Staff Report Information: OSurn Ct. (S 85-13).
DISMISSION
A[ its +oeeting of October 8, 1985 the Planning Commission approved the
Site and Architectural Plans for the homes on OBurn Ct. The Commission
requested that Staff prepare a diagram indicating the relationship of the
proposed homes to the existing homes in the area.
Attached for the Commission's review is an aerial photograph indicating
the approximate location of the proposed homes and the existing homes.
For the most part, the existing homes are loca�ed toward the front of the
lots with deep backyards backine, up to the new homes.

Commissioner Christ reported that this item was considered by the Site and
Architectural Review Committee. Review of the plans included the
setbacks, second stories, and street improvements. The Committee is
recommending approval with the stipulation that the previously recommended
alternative street improvements be reviewed in that standard improvements
may be more appropriate in light of the quality of the development. The
Committee expressed a concern with tie deterioration of asphalt driveways,
curbs and gutters.
Commissioner Christ noted his personal concern that the improvements for
the new court blend with the existing street.
Commissioner Olszewski asked about the retention of existing landscapinr,.
Commissioner Kasolas noted that this development is before the Commission
is only because it is in a sensitive area, otherwise it would just go
through the Building Department for permits.
Commissioner Dickson questioned if the new homes would fit in with the
surrounding homes, specifically side yards placed against back yards of
adjacent homes.
Comrsissioner Christ responded that the new homes are all designed —Nth the
privacy and line of sight of surrounding homes in mind. The Committeee
did not look at the architectural design from a compatibility standpoint;
however, the homes are well beyond the normal setbacks and the only
intrusions would be from secons stories, with these units being placed a
considerable distance from adjacent properties. The Site Committee is
impressed with the treatments on the different elevations.
Commissioner Christ noted that the Site Committee also -expressed a concern
that the unit which is tc be retained be completed before the other
homes. The applicant has basically agreed to this stipulation.

Chairman Fairbanks noted that alternative street improvements do not
necassarely mean substandard improvements, --a cement driveway is
allowable. She asked for a review of the alternative street improvement
policy.

Mr. Helms provided this review, noting that the policy allows for
materials which can be used in -lieu of Portland cement.
Considerable discussion ensued regarding the type of street improvements
to be provided for this subdivision. It was noted by Commissioner Kasolas
that the asphalt creates a maintenance problem, the sites can be provided
with better drainage with standard improvements, and concrete would be
cleaner for the homeowner. Commissioner Christ noted that it was the Site
Committee who brought the issue of improvements up to the developer.
Additionally, the Architectural Advisor expressed a concern about the
driveway placements and the aesthetics of the street if alternative
improvements are used. Standard improvements would allow for
substantially more on -street parking.
Mr. Hike Young, applicant, requested standard street improvements as
explained by Commissioner Christ.
Mr. Le- Peterson, 1156 Audrey Ave., noted that this project appeared to be
the best he has seen for this parcel so far. However, he indicated that
there are still a few problems. First, the original provision for sale of
this property assured that there would be no two-story homes built.
Although the setbacks are good for the most part, he questioned if
two-story homes were necessary --particularly on Lot i4. Mr. Peterson
continued that there is a traffic problem in this area, with a relatively
blind corner and increases traffic. Recently installed storm drains
modified the corner making it easier for cars to cut across the corner.
He asked that something be done to keep the cars from cutting across the
corner. Regarding alternative street improvements, Mr. Peterson prefers
earth colored concrete to asphalt, and is definitely opposed to white
concrete. He also expressed a problem with not allowing a rolled curb,
noting that this is a cul-de-sac with little traffic, and a rolled curb
would be pedestrian and bicycle friendly. Lastly, Mr. Peterson asked if
the street had to be named Oburn Court.
Mr. Kee explained that the name went with the te.itative subdivision map,
and to change the name would involve a re -submittal of this map.
Mr. Helms stated that Staff is opposed to rolled curbs as well as colored
concrete.
Commissioner Dickson felt that a piece of information was missing, namely
an aerial or overhead of the surrounding area to show the layout of
existing in reference to the proposed. He asked that an aerial be
provided at the next meeting for information purposes.
Commissioner Christ noted that the layout of the new homes in relation to
the surrounding homes was the first thing the Site Committee looked at,
and the Committee was impressed with the developers attempt to maintain
the setbacks and the privacy, with most of the structures are 20-30' from
adjoining property lines.
Mr. Lothar Shicker, 1092 Lucot Way, asked about the fence line on the east
side of the development, the height of the second story on Lot /4, the
access to the fo-mer park, the access during the construction process, and
the fencing policy.
Staff responded that ,he height of the second story is 22' from grade to
peak; the access easements would be abandoned according to Condition 14 of
the Tentative Subdivision Map approval, and the subdivider is required to
provide fencing. Fencing would be constructed as each lot to developed.
It is Staff's understanding that all the homes would be built s� the same
time, however, the construction period could extend over a year's time and
the fencing would not be the first thing to go up.

Discussion of Motion
Commissioner Christ again noted his concern about the improvements in the
area where the court will meet the existing street, hoping that Public
Works would see to it that there will be some type of blending between the
different types of improvements.
Commissioner Perrine .ommented on the excellent work of the Site
Committee.
Chairman Fairbanks stated that her own particular bias is to go with
alternative street improvements. Although she likes what is being done on
this site, and the way the developer has responded to the area's
concerns. However, because of the inclusion of the street improvement
issue in the motion, she stated that she would be speaking against the
motion. _
Vote on Motion
Motion carried with a vote of 4-2-1,
with Comwissioner Olszewski and
Fairbanks voting "no" and Commissioner
Toshach being absent.

The applicant is notified as part of this application that he/she is required
to meet the following conditions in accordance with the Ordinances of the City
of Campbell and the Laws of the State of California.
1. Property to be fenced and landscaped as indicated and/or added In red on the
plans. Landscaping and fencing shall be maintained in accordance with the
approved plans.
2. All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell ttunlcipal Code. All parking spaces to be provided with
appropriate concrete curbs or bumper guards.
3. Underground utilities to be pruvtded as required by Section 20.16.070 of the
Campbell Municipal Code.
♦. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections fo, underground utilities including
water, sever, electric, telephone and television cables, etc.
5. Ordinance No. 782 of the Campbell Municipal Code stipulates that any
contract for the collection and disposal of refuse, garbage, vet garbage and
rubbish produced within the limits of the City of Campbell shall be made with
Green Valley Disposal Company. This requirement applies to all single-family
dwellings, multiple apartment units, to all commercial, business. Industrial,
manufacturing, and construction establishments.
6. Applicant shall comply with all appropriate Stare and City requirements for
the handicapped.
7. Noise levels for the interior of residential units shall comply with minimum
State (Title 25) and local standards as indicated in the Noise Element of the
Campbell General Plan.
B. Applicant is hereby notified that he will be required to pay Park Dedication
In -Lieu Fee which will be assessed at the time the subdivision map is
submitted.
9. The applicant is hereby notified that the property Is to be maintained free
of any combustible trash, debris and weeds, until the time that actual
construction commences. All existing structures shall be secured by having
windows boarded up and doors sealed shut, or he demolished or removed from the

At its meeting of January 8, 1985 the Planning Commission recommended approval
of a Tentative Subdivision Map allowing the creation of 1D single family lots.
The City Council subsequently approved this subdivision at its meeting, of
February 12, 1984. CoadItions 15 and 16 of this subdivision map approval
required the applicant to submit site plans and elevations for the approval of
the Planning Commission.
The applicant at this time has submitted plans indicating the retention of an
existing house on Lot 1 and the construction of 9 new homes on the remaining
lots. A review of the applicant's proposal is attached as Exhibit A.

STAFF DISCUSSION
Background•
At its meeting of January 24, 1984, the Planning Commission adopted
Resolution 2254. which recommended approval of the 10 lot tentative
subdivision for this land. The City Council, at its meeting of February
21, 1984. accepted the Commission's recommendation and unanimously
approved the proposed subdivision. As indicated on the subdivisiu, map,
two of the three existing residentfat structures were to be retained.
Subsequently, the applicant requested approval of alternative street
improvements for the subdivision. This request was recommended for
approval by a 5-2-0 vote and approved by the City Council on February 5,
1985 by unanimous vote.
Current application:
At this time the applicant has submitted plans for site and architectural
approval for 9 new single family homes, and retention of one existing
home. One of the two existing homes, originally shown on the subdivision
map to remain, will ne removed if this application is approved.
The applicant has submitted plans and elevations for the 9 new homes being
proposed, however, plans and elevations have not been submitted for the
existing single family dwelling that is to remain. Condition number 16 of
the approval for the tentative map reads as follows:
16. Approval includes site review of existing structures which are
proposed to remain, in order that these structures be brought
up to compatible architectural standards with the surrounding
neighborhood and new construction.

The applicant is notified as part of this application that he/she is required
to meet the following conditions in accordance with the Ordinances of. the City
of Campbell and the Laws of the State of California.
1. Property to be fenced and landscaped as indicated and/or added in red on the
plans. Landscaping and fencing shall be maintained in accordance with the
approved l:lrns.
2. All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell Iunicipal Code. All parking spaces to be provided with
appropriate concrete curbs or bumper guards. i
3. Underground utilities to be provided as required by Section 20.16.070 of the
Campbell Municipal Code.
4. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
5. Ordinance No. 782 of the Campbell Municipal Code stipulates that any (
contract for the collection and disposal of refuse, garbage, wet garbage and I
rubbish produced within the limits of the City of Campbell shall be made with
Green Valley Disposal Company. This requirement applies to all single-family
dwellings, multiple apartment units, to all commercial, business, industrial,
manufacturing, and construction establishments.
6. Applicant shall comply with all appropriate State and City requirements for
the handicapped.
7. Noise levels for the interior of residential units shall comply with minimum
State (Title 25) and local standards as indicated in the Noise Element of the
Campbell General Plan.
S. Applicant is hereby notified that he will he required to pay Park Dedication
In -Lieu Fee which will be assessed at the time the subdivision map is
! submitted.
9. The applicant is hereby notified that the property is to be maintained free
of any combustible trash, dehris and weeds, until the time that artual
construction commences. All existing structures shall be secured by having
windows boarded up and doors sealed shut, or be demolished or removed from the

Pl=ase take notice that no vested right to a building permit
shall accrue as the result of the granting of any land developr-.ent
approvals, and applications. Pursuant to the adoption of ordinance
9.045 1)y County Sanitation District No. 4 of Santa Clara County,
the agency providing the above described parcel(s) with sewer
service, if the District's Manager and Engineer makes a deter-
mination that the issuance'of a sewer connection permit to n
building, or proposed building, on the above described property,
will, in his opinion, cause the District to exceed its ability to
treat adequately the wastewater that would result from the issuance
of such connection permit, then said permit may not be issued,
and, hence, no building permit may be issued by this agency.
If t;ie sewer connection permit is issued, it may contain sub-
stantive conditions designed to decrease the wastewater associated
