Minute action approving request for reduction of application fees and refund of
$375 - Mr. Henning Marahrens - 1256 Audrey Ave. (S 86-23)
STAFF RECOMMENDATION
That the City Council approve Mr. Marahrens request, and authorize a refund of
$375.00.
DISCUSSION
under standard application procedures, Mr. Marahrens paid a fee of $500 in July
1986 for a public hearing to consider his application for approval of site
and architectural application to allow a house move -on of a residence to
property known as 1256 Audrey Ave. This public hearing was held before the
Planning Commission under proceedings known as S 86-14. The Planning
Commission approved this request (vote: 6-0-1, with Commissioner Fairbanks
being atsent).
At this time, under proceedings known as S 86-23, Mr. Marahrens has changed his
development plans for this property. He intends to construct a new home on the
property, lather than move -on an existing home. He has, consequently, paid
another $500 application fee for this most recent application, or a total of
$1,000 for application fees on this property thus far.
Because he applied previously, and paid the standard $500 fee, Mr. Marahrens is
requesting that the latest site and architectural application (S 86-23) be
changed to a minor modification, thereby reducing the application fee to $125.
A letter from the applicant is attached for the council's information.
If the Council is in agreement with the applicant, it would be appropriate to
authorize a refund of $375.00.

Commissioner Grist reported that this application was considered by the
Site and Architectural Review Committee. The design is exceptional, and
the Committee is recommending approval.
Planning Director Kee noted that this item is before the Commission, in
accord with Council policy, because it is in the San Tomas Area. Staff is
also recommending approval.
Commissioner Kasolas asked if this application were anywhere else in the
City, other than the San Tomas Area, would it have to come before the
Planning Commission] and, in having to be considered by the Commission, is
the applicant placed under any additional burdens in the form of fees or
length of time for application processes.
Mr. Kee responded that the applicant is subject to the normal three week
application process time, as well as the standard $500 fee for site
approval applications.
Commissioner Dickson asked if this procedure is required because the
property is in the San Tomas Area, or because the property is zoned
R-1-10.
Mr. Kee noted that the San Tomas Area is the only area in the City where
there are lot sizes in the R-1-10 category. There were specific concerns
expressed in the San Tomes hearings relating to development in the area,
and requests to notify residents in that area regarding development.

Commissioner Rasolas stated, for the record, that proposals such as
S 86-23 are very bold and certainly something the City wants to encourage,
and should encourage -- not discourage by adding additional burdens. He
continued that this application points out that the San Tomas Policy may
have been appropriate at the time, but now it's time to do something to
encourage development in the area. If this applicant had wanted to build
his house anywhere else in this city, he would not have had to come before
the Planning C�msis,ion. Commissioner Rasolas concluded that this
procedure only hinders development of growth.

OF THE CITY OF CAMPBELL APPROVING A SITE AND
ARCHITECTURAL APPLICATION ALLOWING THE

ON PROPERTY KNOWN AS 1256 AUDREY AVE.

(APPLICATION OF MR. HFVNING MARAHRENS, S 86-23).
After notification and public hearing as specified by law on the application of
Mr. Henning Mara*revs for approval of plans and elevations to allow the
construction of a single family residence on property known as 1256 Audrey Ave.
in an R-1-10 (Single Family Residential) Zoning District, as per the
application filed in the Planning Office on December 18, 19861 and, after
presentation by the Planning Director, proponents and opponents, the hearing
was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows,
1. The proposed project is an appropriate scale in relationship to the
adjacent developed uses.
2. The house is well designed and architecturally blends into the
neighborhood.
3. The building design is considered acceptable and interesting by the
Architectural Advisor.
4. The parking provided meets/exceeds the code requirements.
5. The project is designed to minimize infringement on neighboring properties.
6. The project is of a high quality design and will be aesthetically pleasing.
Based on the above findings, the Planning Commission does hereby grant the
requested development, subject to the following conditions:
1. Building occupancy will not be allowed until public improvements are
installed.
2. All parking and driveway areas to be developed in compliance with Chapter
21.50 of the Campbell Municipal Code. All parking spaces to be provided
with appropriate concrete curbs or bumper guards.
3. Plans submitted to the Building Department for plan check shall indicate
clearly the location of all connections for underground utilities including
water, sewer, electric, telephone and television cables, etc.
4. Sign application to be submitted in accordance with provisions of the Sign
Ordinance for all signs. No sign to be installed until application is
approved and permit issued by Planning and Building Departments (Section
21.68.030 of the Campbell Municipal Code).

STAFF RECOMMENDATION
That the Planning Commission adopt the attached findings and approve this
application, subject to the attached conditions.
STAFF DISCUSSION
The applicant is requesting approval of plane to allow construction of a
single family residence on the 8,700 sq.ft. vacant lot. Because this
vacant property is in the San Tomas Area; and because of the new 'Zoning
Ordinance, this application requires a public hearing before the Planning
Commission. All property owners within 300 feet of the parcel have been
notified.
Building materials for the two-story house are indicated as lap siding for j
th- walls and shakes for the roof. The site plan indicates that the
structure will cover 231 of the net lot are+.
Parking will be provided by a 3-car garage and another 3 spaces in
tandem. The proposed house meefc or exceeds all setback requirements. '
The property is abutted with townhomes to the west and south, and single
family homes to the north and east. ,
As the Commission may recall, at its meeting of July 22, 1986, it approved
a house move -on for this property (Vote: 6-0-1, Commissioner Fairbanks
