CA 94080 RE: Relocation of three (3) cellular antennas (S 99-03) - 1999 SJ3ascom Avenue Dear Ms. Pennington: The Community Development Department has reviewed your Site and Architectural Review Permit application (S 99-03) for the relocation of three (3) cellular antennas on the facade of an existing roof - mounted structure on the office building located at 1999 S. Bascom Avenue. It is understood chat the I` application is a request for a modification to a previously -approved cellular antenna facility located on the roof of the office building at the above -referenced address and entails the movement of three (3) cellular antennas from the east elevation of the facade of the roof -mounted structure to the north elevation of the facade of the roof -mounted structure. Because the antennas are facade -mounted and are painted to blend in and match the existing roof -mounted structure, the antennas are considered "stealth facilities". "Stealth facilities" may be conditionally -approved by the Community Development Director. Upon review of the application, the Community Development Director has conditionally -approved the Site and Architectural Review Permit based upon the :ollowing conditions: I. Protect Aoorov_al: Approval is granted for a Site and Architectural Review Permit (S 99-03) for the movement of three (3) cellular antennas from the east elevation of the facade of the existing roof - mounted structure on the building located at 1999 S. Bascom Avenue to the north elevation of the facade of the existing roof -mounted structure. The antennas are four (4) feet in height and will be attached to the facade of the roof -mounted structure by brackets. No portion of the antennas and/or its attachments will protrude above the roof -mounted structure and the antennas will be painted to blend in and match the roof -mounted structure. Project approval shall substantially comply with project plans prepared by Total Design Solutions Architects. LLD dated May 19, 1999. 2. Permit., The applicant shall obtain any permits deerticd necessary by the Building Division and the Uniform Building Code. 3 Cables: Any new cables installed as a result of the movement of the antennas shall be obscured from public view h7 enclosing them in architecturally designed cabinets painted to match the building or be run internally through the building. Compatibility with City Emergency Services: The facility shali not be operated, nor cause to be transmitted on any radio frequencies licensed to the City for emergency telecommunication services such that the Citv's emergency telecommunications system experiences interference. 5. No Impacts on Adjacent Uses: A. The use of lighting shall not be allowed on wireless telecommunications facilities unless required as a public safety measure. Where lighting is used, it shall be shielded to prevent glare on adjacent uses. B. No advertising signage or identifying logos shall be displayed on wireless telecommunication facilities, except for small identification plates used for emergency notification or hazardous or tonic materials warnings. C. The wireless telecommunications facility, including power source, ventilation and cooling facility, shall not generate noise discernible beyond the property lines. 6. Safety: A. Antennas are to be sited in such a way to prevent a person from passing within the safety limits established by the FCC -adopted standards for controlled access. Warning signage shall be maintained at the facility identifying all wireless telecommunication facility equipment and safety precautions for people nearing the equipment as may be required by any applicable FCC -adopted standards, including the RF radiation hazard warning symbol identified in ANSI C95.2-1982, to notify persons that the facility could cause exposure to RF emissions. C It is a continuing condition of this authorization that such facilities be operated in such a manner so as not to contribute to ambient RF/EMF emissions in excess of then current FCC adopted RFIENIF emission standards. Violation of this condition shall be grounds for revocation. D. The wireless telecommunications service provider shall submit to the Community Development Director ten (10) days after installation of the facility, and every two (2) years thereafter, a certification attested by a licenses engineer expert in the field of RF/EMF emissions. that die facility is and has been orerating within the then current applicable FCC standards for RF/EMF emissions. E. The service provider shall provide signage, as required, including phone numbers of the utility provider, for use in case of an emergency. The signs shall be visibly posted. i 7. Permit Expiration A. The Site and Architectural Review Permit (S 99-03) for this project is valid for a period of one t I i year from the date of this approval. All conditions of approval specified herein must be completed within one ( I ) year from the date of the Site and Architectural Review Permit approval, or the Permit shall become void. B. This Site and Architectural Review Permit approval is effective for five (5) ,years from the date of approval of the Pertrul. If the use is to continue, the applicant hall apply for an extension prior to the expiration of this Permit. C The service provider shall provide written notification to the Community Development Director upon cessation of operation on the site exceeding a 90-day period. The service provider shall remove all obsolete or unused facilities from the site within IPO days of termination of its lease with the property owner or cessation of operations, whichever comes earlier. S 99-03 - 1999 S. Bascom Page 3 D. If a consecutive period of 180 day, has lapsed since cessation of operations, a new Pet -rut shall be required prior to use or reuse of the site. E. Prior to issuance of any permits for a new wireless telecommunications facility on site. or prior to renewing the Site and Architectural Review Permit for an existing wireless telecommunications facility, the applicant shall provide an irrevocable letter of credit or other reasonable form of security, satisfactory to the City Attorney, in an amount 2asonably sufficient to cover the cost of removal of the facility in the event that its use is abandoned or .Site and Architectural Review Permit expires, or is terminated and the equipment is not voluntarily removed. F. If technological improvements or developments occur which allow the use of materially smaller or less visually obtrusive equipment. the service provider will be required to replace or upgrade the approved facility upon application for a new Site and Architectural Review Permit to minimize the adverse effects related to land use compatibility, visual resources. public safety and/or environmental factors. PROCESS Pre-Annlication Review: It is recommended that the applicant make an appointment with a planner prior to submitting an application to discuss the preliminary design of the project. This will help the applicant determine if the proposal is t,- sistent with existing review standards and ordinance requirements. Filing of Aoohcation: The completed application must be filed with the Planning Department along with the appropriate fee and all required data.
