the parkino
situation; he felt that consideration should be given to putting in additional
landscaping for futurE parking.
Commissioner Kasolas inquired of Mr. Kee how the Commission or Planninq
Department might become iware of the fact if a parkinq problem should arise.
Mr. Kee noted that there auld no doubt be calls to the staff as well
as other persons (Comm,iss.on members, Council members, etc.) complaining
of a parking problem
Mr. Long noted that he would probably be one of the first persons notified
since his tenants would be first to complain of any problems that might arise.
MOTION
Commissioner Kasolas then moved that S 79-17 be approved subject to the
following conditions listed with an added condition to read "Applicant to
enter into agreement, within 15 days, that would state if the Plannino
Commission at any time in the f.:ture determines that there is a parkino
problem and upon such determination the restaurant shall revert back to
a maximum of 193 seats." The applicant at that point in time would be
free to submit a new application fully explaininq his position and hew
he could resolve his parking problems if possible at that point in time.
This motion was seconded by Commissioner Vierhus.
The applicant noted he was in agreement with this condition.
AMENDMENT TO MOTION
Commissioner Vierhus then moved to delete Condition No. 2 as listed in
the Staff Comment Sheet; seconded by Commissioner Meyer, and adopted
with Commissioner Dickson voting "no".
VOTE CN ORIGINAL MOTION
Commissioner Kasolas again stated the original notion which was seconded
by Commissioner vierhus and adopted with Commissioner Dickson voting "no".
This approval is subject to the following conditions:
1. Revised elevations to be approved by the Planning Director
upon recommendation of the Architectural Advisor.
2. Applicant to enter into agreement, within 15 days, that states
if the Planning Commission at a,.y time in the future determines
that there is a parking problem, and upon such determination
the restaurant shall revert back to a maximum of 193 seats.
The applicant is notified as part of this application that he/she
is required to meet the following conditions in accordance with
Ordinances of the City of Campbell and Laws of the State of
California.
A. All parking and driveway areas to be developed in compliance
with Section 21.50 of the Campbell Municipal Code. All parking
spaces to be provided with appropriate concrete curbs or bumper guards.
B. Underground utilities to be provided as required by Section
20.16.070 of the Campbell Municipal Code.
C. Plans submitted to the Building Department for plan check shall
indicate clearly the location of all connections for underground
utilities including water, ;ewer, electric, telephone, and
television cables, etc.
D. Sign application to be submitted in accordance with provisions
of the sign ordinance for a"l signs. No sign to be installed
until application is approved and permit issued by the Building
Department. (Section 21.68.070 of the Campbell Municipal Code.)
E. Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage,
wet garbage and rubbish produced within the limits of the City
of Campbell shall be made with Grcen Valley Disposal Company.
This requirement applies to all single-family dwellings, multipl
apartment units, to all commercial, business, industrial, manu-
facturing, and construction establishments.
F. Trash container(s) of a size and quantity necessary to serve the
development shall be located in area(s) approved by the Fire
Department. Unless otherwise noted, enclosure(s) shall consist
of a concrete floor surrounded by a solid wall or rence and have
self -closing doors of a size specified by t:—, Fire Department.
All enclosures to be constructed at grade level.
S. Applicant shall comply with all appropriate State and City
requirements for the handicapped.
FIRE DEPARTMENT
H. Obtain a Permit to Operate a Plan. of Assembly.
I. Any change to the automatic sprinkler system shall be done with
permit from the Fire Department.
J. Provide "2A-IOBC" fire extinguishers.
The applicant is notified that he/she shall comply with all applicah
Codes or Ordinances of the City of Campbell which pertain to this
development and are not herein specified.

STAFF RECOMMENDATION
That the Planning Commission approve the revised plans for a restaurant
to be located on the subject property, subject to the following
conditions:

1. The applicant provide an additional 24 parking spaces, or
2. Seating capacity of the restaurant, lounge, and waiting
areas to be a maximum of 193 seats.
' 3. If approved, subject to the attached conditions.
STAFF DISCUSSION
This application was continued from the meeting of June 19, 1979 in order
that the dppli-ant could provide the staff and Commission with information
clarifying the extent and nature of the restaurant expansion.
On June 13, 1979 the applicant submitted the attached letter outlining the
areas within the restaurant which had been expanded since the original
approval. In addition, a narking analysis for the office complex and
restaurant was submitted.
Basically, the size of the restaurant Ias been increased from the 5,000
square .feet in the original approval to the 8,800 square feet which is the
subject of this application. In addition the number of seats has increased
from the 150 as originally approved for the restaurant to the 265 currently
being proposed for the restaurant, lounge, and waiting area.
After reviewing the revised plans which were submitted on June 21, 1979,
it is apparent that approximately 2,880 grass square feet of area that was
originall approved for office use will be taken up by the restaurant. The
number of parking spaces whicn were assigned to this area is 2,880 : 200
(one space for every 200 square feet of gross floor area) = 15.
The increased number of seats in the restaurant, as proposed, is 115.
DiviAing this number by 3 (one parking space for each 3 seats) results in
the number of parking spaces required for the restaurant use, or 39 spaces.

Since 15 spaces were already provided in the original plans for office use,
the net difference is 39 - 15 = 24 spaces. It is staff's opinion that 24
additiunal parking spaces would be required to satisfy a use of this
intensity. If it is not feasible to provide the additional spaces,staff
is recommending that the seating capacity be reduced by 72 seats (24 x 3).
This would limit the maximum seating capacity to 193 seats.
Letters and additional information from the applicant, as well as the Staff
Comment Sheets of May 15 and June 19, 1979 are attached for the Coirmission's
review.

STAFF DISCUSSION
This item has been continued from the meeting of May 15 and June 5, 1979,
in order that the applicant could submit revived pans and additional
information regarding this development. Due to the fact that staff received
the new information on June 13, 1979, there has not been sufficient time for
staff to complete an adequ,,te review, prior to distribution of the agenda.
This application was submitted or. April 11, 1979. Section 21.42.030(4) of
the Zoning Code requires the Planning Commission to hear and decide all
apnlications for architectural and site approval within 60 days of the filing
of the application. For this reason, staff is recommending a continuance with
the applicant's concurrence.

STAFF DISCUSSION
On June 7, 1977, the Planning Commission approved plans to allow the
construction of a 54,000 square foot, two-story, office building on a
3.54 acre site. The floor plans for this application (S 77-26) indicated
that there would be a restaurant, with a seating capacity of 150 persons,
to serve the needs of the office tenants and their clients.
The applicant is now requesting approval of detailed plans for a restaurant
that would be a more intense use than originally approved. The new plans
indicate that there will be four- dining rooms, an oyster bar, a lounge, a
dance lounge and dance floor, a game bar, a cocktail bar and a waiting area.
The seating capacity will be 150 seats for the dining area, 100 seats for
the lounge and 15 seats in the waiting area.
Staff is of the opinion that the proposed use will to compatible with the
office use if the lounge and entertainment areas are only open in the
evenings when the offices are generally not being used.
The applicant has submitted a parking analysis which shows how the
existing 228 parking spaces could meet the needs o" both uses.
The Architectural Advisor has some concerns regarding the design of the
proposed entryway which will be discussed with the applicant at the
Architectural Review Committee meeting.

Martha's Vineyard Inc. has brought to California a traditional New
England seafuod menu and incorporated i. with the contemporary design of
modern California restaurants. This concept includes a quality but limited
menu approach which gill minimize increasing labor costs. The atmosphere
will be directed at the adult who enjoys a social but less formal dining
and bar ambiance. High ceiling, natural wood decor, plants and skylights
will add to the social setting of "he lounge. Booths, wood tables and wicker
patio seating, will add warmth and a relaxed, informal feeling to the dining
areas.
The menu of Martha's Vineyard will be of a limited nature. The reason
being, the owners feel that a restcuiant will be sure-essful if You strive for
"Quality in Simplicity." To accomplish this goal, the owners have limited
lunch and dinner menus to approximately twelvo items nlus the oyster bar.
The owners feel that they can control product quality better with less items
and at the same time control the increasing labor costs. Faster turnover is
also important to the operation and this will help to insure repeat business,
especially with the lunch trade. ML tha's will incorporate an extensive salad
bar with the dinner menu. The public will be offered a choice between a trip
to the salad bar or having one oC the waitresses prepare a fresh tossed green
salad, all included in the price of the entree.
What would a seafood restaurant be without an authentic New England
Oyster Bar? We have incorporated in the restaurant an oyster bar Lhat will
serve. appetizers to the dining room and lounge, n. well as selling seafnod for
take time. The oyster bar will Lvdeeigneda, an old fashioned walk-up oyster
bar found on the wharfs of many coastal t—ns.
All crab and lobster will be cooked fresh, in front of our customers.
The Martha's Vineyard bar will be a refreshing addition to any suburban
setting. The lounge -bar is on two levels and will comfortably seat 100 people.
With a lounge this size, we felt it necessary tc incorporate a variety of
interesting mediums. We will have a blend of live music and light dance with
the emphasis being on people as the main attraction. A backgammon bar will
accomodate fourteen couples at one tine. A large fireplace set apart from the
entertainment area will be one area fe, people who want to relax and socialize.
To compliment the atmosphere we have spent years reasearching a sound system
that will allow a clear distinct sound, yet be so balanced as not to overpower
customers who want to talk. Martha's Happy Horn: will be a perfect setting for
the businessman to corn and unwind. 1'ree hors d'oeuvres will be served daily
as well as appetizers from the oyster bar.
What we are attempting to do is provide a contemporary informal setting
that the middle income, high business density area will appreciate. We feel
that the Martha's Vineyard idea is new, different, innovative, and that it
will fit into any market. The key to our success will be as always, "Quality
in Simplicity."

Commissioner Kasolas reported that the applicant had met with the Site and
Architectural Review Committee this morning. The applicant is requesting a
continuance of the plans in order that some concerns could be resolved; however
at this time the applicant is requesting approval of a minor modification to the
entryway for security purposes. The Committee is in agreement with both requests.
Mr. Kee explained that staff is in full agreement with the requests of the
applicant.
At this time Commissicner Vierhus moved that the Planning Commission approve
the minor modification, to be approved by the Planning Director, seconded by
Commissioner Pack and unanimously adopted.
Commissioner Pack then moved that the Planning Commission continue the application
for approval of plans for S 79-17 to the July 3, 1979, Planning Commission meeting,
seconded by Commissioner Kasolas and unanimously adopted.

STAFF DISCUSSION
This item has been continued from the meeting of May 15 and June 5, 1979,
in order that the applicant could submit revised plans and additional
information regarding this development. Due to the fact that staff received
the new information on June 13, 1979, there has not been sufficient time for
staff to complete an adequate review„ prior to distribution of the agenda.
This application was submitted on April 11, 1979. Section 21.42.030(4) of
the Zoning Code requires the Planning Commission to hear and decide all
applications for architectural and site approval within 60 days of the filing
of the application. For this reason, staff is recommending a continuance with
the applicant's concurrence.

STAFF DISCUSSION
On June 7, 1977, the Planning Commission approved plans to allow the
construction of a 54,000 square foot, two-story, office building on a
3.54 acre site. The floor plans for this application (S 77-26) indicated
that there would be a restaurant, with a seating capacity of 150 persons,
to serve the needs of the office tenants and their clients.
The applicant is now requesting approval of detailed plans for a restaurant
that would be a more intense use than originally approved. The new plans
indicate that there will be four dining rooms, an oyster bar, a lounge, a
dance lounge and dance floor, a game bar, a cocktail bar and a waiting a.ea.
The seating capacity will be 150 seats for the dining area, 100 seats for
the lounge and 15 seats in the waiting area.
Staff is of the opinion that the proposed use will be compatible with the
office use if the lounge and entertainment areas are only open in the
evenings when the offices are generally not being used.
The applicant has submitted a parking analysis which shows how the
existing 228 parking spaces could meet the needs of both uses.
The Architectural Advisor has some concerns regarding the design of the
proposed entryway which will be discussed with the applicant at the
Architectural Review Committee meeting.

S 79-17 Application of Mr. Steve Sundeen and Martha's
Sundeen, S. Vineyard Inc. for approval of plans for a
restaurant to be located on property known as
1475 S. Bascom Avenue in a C-2-S (General
Commercial) Zoning District.
STAFF RECOMMENDATION
Approval, subject to the attached conditions.
STAFF DISCUSSION
On June 7, 1977, the Planning Commission approved plans to allow the
construction of a 54,000 square foot, two-story, office building on a
3.54 acre site. The floor plans for this application (S 77-26) indicated
that there would be a restaurant, with a seating capacity of 150 persons,
to serve the needs of the office tenants and their clients.
The applicant is now requesting approval of detailed plans for a restaurant
that would be a more intense use than originally approved. The new plans
indicate that there will be four dining rooms, an oyster bar, a lounge, a
dance lounge and dance floor, a game bar, a cocktail bar and a waiting area.
The seating capacity will be 150 seats for the dining area, 100 seats for
the lounge and 15 seats in the waiting area.
Staff is of the opinion that the proposed use will be compatible with the
office use if the lounge and entertainment areas are only open in the
evenings when the offices are generally not being used.
The applicant has submitted a parking analysis which shows how the
existing 228 parking spaces could meet the needs of both uses.
The Architectural Advisor has some concerns regarding the design of the
proposed entryway which will be discussed with the applicant at the
Architectural Review Committee meeting.

with Section 21.50 of the Campbell Municipal Code. All

The nature of our business will be an Eastern seafood
restaurant and cocktail lounge. The theme of the restaurant
will be Ne�j England, i. e. a'ithentic New England street
lighting, brick walkways, skylights, exposed structure,
fish market, and terrace vineyard dining overlooking the
office mall with its interior waterscape.

Commercial restaurant, which will be neighborhood, city and
regionally oriented of approximately 8847 SF. The City of
Campbell does not, at this time, have an Eastern seafood
restaurant with a fish market, salad bar and cocktail lounge
of this caliber and will be a positive addition to this
area.

The site conditions were reviewed in June of 1978 at the time
the office building, "Creekside Business Mall" was submitted.
The restaurant is a tenant improvement and will not change
any of these site conditions. The office building is
approximately 75% complete.

The site conditions directly adjacent to the project are as
follows: bounded north and west, Santa Clara Water District
Channel. South, Flaggs Restaurant and Delta Queen Car Wash.
East, Bascom Avenue. Across Bascom Avenue is a large
undeveloped parcel and an apartment house development.
Across the channel is a residential development.

Code of the City of Campbell, the undersigned hereby makes application for approval
of the attached plans.

Avenue in the City of Campbell, said county of Santa Clara, bounded on the North-
west by the Southeasterly boundary line of the Railroad right of way of Southern
Pacific Railroad Company traversing said Section 26, and bounded on the West by
the Easterly boundary line of that certain 1.037 acre parcel of land described in
the Deed from Mervyn S. Keesling and others to J. W. Hylton and others, dated
June 25, 1957 and recorded in the office of the County Recorder of said County of
Santa Clara in Book 3846 of Official Records at page 22;
Save and excepting therefrom (A) that portion thereof conveyed by Nicholas
Suzzallo and others to George A. Burum by Deed dated April 6, 1923 and recorded
