Mr. Kee reported that a communication has been received from the applicant requesting that the appeal be withdrawn, therefore the Staff is recommending denial without prejudice. Commissioner Fairbanks then moved that SA 81-46 be denied without prejudice, seconded by Commissioner Howard and unanimously adopted. ITEM NO. 13 STAFF COMMENT SHEET - PLANNING COMMISSION MEETING OF JANUARY 12, 1982 SA 81-46 Continued appeal of decision of Planning Director Kuehn Chiropractic denying request for signing on property known as 1627 S. Bascom Avenue. STAFF RECOMMENDATION Denial, without prejudice. STAFF DISCUSSION At its meeting of December 8, 1981 the Planning Commission continued this item to the January 12, 1982 meeting in order that the applicant could apply for a temporary sign permit for the fence sign. A copy of the previous Staff Report is attached for the Commission's review. Since that time, the applicant has submitted an application for a temporary sign permit. The Staff granted a three month permit for the fence sign, subject to the condition that the phone number be removed (see attached letter dated December 15, 1981). STAFF DISCUSSION The applicant is appealing the decision of the Planning Director denying a request for a 50 square foot sign which is painted on a fence. Attached for the Commission's review is the following information: 1. The letter from the Planning Department to Mr. Kuehn explaining the reasons for denial dated November 5, 1981. 2. Drawings of the sign. 3. Letter from Mr. Kuehn stating his reasons for appeal dated November 16, 1981. As stated in the letter to Mr. Kuehn, the sign ordinance requires that signs for this type of use be attached to or painted on the building and parallel to the adjoining street or be free-standing. It is Staff's interpretation of the code that a fence is not a part of the building. Staff is concerned that approval of this application could set a precedent, thus allowing signs to be painted on fences elsewhere in the City. For these reasons Staff is recommending denial of this appeal. Bascom Avenue Gentlemen: I was greatly disappointed upon receipt of your denial of the sign now standing at 1627 S. Bascom Avenue (fence). Upon moving onto the property (1627 S. Bascom) and considering the surrounding properties adjoining us on Bascom Avenue, it was our decision to, in effect, improve not only the appearance of our building, but also to hopefully encourage others to improve their signs. Therefore, at considerable expense to myself, we employed persons to "clean up" the lot located next to us on the corner of Bascom and Hamilton Aves., which has evidently been greatly neglected for some period of time and evidently without the notice of your planning commission. There was an abandoned car on the premises and weeds growing six to eight feet high along the entire lateral margin of our property. Over a period of several days, we removed all the weeds, excepting the back portion of the adjoining property, and cleared up the beer bottles arxi other assorted garbage, and were instrumental in having the abandoned car towed away. To be honest with you, our fence was really not attractive when we first moved in. We therefore had it painted to match the building, thereby giving us the appearance of having a larger single p'.ace of property. The fence in question: 1. is structurally attached to our building, 2. has been decorated to match and give the resemblance of being a single piece of property, and 3. at considerable expense and careful consideration, has had a brown lettering with the name of our office applied to creme color paint so as not to be offensive to anyone seeing the sign. 162? We will so construct the alternative sign that we have also appl?-d to your commission for in approximately 90-180 days. However, as again considerable expense is involved with the new sign and it is the opinion of all persons I have asked that the fence is not offensive but impressive, and since the fence does face Hamilton Avenue, a main thoroughfare with no physical obstacles in front of it, we would like to request that we be able to keep the fence sign, for a period of one year or until the construction of property on the vacant lot is completed, whichever canes first. Bascom Avenue Gentlemen I was greatly disappointed upon receipt of your denial of the sign now standing at 1627 S. Bascom Avenue (fence). Upon moving onto the property (1627 S. Bascom) and considering the surrounding properties adjoining us on Bascom Avenue, it was our decision to, in effect, improve not only the appearance of our building, but also to hopefully encourage others to improve their signs. Therefore, at considerable expense to myself, we employed persons tv "clean up" the lot located next to us on the corner of Bascom and Hamilton Aves., which has evidently been greatly neglected for some period of time and evidently without the notice of your planning commission. There was an abandoned car on the premises and weeds growing six to eight feet high along the entire lateral margin of our property. Over a period of several days, we removed all the weeds, excepting the back portion of the adjoining property, and cleared up the beer bottles and other assorted garbage, and were instrumental in having the abandoned car towed away. To be honest with you, our fence was really not attractive when we first moved in. We therefore had it painted to match the building, thereby giving us the appearance of having a larger single piece of property. The fence in question: 1. is structurally attached to our building, 2. has been decorated to match and give the resemblance of being a single piece of property, and 3. at considerable expense and careful consideration, has had a brown lettering with the name of our office applied to creme color paint so as not to be offensive to anyone seeing the sign. 1627B.BABCOM AVE. We will so construct the alternative sign that we have also applied to your commission for in approximately 90-180 days. However, as again considerable expense is involved with the new sign and it is t'.e opinion of all persons I have asked that the fence is not offensive but impressive, and since the fence does face Hamilton Avenue, a main thoroughfare with no physical obstacles in front of it, we would like to request that we be able to keep the fence sign, for a period of one year or until the construction of property on the vacant lot is completed, whichever canes first.
