denied his signing request to add an additional sign to an existing
freestanding sign. The Planning Director denied the applicant's sign
request on the basis that the proposed sign was not consistent in
arrangement with other approved signing at this commercial center. The
letter denying the applicant's signing request, and the letter of appeal,
are attached for the Commission's review.
Staff, additionally, has been advised that the Publi- works Department
expresses a concern renardina any expansijn of this freestanding sign
towards the street right-of-way which would decrease vehicular
visibility. The Public works Staff has a particular concern at this
location, in that the parking lane along this portion of Bascom Ave. wil'
be eliminated in conjunction with the office development just south of
this property.
The requested sign has been erected at this time.

on the referenced property. This signing request has been denied because it
is the Planning Director's opinion tnat the proposal is not of the same design
as the other signing panels on this freestanding sign.
The Planning Director expressed the following concerts:
1. The relationship of the size of the r.Pw sign panels and the existing
panels on the freestanding sign is not consistent.
2. The use of a vertical display or arrangement, rather than horizontal,
is not consistent with the other signage at this location.
3. The depth of the sign cabinet is different.
4. The video b•ziness is identified five times on the freestanding
sign, whereas the majority of businesses at this location only
have two sign faces.
Section 21.68,090(4)(D) indicates that individual signs for occilpants in the
same building or shopping center shall be of the same design insofar as possible.

Kindly be informed that I have recently been contacted by and have
agreed to represent Mr. Jack Livingood, the President of *•GMEC, Inc.,
with reference to the above -captioned matter. Mr. Livingood has
authorized me, on his behalf, to appeal the decision of Mr. Tim
Haley in a letter dated January 6, 1986 in which Mr. '-ivingood's
request for a sign permit for his business known as "Play It Again
Same" Video was denied. Please accept this letter as our Notice
of Appeal of that decision.
The reasons for our appeal are the following:
1. The sign as proposed by the appellant is of similar size
(length and width) proportion, materials and color as the
associated building and the other structures in the
surrounding area as required by S21.68.090 entitled
"Permanent Signs -General".
2. The vertical display or arrangement of the Appellant's
sign is again generally of the same size, color, materials
and proportion of the other signs, even though they are
horizontal. It is Appellant's contention that because of
the similarity in those areas his sign does fall within
the "same design insofar as possible" as provided for in
S21.68.090(4)(D). There is no requirement within that
Section that the signs be identical as opposed to similar.
There is also nothing within itI at Section that specifies
that signs must be either horizontal or vertical and the
Planner's interpretation or reading into that ordinance
of that requirement constitutes error which forms the
basis of this appeal.

3. The depth of the siqn cabinet between Appellant's proposed
sign and the other signs of related businesses is minimal
and, as such, does come within the provisions of that
Section which allows some latitude in discrepancies because
of the words "insofar as possible". Agair, there is no
requirement within tee sign ordinance that each individual
sign be exactly the same or identical.
4. Although the video business is identified five times on
the sign, whereas the majority of businesses have only
two sign faces, Appellant is willing to remove two of his
sign displays which would make the difference between the
Appellant's business and the remaining businesses negligible
and as such to come within the spirit and intent of the sign
ordinance. I
S. There ha- been and is no objection to the Appellant's sign
from the other businesses whic5 are located within the
proposed commercial site and the economic livelihood of
Appellant's business has been and is directly connected
and linked to Appellant's proposed sign display. The Planner,
Mr. Haley, d..d not take any of those two cc:siderations
mentioned in this sub -paragraph into his co,,sideration in
making his adverse determination and such failure also
constitutes er_or on his part.

Wherefore, for all of the above reasons, I respectfully request,
on behalf of Mr. Livingood and the above -named business, a hearing be-
forethe Planning Commission of the City of Campbell to appeal
this previously mentioned decision. I would also appreciate
your notifying me and Mr. Livingood directly of the time when
this matter will be considered on the next Planning Commission
agenda.

Mr. tee reported that Staff is recommending a continuance to April 22.
1986, in that Staff is of the understanding that a sign program is
forthcoming.
Mr. Jack Livingood, 2901 S. Bascom Ave., stated that he has engaged a sign
company to provide plans, however, he has no control over when the plans
will be ready. Mr. Livingood felt that his appearance before the
Couniseion should be eliminated unless the forthcoming plans are denied by
the Staff. He noted that he has been working with Mr. Kee toward a
resolution of the problem.
Mr. Kee indicated that if the subject plans are along the line that has
been discussed with the applicant, there may be no need for the issue to
con. before the Commission. Staff is recommending a continuance on the
basis of information available at the time the Staff Report was written;
however, the Commission could also take action to remove ;his item from
the agenda if it so desires.

Commissioner Dickson expressed a concern with the illegal signing on the

application to its meeting of April 22, 1986.
STAFF DISCUSSION
This matter has been continued from the previous Planning Commission
meetings of January 28, February 11 and March 25, 1986. This matter vas
continued by the Commission at its meeting in January at the request of
tl,a applicant, and at its meeting in February upon recommendation of the
Site and Architectural Review Committee, so that a revised signing
proposal --ould be submitted.
This matter was again continued from the Planning Commission meeting of
March 25, 1986 so that a revised proposal could be submitted. As of this
writing, Staff has not received a revised plan.
Staff is of the opinion that the applicant has had ample time,
approximately 2 months, -o have submitted a revised proposal for the
sl.gning at this location. Consequently, Staff can support only one
further -onrinuance of this matter.
The requested sign has been erected for approximately 3 months without
permits at this time.

could be submitted.
As of this writing, Staff has not received a revised plan or additional

Dear Mr. Kee:
Kindly be informed that I have recently been contacted by and have
agreed to represent Mr. Jack Livinqood, the President of AG.MEC, Inc.,
with reference to the above -captioned matter. Mr. Livingood has
authorized me, on his behalf, to anneal the decision of Mr. Tim
Haley in a letter dated January 6, 1986 in which Mr. Livingood's
request for a sign permit for his business known as "Play It Again
Same" Video was denied. Please accept this letter as our Notice
of Appeal of that decision.
The reasons for our appeal are the following:
1. The sign as proposed by the appellant is of similar size
(length and width) proportion, materials and color as the
associated building and the other structures in the
surrounding area as required by §21.68.090 entitled
"Permanent Signs -General".
2. The vertical display or arrangement of the Appellant's
sign is again generally of the same size, color, materials
and proportion of the other signs, even though they are
horizontal. It is Appellant's contention that because of
the similarity in those areas his sign does fall within
the "same design insofar as possible" as provided for in
521.68.090(4)(D). There is no requirement within that
Section that the signs be identical as opposed to similar.
There is also nothing within�tlat Section t'.Iat specifies
that signs must be either horizontal or vertical and the
Planner's interpretation or reading into that ordinance
of that requirement constitutes error which forms the
basis of this appeal.

and, as such, does come within the provisions of that
Section which allows some• latitude in discrepancies because

4. Although the video business is identified five times on
the sign, whereas the majority of businesses have only
two sign faces, Appellant is willing to remove two of his

continuance of the existing one. They indicated that they would approach
the other tenants in the building and try to work something out;
therefore, a continuance is being recommended.

Bascom. It is not visible from the street. We we would like to
replace the existing 8' sign with a 4'-6" sign that reads VIDEO
the plastic 4'-611 sign would be visible from S. Bascom.
I am opening a new store in Santa Clara so my time has been
drasticly curtailed. That is why I have been lax in not contacting
you sooner . I will be in after the 4th and hope we can resolve
the sign problem.

Dear Sir:
It has come to the attention of the Planning Department that
the approved canopy reading "Video Rental s Sales" has been
removed from your business and that an unapproved canopy sign
reading "Video" has been retained. The Planning Department
does not have difficulty supporting this new sign in lieu of
the approved canopy sign, however, 1t is necessary that the
file reflect this change in signing.
Please submit a drawing which depicts this new canopy sign.
Additionally, please paint the cabinet cf this sign dark
brown so that it is consistent with the other approved canopy
signs in the center. Additionally, please secure any necessary
building permits which would be required in conjunction with
the erection of new signing.
