At its meeting of February 19, 1985, the Site and
Architectural Review
Committee conditionally approved the lighting of
the parking area for this
office. This approval was subject to a six month
review of the lighting
by the Site and Architectural Review Committee.
The Committee at that
time had expressed a concern regarding the height
of the light standards.
The project has been completed for six months at
this time, consequently a
review of this matter is before the Committee. Staff
has not received any
complaints regarding, the glare from this lighting
and is consequently
recommending its approval.

STAFF DISCUSSION
This item was continued from the Planning Commission meeting of February
25, 1986, so that the applicant could present an illustrative example of a
color blue/green band on this office building. This example will be
painted on April 4, 1986 so that it may be reviewed by the Site and
Architectural Review Committee.
Staff is recommending that the Planning Commission consider the
recommendation of the Site and ARchitectural Review Committee and make a
decision regarding the accent treatment on this office building.

STAFF DISCUSSION
At its meeting of January 8, 1985the 'n ing Commission approved the
elevations of the three story office b.i. •g located on the subject
property. The approved elevations indicated the use of a granite veneer
material as an horizontal accent band or, the building facade. The glass
fiber reinforced concrete panels which were shown for wall materials were
also accented by minor steps in the panels.
The developer, subsequently, has chosen to modify this wall treatment as
described in the attached letter.
The Architectural Advisor and Staff have reviewed the requested
elimination of the color horizontal bands and the replacement of these
bands by a vertical rib pattern. It is Staff's recommendation that a
color band provides a more effective relief to the massiveness of bullding, consequently, Staff is recommending this
that the proposed

architectural design for the facade, with the interplay
of the green glass and the white GFRC panels. This
provides an interesting contrast of color and textures
pleasing to the eye without having the addition of the

At its previous meeting of January 8, 1985, the Site and Architectural
Review Committee continued the consideration of these plans so that the
items discussed on the attached memorandum could be addressed.
The applicant has submitted revised plans which address the concerns
regarding the landscaping and irrigation plans. Consequently, Staff
is recommending approval of these plans.
As of this writing Staff has not received plans addressing concerns
for the fencing and lighting plan.
ITEM REFERRED BY THE PLANNING COMMISSION

height of the parking structure and the screening of the trash enclosure

STAFF RECOMMENDATION
That the Site and Architectural Review Committee continue consideration
of these plans so that the items discussed below may he addressed.
STAFF DISCUSSION
At its meeting of August 28, 1984 the Planning Commission approved the
,replication of Mr. Burch Boone for a three-story office building on the
referenced property. Conditions 3 and 4 of the approval required the
applicant to submit the following plans for the Site Committee's approval:
1. Landscaping Plan.
2. Irrigation Plan.
3. Fencing Plan, and
4. Lighting Plan.
Landscaping Plan
The submitted landscaping plan provides detail of pavement treatment throughout
the project as well as landscaping materials. Staff finds the submitted plans
generally acceptable, however, would recommend that the following items be
addressed with revisions to the presented landscaping plan:
1. Increase the amount of lawn areas along the Michael Drive
frontage to give project a more residential appearance.
2. Distribute planting areas within parking garage more evenly.
3. Provide additional bollards at easterly end of emergency
access road.
4. Provide some variety of shrub heights adjacent to
handicapped parking spaces.
5. Provide detail of raised planter area along north side of
the office building.
6. Clarify screening of utility transformer at south elevation
of building.

from Bascom Ave. frontage, and
8. Provide planting materials on building balconies.
Irrigation Plans
The irrigation plans are considered generally acceptable. The proposed
system should incorporate street trees and the planting strip along the
Michael Drive frontage.
Fencing Plan
The submitted fencing plan indicates the provision of a 7' block wall
adjacent to the existing residential uses. The submitted plan, however,
does not pprovide any detail of this fencing. Further details should
provide th.a fol'.owing information:
1. Detail of fencing material and color.
2. How the proposed fence will be stepped down nearing the street
frontages.
Lighting Plan
The submitted lighting plan indicates the provision of lighting for the
driveway along the northerly side of the building and for the garage
structure. The parking garage lighting is provided by 20' twin headed poles
on the second level of the garage and 8' lighting fixtures within the garage.
Staff cannot determine from the submitted plan if this lighting will
adversely affect the adjact,it residential properties. To address this
concern, Staff is recommending that a lighting diagram be provided
which illustrates the light distribution from these fixtures.

Zoning District.
Commissioner Howard reported that this item was before the Site and
Architectural Review Committee. The revised parking layout indicates
a ratio of 1:250 with the correct back-up distances provided. The
details of the parking structure have been completed and address the
grade -line con"rns.
Mr. Kee noted, at this point, that Staff is of the opinion that some
measurements of the grades are still needed.
Commissioner Howard continued that the details of the loading and
trash enclosure will be coming back to the Site Committee, along with
a lighting scheme. Samples of colors and buildings materials have
not yet been presented. And, the paving materials have been
addressed. Therefore, the Site Committee is recommending approval.
There was brief discussion regarding grade measurements. Mr. Kee
commented that presented plans were not clear, in Staff's opinion,
which results in the recommendation for the submittal of cross
sections demonstrating a reduced height in the parking garage, as
specified in the Staff Report.
Chairman Fairbanks asked if the plans, as presented this evening,
address Staff's concerns totally.
Mr. Kee stated that Staff would still want the distances clarified.
Staff would like to be able to check these distances once
constructed, to see that what has been represented to the Commission
is what is being constructed in the field.

STRFF_DISCUSSION
At its meeting of August 28, 1984 the Planning Commission adopted
Resolution No. 2288 approving the application of Mr. Burch Boone, on
behalf of Lincoln Property Co., for approval of a three-story office
building and a related parking structure on the project site.
Condition 1 of that approval required the applicant to submit revised
plans and elevations addressing the following concerns-
-Revised parking layout which indicates the required back-up
distance.
-Details of parking structure, including a barrier surrounding
it, high enough to block headlights from shining on adjacent
properties.
-Details of loading, trash enclosure, and plaza areas.
-Samples of the color and buiding materials.
-p plan, indicating paving materiais for the project and turf
block for she fire lane along the south property line.
The applicant has su,3sequently submitted plans so that these concerns
could be addressed.
The submitted plans indicate the provision of 481 parking spaces in
the proposed parking garages+. The proposed parking results in a
parking ratio of 1:250 for the gross square footage of office use.
Additionally, the provided parking provides the required back-up
distance for a parking space.
The plans additionally include details of the parking garage which
wars not previously indicated. The plans indicate the construction
of a two -level parking structure with the second level being

approximately 518" to 714" above finished grade. A solid concrete
railing of 316" is proposed along the perimeter of the parking
structure, consequently, the height of the parking structure is 992"
to 10•10" above finished grade. Staff expresses a concern regarding
the height of this structure in that it was previously shown as 7.6"
above grade.
Staff is recommending that the applicant provide cross sections
details between the garage and neighboring residential properties and
also between the garage and Michael Drive se that the previously
approved height is illustrated.
The revised plans have provided further details for the loading and
trash enclosure area for this project. Additionallys details have
been provided for the interior courtyard area and the paving
material- throughout the project. These details address the
informat.on previously requested by Staff.
Staff is recommending approval of these plans subject to the revision
in the garage design so that a 7.51 maximum height is p•�ovided.

STAFF DISCUSSION
At its meeting of August 28, 1984 the Planning Commission approved the
application of Mr. Burch Boone for a three-story office building on the
referenced property. Conditions 3 and 4 of the approval required the
applicant to submit the following plans for the Site Comr.ittee's approval:
1. Landscaping Plan.
2. Irrigation Plan.
3, Fencing Plan, and
4. Lighting Plan.
Landscaping Plan
The submitted landscaping plan provides detail of pavtment treatment throughout
the project as well as landscaping materials. Staff finds the submitted plans
generally acceptable, however, would recommend that the following items be
addressed with revisions to the presented landscaping plan:
1. Increase the amount of lawn areas along the Michael Drive
frontage to give project a more residential appearance.
2. Distribute plcnting areas within parking garage more evenly.
3. Provide additional bollards at easterly end of emergency
access road.
4. Provide some variety of shrub heights adjacent to
handicapped parking spaces.
5. Provide detail of raised planter area along north sire of
the office building.
6. Clarify screening of utility transformer at south elevation
of building.

7. Consider the use alternative pavement materials for entrance
from Lascom Ave. frontage, and
8. Provide planting materials on building balconies.
Irrigation Plans
The irrigation plans are considered generally acceptable. The proposed
system should incorporate street trees and the planting strip along the
A1ichael Drive frontage.
Fencing Plan
The submitted fencing plan indicates the provision of a 7' block wall
adjacent to the existing residential uses. The submitted pian, however,
does not provide any detail of this fencing. Further details should
provide the following information:
1. Detail of fencing material and color.
2. How the proposed fence will be stepped down nearing the street
frontages.
Lighting Plan
The sebautted lighting plan indicates the provision of lighting for the
driveway 4long the northerly side of the building and for the garage
structure. The parking garage lighting is provided by 20' twin headed poles
on the second level �f the garage and 8' lighting fixtures within the garage.
Staff cannot determine from the submitted plan if this lighting will
adversely affect the adjacent residential properties. To address this
concern, Staff is recommending that alighting diagram be provided
which illustrates the light distribution from these fixtures.

After notificati^n and public hearing as specified by law on the
application of Mr. Burch Boone, on behalf of Lincoln Property Co., for
a Use Permit and approval of plans and elevations to allow the construc-
tion of a 3-story office building on property known as 210S S. Bascom
Av -iue in a C-2-S (General Commercial) and R-3-S ftltiple Family !tesi-
dential) Zoning District, as per application filed in the Planninf;
Department on April 9, 1"84, and after presentation by the Planning
Director, proponents and opponents, the hearing was closed. UP 34-08/
S 84-11.
After due consideration of all evidence presented, the Commission
did find as follows:
That the est,blishment, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort, or general welfare of persons re-
siding or working in the neighborhood of such use, or be
detrimental or injurious to the property and improvements
in the neighborhood or the general welfare of the C`-ty.
Based on the above findings, the Planning Commission does hereby
grant the requested use permit, subject to the conditions attached here-
to as Exhibit A.
The applicant is notified as part of this application that he is
required to comply with all applicable Codes and/or Ordinances of the

That. the Planning Commission approve the plans and elevations, subject to
the attached conditions.
STAFF DISCUSSION
At its meeting of July 10, 1984 the Planning Co mission considered plans
for a 4-story, 140,000 sq.ft. office building on this site. A motion to
approve the project failed on a 3-3-1 vote, with Commissioners Fairbanks,
Christ, and Dickson voting "no", and Commissioner Howard being absent.
The Commission then took action to refer this item to the City Council.
The Council continued the ite at its meeting of July 17, 1984, and
prior to the August 21, 1984 meeting, tie applicant submitted revised
plans indicating a 3-story office building, and a reduction in the square
footage to 122,383 sq.ft. At its meeting of August 21, 1984 the Council
granted conceptual approval of the proj—t with a referral to the Planning
Commission for site and architectural approval. Below is a description of
the revised proposal.
The applicant is proposing to construct a 3-story, 122,383 sq.ft. office
building. The elevations and site layout are almost the same as the
previous 4-story proposal. The building is setback 25' from Bascom Ave.
The parking structure to the rear of the building maintains a 15' setback
from Michael Drive and a 20' setback from the adjacent residential develop-
ment to the north. The parking str. tore will be of concrete construction
with the first level depressed s -)roximately 4'.. and the second level
approximately 4' above grade. Staff is recommending a solid barrier
around the structure to block headlights shining onto adjacent properties.
Staff is of the opinion that the proposed parking structure should have
minimal impact on adjacent properties if proper landscaping bdiffers are
provided and specific attention is provided regarding parking area light-
ing and screening. These concerns are addressed in the conditions of
approval.
The proposed building is of contemporary design. Building materials are
shown ns an off-white concrete wall with a sandblasted finish and a blue/
green reflective glass for glazing treatment. The windows are accented
with dark green aluminum mullion and a dark red accent stripe.

Access to the project has been indicated solely from the Bascom Avenue frontage.
A driveway to the north and south of the building provides access to the rear
of the property. Staff is of the opinion that the sole access onto Bascom
Avenue is necessary to preserve the residential character of Michael Drive.
The applicant has provided two alternative parking layouts. One provides
491 parking spaces (48% compact) resulting in a parking ratio of 1:250.
The second provides 544 parking spaces (57% compact) resulting in a parking
ratio of 1:225. The 1:250 layout also provides 7 openings between the 2
parking levels for the planting of trees. As previously recommended, Staff
is of the opinion that the 1:250 ratio would provide adequate parking for a
development of this size. This ratio would be consistent with previous
Commission approvals of larger projects.
The Architectural Advisor is of the opinion that the building design is of
high quality. He would like to see samples of the building materials and
colors and paving materials. Staff recommends carrying out the front balcony
corner elements around to the side of the Building and to the west elevations.
Sta.',' has the following additional concern regarding the project, which
should be addressed in revised plans:
1. The back-up distance for some of the parking spaces do not
meet code. This concern can be addressed in revised plans.
The Public Works Department traffic mitigation measures are listed in the
Conditions of Approval under "Public Works".

E Ordinance No. 782 of the Campbell Municipal Code stipulates that
any contract for the collection and disposal of refuse, garbage,
wet garbage and rubbish produced within the limits of the City of
Campbell shall be made with Green Valley Disposal Company. This
requirement applies to all single-family dwellings, multiple apart-
ment units, to all commercial, business, industrial, manufacturing,
and construction establishments.

development shall be located in area(s) approved by the Fire De-

STAFF DISCUSSION
This item was continued from the meeting of July 17, 1984 in order that
residents in the area could he notified that this application was being
considered by the City council. In addition, the continuance was also
to allow the applicant the opportunity to consider some of the issues
and concerns that had been raised regarding the project.
On August 10, 1984 Staff received revised plans indicating a 3-story building
with a gross floor area of 122,383 sq.ft. The original submittal proposed a
4-story building having a gross floor area of 140,000 sq.ft.
Since the Planning Commission and Staff have not had an opportunity to review
these plans. Staff is recommending that they be referred back to the Planning
Commission and Staff for Site and Architectural review. Staff is also re-
commending that the revisions be re-a.gendized for consideration by the C-ty
Ccxmcil at the earliest possible date.
Another alternative, as recommended in 2a., would provide the Council the
opportunity to indicate conditions it would find acceptable for this project,
and to have those concerns addressed by the Pinning Commission n its review
of the revised plans. Typically, Site and Architectural applications or Use
Permit applications are not referred to the Council for acti however,
because of the sensitivity of this project, it was the reques i the Planning
Commission, Staff, and the applicant that it be referred to "�e Council. If
it is the Coumcil's desire, once the concerns are known and :onditi.ois express-
ed, the Planning Commission has the authority to take action on this project
without it being referred back to the Council.

W. Bee stated that this item was continued from the
meeting of July 17, 1984 in order that residents in
the area could be notified that this application was
being considered by the City Council, and to allow the
applicant to address some of the issues and ooncerns
that had been raised regarding the project.
Engineering Manager Relms addressed some of the
questions raised regarding mitigating measures.
Acting City Attorney Duckworth advised the Council that
it is possible for the City Council to mandate a certain
amount of money to be set aside to mitigate what is
perceived to be traffic problems with the development of
this project. City Attorney Duckworth advised further
that the only caveat in doing so is that these funds are
to be used specifically to mitigate traffic problem

City Manager Schilling stated that this would be
a significant change from existing policy. Mr.
Schilling stated that if tije Council wished to retain
some flexibility in how these funds might be spent in

be his recommendation that the developer initially
be requir d tc pay for the improvements that have been
identified ane. that a caveat be put in so that if the
City identified another improvement which, in its
opinion, will be of equal benefit to the project to

contribute an amount no greater than the amount that

Village Haneowners Association, and expressed cnncerns
regarding thi=_: project, citing traffic as a major Problem.
John Figuer-)a, 52 Michael Drive, Campbell appeared before
the Council and spoke against the project. Mr. Figueroa
stated that the parking structure does not conform to
City ordinance and is not a p.-mi,3sible use.
City Attorney Duckworth advised that the parking structure
1s a related, permissible use and does coufonm to City
ordinance.
Burch Boone, applicant on behalf of Lincoln Property
Company, appeared before th. Council to answer any
questions.
A representative of Antbony Gu=ardo & Associates, Inc.,
Architects, 836 Montgomery Street, San Francisco, appeared
before the Council and spoke regarding the proposed
landscape plan and parking structure .
Discussion followed regarding the applicant's need to
have a decision on this project by August 31st. Ls. &,one
indicated his concern that, if referred to the Planning
Camnission, the vote might end in a tie.

Vice May-)r Ashworth expressed his concerns that this item
was referred from the Planning Commission without adequate
public hearing notice.
City Attorney Dempster advised that this item did not
require a public hearing, and was referred to the Cite
Council because of the 3-3 Planning Commission vote.
Mayor Doetsch asxed if anyone :.n the audience wished to
be heard on the application of Lincoln Property Company,
UP 84-08, S 84-11.
Burch Boone, Lincoln Property Company, 101 Lincoln
Centre Drive, Foster City, appeared before the Council
and spoke in favor of the development. Mr. Boone stated
tnat he has been working with staff for over three and
one-half months and has attempted to address all issues
regarding traffic and mitigating .neasures.
John Wilson, traffic consultant representing Wilson -
Porter Engineering, San Francisco, appeared before the
Council and addressed the issue of mitigating measures.
Mr. Wilson stated that the intersections of Bascom and
Campbell Avenues, Bascom and Hamilton Avenues, and the
Highway 17 southbound off -ramp at Salmar Avenue were
studied and the mitigating measures were developed as
a result.
Following discussion, Engineering Manager Helms appeared
before the Council and explained how the mitigating
measures would impact the traffic.

Gary Black, Bartcn-Aschman Associates, 99 Almaden
Boulevard, San Jose, appeared before the Council and
spoke regarding the request for the parking variance.
Burch Boone, Lincoln Property Company, presented 6
letters and a petition containing 42 signatures of
surrounding businesses and property owners in support
of the project.
Garnetta J. Annable, 951 Dry Creek Road, Campbeli,
appeared before the Council on behalf of herself and
the Cambrian Village Homeowners Association, and spoke
against the project citing traffic, and storm drain
problems.
Pat Figueroa, 52 Michael Drive, Campbell., appeared before
the Council and spoke against the variance because of
the impact to the neighborhood and adjacent residents.
Mrs. Figueroa requested that a 7 ft. fence be added as
a condition of approval if the Council were to approve
the variance.
David Oswald, owner of property located at West Valley
Drive and Union Avenue, appeared before the Council and
spoke in favor of the project.
Sam Magnano, 1824 Kirkmont Drive, San Jose, appeared
before the Council and spoke in favor of the project.
Ray Clark, 325 April Way, Campbell, appeared before
the Council and spoke against the project stating that
this project was too large for this piece of property.
Warren Banet, 916 Apricot, Campbell, appeared oefore
the Cow,cil and expressed concerns regarding the
traffic impact on Apricot Avenue.
Russell Levitt- Earthmetrics, 659 Cowan Road, Burlingame,
appeared before the Council and spoke regarding the
traffic impact this project would have.
Joseph Gemma, 2160 S. Bascom Avenue, Campbell, appeared
before the Council a.id spoke in favor of the project.
Wayne Mitsunaga, 1518 Via Carcion, San Jose, appeared
before the Council and expressed concerns regarding
the project stating that the project was too large
for this particular site.
Andre Walewski, 125 B Redding Road, Campbell, appeared
before the Council and spoke in favor of the project.
Mayor Doetsch expresse' his concerns regarding the
impact this project would have on Bascom Avenue, which
is already heavily congested.

Engineering Manager Helms responded to discussion
pertaining to tr.ffic movements or. Bascom Avenue.
Mr. Helms stated that the two-way left hand turn
lane on Bascom Avenue should be adequate; however,
staff will monitor the tuning movements and if it
appears to be a problem, -he applicant wa.uld be
req.,ired to construct measuzis to restrict the
turning movements.
Councilman Kutowski pointed out that the Council sho.:ld
define exactly what "high rise" for the City of
Campbell is.
Burch Boone, applicant, stated that the property is
under a contract which expires at the end of July so
he would like a decision by that time. Mr. Boone
requested the Council to call a special meeting between
now and the end L` July; however, if that would be
impossible, Mr. bone indicated he would be willing to
wait until August when a full Council would be present.
Following discussion, it was determined that a full
Council would not be present until the August 21, 1984
City Council Meeting, and Mr. Boone indicated his approval
of this date.

DISCUSSION
The applicant is proposing the construction of a 4-story office building of
approximately 14 0, 000 sq.ft., and a related two -level parking structure which
would accommodate 553 parking spaces.
The project site is currently used as a trailer sales business which would be
removed with the development of this proposal. A converted residential build-
ing which is listed on Campbell's survey of potentially historic buildings would
also be removed. Removal of this building was reviewed by the Historic Preserva-
tion Board at its meeting of June 27, 1984.
The site combines 3 parcels of land with an approximate square footage of 184,000
sq.ft. The front portion of the project, having frontage along Bascom Avenue is
zoned C-2-S (General Commercial) and has a depth of approximately 240 ft. The
remainder of the project, to the Michael Drive frontage, is zoned R-3-S (Multiple
Family Residential).
The applicant is requesting approval of a Use Permit to allow the :onstrLr_.iot
of parking facilities on the residentially zoned portion of the project site.
The proposed parkimp, structure maintains a 15' setback from Michael Drive, and
a 20' setback frme adjacent residential developments along the sides of the
project. The structure will be of a concrete construction, with the first level
depressed (below grade) approximately 4' and the second level approximately 4'
above grade. The protective railings and barriers will be approximately 7'
above grade.
Staff is of the opinion that the proposed parking structure should have minimal
impact on adjacent properties if proper landscaping buffers are provided and
specific attention is provided regarding parking area lighting and screening.
These concerns are addressed in the conditions of approval.
The proposed office building is a 4-story structure with a contemporary design.
Building materials are shown as off-white concrete with a sand -blasted finish,
and a blue/green reflective glass Fir glazing treatment. Windows are accented
with dark green aluminum mullions and an accent strip of dark red.

The Bascom Avenue and parking structure elevations have proposed balconies
which provide relief to the building facade. The entrance to the office
building is at the northwest corner of the structure near the parking faci-
lities.
Access to the project has been proposed solely from time Bascom Avenue
frontage. 1Vxn driveways to the north and south of the office building
provide accessibility to the rear parking area. Staff is of the opinion
that access restricted to the Bascom Avenue frontage is necessary to
preserve the residential character of Michael Drive. Staff does express
a concern that the pedestrian circulation on -site be studied further, in
that vehicle and pedestrian circulation are not well separated at this
time.
The applicant has provided 560 parking spaces (330 standard, 222 compact,
8 handicapped) for this project, resulting in a parking ratio of 1:250.
Chapter 21.50 of the Zoning Ordinance indicates that parking should be
provided at a ratio of 1:225 for office uses. The Planning Commission,
however, may approve lesser parking when the applicant has demonstrated
that less parking is warranted. Staff is of the opinion that due to the
scale of the proposed project the requested parking ratio is acceptable.
Approval of a parking ratio of 1:250 would be consistent with previoiu
Planning Commission approvals of larger projects.
The Architectural Advisor is of the opinion that the building design is
well done. He does suggest that further study be done of the accent
treatment and the way the bands meet the glass.
Staff is of the opinion that the project is conceptually acceptable and
is recomnendi,ig its approval subject to the submittal of revised plans
fot the approval of the Planning Commission. Revised plans should
address the following concerns:
1. Details of parking structure, loading and trash enclosure
area, and plaza area.
2. Further study of the proposed accent bands on the building.
3. Better separation and clarification of pedestrian circulation
on site.
4. Provision of more landscaping along the southern portion of
the parking stricture.
At its meeting of Tuly 10, 1984 the Planning Grmission heard testimony
regarding the presented Taft Environmental Impact Report for this pro-
ject, and took action to certify the EIR as complete (vote: 4-2-1, with
Commissioners Fairbanks and Dickson voting "no", and Commissioner Howard
being absent).
After public hearing regarding the Conditional Use Permit and the Site
and Architectural application for this proposed development, the Planning,
Commission motion to approve the project failed on a 3-3-1 vote, with
Commissioners Fairbanks, Christ and Dickson voting "no, and Ca!missioner
Howard being absent.

After closing of the public hearing on the above -referenced project,
the Commission requested the following comments to be forwarded to
the City Council:
Chairman Dickson noted his concerns regarding the requested variance
for parking; he felt the building footprint was out of line for this
area and that the structure is out of place being a 4-story. He
felt the building should be less imposing.
Commissioner Fairbanks noted that she found the building and the
plans most attractive; however, for this site and this City she
felt the project was way too dense. She felt that the parking
use was not compatible with the residential area, and is adverse
to removing residentially zoned property from the rosters to
become a parking structure.
Commissioner Christ noted his opposition to the project. He
felt that the project Eras too large, and that future develop-
ments are going to have to be scaled down in order to consider
the emulative effect. He added that he would like to see this
particular property developed; however, this project was too
large for this area.
Commissioner Campos stated that he was in favor of the project.
The current use has been deteriorating, and the area is in need
of significant improvement. The building is very attractive and
will provide jobs for people in the area. He felt the project
was aesthetically pleasing and would significantly improve this
area. Regarding the parking, Commissioner Campos noted that
the presented analyses support the ratio.
Commissioner Perrine spoke in favor of the project, stating that
he was impressed with the mitigating measures conditioned by the
Public Works Staff. He noted that he would like 'a see an 8'
concrete wall and a review of the parking situate. n within one
year of occupancy.
Commissioner Kasolas notes that there was a philosophical issue
present regarding the size of this project. He felt that the
Commission should consider that the traffic iF with us, and
there is net much that can be done about it. The position the
City has taken is mitigation at the expense of the developers.
fie spoke regarding the jobs that will be created by this project,
noting that more and more people are trying to work closer to
home --which would reduce the traffic problems. The traffic
congestion is one of the reasons why businesses are trying to
move to this end of the valley.

UP 84-08 Public hearing to consider the application of Mr.
S 84-11 Burch Boone, on behalf of Lincoln Property Co.,
Lincoln Property for approval of plans and elevations to allow the
constriction of a 4-story office building on pro-
perty known as 2105 S. Bascom Ave., in a C-2-S
(General Commercial) and R-3-S (Multiple Family
Residential) Zoning District.
Commissioner Perrine reported that this item was before the Site and Archi-
tectural Review Committee. One concern addressed was the emergency access
on Michael Orive. The plan indicates a concrete block pathway with grass
which would allow the Fire Department access if necessary. The Architectural
Advisor expressed a concern with the building facade detail. In general,
the Committee liked what they saw, and is recommending approval subject to
the detailed plans coming back to the Commission within 30 days for final
approval.
W. Stafford further reviewed the project for the Commission, stating that
Staff is recommending approval, subject to attached conditions, and that
the Planning Commission forward this application to tht City Council for
its review.
Mr. Helms reviewed Condi*ions H-N, noting that there is an impact at the
Hamilton/Salmar intersection and Staff is of the opinion that an appropriate
mitigation measure is the addition of one lane which would allow an exclusive
thru-lane down Salmar.
In response to a question from Commissioner Fairbanks regarding the historic
significance of the existing structure on -site, Mr. Stafford indicated that
the structure has been reviewed by the Historic Preservation Board who
found no historic significance.
Chairman Dickson opened the public hearing and invited anyone in the audience
to speak for or against this item.
Mrs. Annable, 951 Dry Creek Rd., stated that she would like to see an office
building on this site; however, she has a problem with the parking variance.
Additionally, she spoke in favor of a reduction in the size of the building,
perhaps making it 3 stories; and, she expressed concerns regarding traffic
circulation, noting that access to Michael Drive would improve circulation
and keep traffic off Apricot Avenue.
Mr. Burch Roane, applicant, presented an aerial photo and slides of the site.

Mr. Dan Ortiz, Architect, reviewed t,, oroject for the Commission, noting
the project will be approximately 140,000 sq.ft. with 136,000 sq.ft. in
adjusted gross floor area; and, with 574 parking spaces provided, which
will bring the parking ratio down to 1:237. btr. Ortiz also reviewed the
plans for the parking structure.
Mr. Paul Lettieri, Landscape Architect, reviewed the landscape plans for
the project, noting that there will be a large amount of Screening around
the project to protect the residential area. The interior atrium will be
provided with a tropical type of plantings; ther, will be several types of
flowering trees; the concrete -block emergency access path with be covered
with turf -cloth; the two large palm trees, as well as existing pines, will
be retained; and a row of redwood trees are proposed along the resiaential
property line.
btr. Gary Black, Barton-Asc man Associates, spoke regarding the parking
ratios provided, indicating that surveys taken by their company show that
the provided parking is adequate for this development; and, they would
recommend a compact ratio of 60%.
btr. Boone presented a table representing parking ratios. He noted that
the developer is not asking the Commission to allow maximum usage on this
site, but rather to consider the parking ratio of 1:250. Mr. Boone pre-
sented information to correlate this parking ratio.
Mr. Marvin Wiks, Metro Parking, San Francisco, spoke on methodology for
down -scaling parking spaces to facilitate more compact cars and improving
efficiency.
btr. Hal Clarke, 168 Michael Dr., stated that when he purchased his property
this site was indicated by the City for residential use. There ;s a 6'
fence indicated; however, the p rking structure will be above -grade, which
does not provide privacy for his property. Mr. Clarke contiraed that the
emergency lane will create traffic problems across Michael Prive. He
asked what would buffer Michael Drive firm this property, lnd what would
stop employees from this project from parking on Michael Drive.
Mr. John Figueroa, property owner of 52 Michael Drive, stated that he was
completely opposed to granting of a variance which would allow residentially
zoned property to be used for parking; he cited sa;ety of residents in the
area; housing impact; privacy of his tenants; security of the office building;
undesirable uses of the parkin!+ structure when office not in use; noise;
air pollution; and lack of satisfactory setba_ks.
btr. Figueroa asked that if the project is anproved, the following conditions
be imposed: grade level to stay the same• where it borders the Prvneyard
Apartments; 8' fence be installed alon; interior perimeter of the project;
parking lot be closed at night; night patrolling to restrict pedestrian
traffic; closed circuit monitoring of parking area.
Mr. Stafford noted, for the Commission's information, that parking is an
allowable use in an R-3 zone under the -Zoning Ordinance.
Mr. Boone stated that the developer could respond to Mr. Figuero's concerns
and enuld be willing to work with him to resolve any problems.

Commissioner Perrin pointed out that the plans indicate a solid wall on
the second floor of the parking stricture so that headlights will not
penetrate to the residential area.
Mr. Wayne Mi.sunaga stated that this was another high density proposal,
he did not feel the traffic has been properly mitigated. ,he sewage
problems are not discussed, the visual impact is not discussed, and
he felt the project should be down -sized.
Mr. Joseph Gemma, 2160 S. Bascom Ave., spoke in favor of the project.
He felt that the project was beautiful, that the property was zoned for
commercial and should be used as such, that Bascom Avenue can handle the
traffic, and that the City could use such a nice development.
WS: Campos, Perrine - That the public hearing on UP 84-08 be closed.
Motion carried unanimously.
M/S: Campos, Kasolas - That the Plann_ng Commission adopt a resolution
approving UP 84-08, subject to conditions listed
in the Staff Comment Sheet.
Discussion
Chairman Dickson stated his concern with the variance for parking; and,the
size of the building footprint for this area. He felt that a 4-story
structure would be out of place in this location.
Commission: Fairbanks stated that she found the building and the plans
most attractive; however, for this place and this City, she felt it was
too dense. She stated that s:.e did not find the parking compatible with
a residential area, and would be adverse to taking residential property
off the General Plan to become a parking structure.
Commissioner Christ stated that he is opposed to the project, in that
he felt it was too large. He added that he would like to see this pro-
perty developed, but with a smaller scaled building.
Commissioner Campos stated that he is in favor of the project. Baker Trailer
Sales has been d?teriorating very badly, and this area is in need of signifi-
cant improvement. This project is very attractive and will provide jobs for
people in the area, as well as being a significant improvement for the area.
With regard to the parking ratio, he felt that sufficient information has
been presented by consultaets to indicate that the ratio will work.
Commissioner Perrine spoke in favor of the project, stating that he is very
impressed with the list the Public Wbrks Department has drawn up as miti-
gating measures. He noted that he would like to add an 8' concrete fence
and a review of the larking situation within one year of completion of the
project.
Commissioner Kasolas spoke in favor of the project, noting that there is
not much that can be done about the traffic gcing through the City. What
Staff is trying to do is mitigate the impacts at the developers expense.
He continued that more jobs in the City will allow residents to work
closer to home, thereby reducing traffic problems.

STAFF DISCUSSION
The applicant is proposing the construction of a four story office building
of approximately 140,000 sm are feet and a related two -level parking structure
which would accomodate SE'l _.g spaces.
The project site currentl; ' used as a trailer sales business which would be
removed with the developnxn� ;f this proposal. A converted residential building
which is listed on Campbell':: survey of potentially historic buildings would
also be removed. Removal of this building was reviewed by the Historic Pre-
servation Board at its meeting of June 27, 1984.
The site combines three parcels of land with an approximate square footage of
184,000 sq. ft. The front portion of the project having frontage along
Bascom Ave. in zoned C-2-S (General Commercial) and has a depth of approximately
240 feet. The remainder of the project to the Michael Dr. frontage is zoned
R-3-S (Multiple Family Residential).
The applicant is requesting approval of a use permit to allow the construction
of parking facilities as a transitional use on the residentially zoned portion
of the project site. The proposed parking structure maintains a 15' setback
from Michael Drive and a 20' setback from adjacent residential developments
along the sides of the project. The structure will be of a concrete construc-
tion with the first level depressed approximately 4 feet and the second level
approximately 4 feet above grade. The protective railings and barriers will
be approximately 7' above grade.
Staff is of the opinion that the proposed parking structure should have
minimal impact on adjacent properties, if proper landscaping buffers are pro-
vided and specific attention is provided regarding parking area lighting and
screening. 'these concerns are addressed in the conditions of approval.

The proposed office building is a four story structure with a contemporary
design. Building materials are shown as an off white concrete wall with
a sand blasted finish and a blue/green reflective glass for glazing treat -
writ. Windows are accented with dark green aluminun mullions and an accent
strip of dard red.
The Bascom Ave. and parking structure elevations have proposed balconies
which provide relief to the building facade. The entrance to the office
building is at the northwest corner of the structure near the parking faci-
lities.
Access to the projec' has been proposed solely from the Bascom Ave. frontage.
Two driveways to the north and south of the office building provide accessi-
bility to the rear parking area. Staff is of the opinion that restrictive
access to the Bascom Ave. frontage is necessary to preserve the residential
character of Michael Drive frontage. Staff does express a concern that the
pedestrian circulation on site be studied further, in that vehicle and pedes-
trian circulation are not well separated at this time.
The applicant has provided 560 parking spaces (330 standard, 222 compact,
8 handicapped) for this project which results in a parking ratio of 1:250.
Chapter 21.50 of the Zoning Ordinance indicates that parking should be
provided at a ratio of 1:225 for office uses. The Planning Commission, how-
ever, may approve lesser parking when the applicant has demonstrated that
less parking is warranted. Staff is of the opinion that due to the scale
of the proposed project the requested parking ratio is acceptable. Approval
of a parking ratio of 1:250 would be consistent with previous Planning Com-
mission appr,)vals of larger projects.
The Architectural Advisor is of the opinion that the building design is
well done. He does suggest t1.gt �r ther study be done of the accent treat-
ment and the way such bands meet the glass.
Staff is of the opinion that the project is conceptually acceptable and is
recommending its approval subject to the submittal of revised plans for the
approval of the Planning Commission. Revised plans should address the
following concerns:
1) Details of parking structure, loading and trash enclosure area,
and plaza area.
2) Further study of the proposed accent bands on the building.
3) Better separation and clarification of pedestrian circulation on site.
4) Provision of more landscaping along the southern portion of the
parking structure.
Since this proposal is for a significant development on Bascom Avenue, Staff
is also recommending that the application be referred to the City Council. The
Commission may recal that the Council has expressed a desire in the past to
review applications for large projects that may have an impact on an area.

The Planning Department is in receipt of building and parking structure
plans for the proposed office project on the referee--d property. A
review of these plans, in particular Sheet A5.3, indicates that the
proposed parking garage is to be constructed substantially higher than
previously represented to the Planning Commission and the City Council.
Specifically, the previous plans presorted to, and approved by, the
Planning Commission indicated a parking area depressed 4' with the
second level of parking being provided 4' above -grade. The submitted
plans now indicate the second level of parking at 715" (Detail 6) and
5'8" (Detail 7) above -grade.
The Planning Department does not support this change in parking structure
height. Your attention in this matter wnuld be appreciated.

Please take notice that no vested right to a building permit
shall accrue as the result of the granting of any land developrent
approvals, and applications. Pursuant to the adoption of ordinance
9.045 by County Sanitation District No. 4 of Santa Clara County,
the agency providing the above described parcel(s) with sewer
service, if the District's Manager and Engineer makes a deter-
mination that the issuance'of a sewer connection permit to a
building, or proposed building, on the above described property,
will, in his opinion, cause the District to exceed its ability to
treat adequatel;• the wastewater that would result from the issuance

BUSINESS AFFAIRS COMMITTEE MEETING
EMIL VILLA'S - JULY 24, 1984
Burch Boone, representing Lincoln Property Co., presented the proposal
for developing the property now occupied by Baker Trailer Sales.
The proposed four story building would comprise 140,00 square feet of
office space.
The property presently is zoned for six stories.
The project meets all the zoning requirements and will include traffic
mitigating provisions to be borne by the developer.
Following discussion on the project, it was recommended (with two
abstentions, city representatives), that the project be supported by
the Chamber cf Commerce.
It was noted that those who purchase property for development based
on zoning premises should be allowed their development if it meets
zoning demands.
The committee also discussed the city's proposed Capital Improvement .41
Construction Tax. The proposed tax would be designated for street
improvements. This would equalize the cost of streets and sidewalks
with all developers .ather than just the major projects. The rate would
vary for residentia: commercial or individual developments.
The committee recommends that the Chamber support such a plan.
These recommendations have been approved by the Chamber's Board
of Directors on August 9, 1984.

Dear Mr. Dempster:
Thank you for your reply dated Aucust 1 in response to my letter to Mr. Arth
Kee. Since my comments reference your letter by paragraph I have attached a
copy.
Your first paragraph refers to the Municipal Code Section 21.16.020 paragrap
on hotels, hospitals plus schools and states their need for 'a great deal of
parking.... if constructed in an R3 zone', It does not say office building
parking for office building.
Yet, your second paragrpah concludes that the R3 zone may be used for parkin
for an adjacent C2 zone office building. Tt does not say hotel, hospital or
school.
Thus, it appears that you are basically interpreting the R3 zone to include
parking not associated with R3 uses!
I do not see how you arrive at that conclusion from the argument presented. As
you are well aware of, the Topanga V. County of Los Angeles decision mandated
very specific requirements for findings of fact. Are you implying that Topanga
does not apoly here?
In your third paragraph you disavow Section 21.08. Then why is a Use Permit
being requested for 'parking as a transitional use"?

Therefore, it is the Staff's position that, in the Lincoln Property
application, the R-3 portion of the property may be used as a parking
facility for the adjacent office building being proposed.
The Staff in no way is concerning itself with Campbell Municipal Code

Dear Art:
Enclosed are the three story plans for the Baker Trailer
Sales project. You'll note that the first page shows a
parking ratio of 1 to 250 which assumes that the variance
parking is granted and the second page, P-1-A reflects
at a 1 to 225 parking ratio. The difference is that
additional light wells penetrating the elevated deck and
the lower level will be used for landscaping.
Per discussions that I have had with several of the
Councilmen, they will support the project with the three
story height restriction. I am assuming that approval
of the four story building subject to its being reduced
to three stories and subject to architectural and site
committee approval is a condition that we need to proceed
with approval of the project. This represents our plans
and i would like to have you circulate these plans to the
various City agencies that need to review them so that we
could be on the architectural and site approvals agenda
for August 28th.

whether, under Campbell's current zoning ordinance requirements, all of the
project's commercial parking could occupy essentially all of the land zoned R3
as a transitional use.
Mr. Dempster, the City Attorney, present at the Planning Commission meeting
stated that although the zoning ordinance R3 Section references R1 zoning which
states specific limitations on the amount of parking permissable, he concurred
With Phil Stafford that it was reasonable to interpret the zoning ordinance to
allow commercial parking on all of the land zoned multi -family.
Mr. Dempster offered to meet me, jointly with you, so that he could explain the
basis for his interpretation. However, due to other commitments I was unable
to schedule a meeting prior to the City Council meeting of July 17, 1984 when
this proposal was before the Council.
As you are aware, the City Council continued this item until the meeting of
August 21, 1984. Because of this additional time available I feel we could best
expedite a joint meeting if I had the City Attorney's basis for interpretation
in writing so that I may be properly prepared for said meeting.
Section 21.16.020 of the Campbell zoning ordinance addresses R3 Multiple Family
Districts. Section (1)-(10) lists all of the permissable uses and Section (11)
states "Uses customarily incidental to any of the above uses --Same as the R1
District".
We were advised that Section (11) is the part that allows parking on this land
zoned R3 with a Use Permit, and I was referred to Section 21.08.030 of the R1
Single -Family District that lists uses permitted with a Use Permit.
Yes, it does list Transitional uses of property for parking where R1 lot side
line abuts upon a lot in a C or M District. However, it continues on to say
"Erovided such transitional use does not extend more than one hundred feet from
the boundary of the less restricted district which it adjoins".
I have reviewed and had others review Chapter 21.08 of the Zoning Ordinance and
have not been able to find anything that appears to allow the Planning Depart-
ment, the Planning Commission or the City Attorney the ability to go beyond the
one hundred (100 ft.) limitation specifically listed in the Zoning Ordinance.
