RECONNENDATION That the City Council adopt the attached findings and uphold the decision of the Planning Ccmmission denying the freestanding sign. DISCUSSION At its previous meeting of June 13, 1986, the City Council continued the consideration of this appeal, at the applicant's request. A copy of the previous Planning Commission report is attached for the Counril's review. COST Not applicable. RECOMMENDATION That the City Council aonot the attached findings and uphold the decision of the Planning Commission denying the freestanding sign. DISCUSSION The applicant refaced an existing freestanding sign and constructed a new wall sign without obtaining a permit. Staff notified him of the violation and he submitted an application. The signs required Planning Commission approval because they exceeded the size and height requirements of the Signing ordinance. At its meeting of May 13, 1986 the Planning Commission approved the wall sign, but denied the freestanding sign based on the attached findings. Attached are the minutes from that meeting. At this time, the applicant is appealing the Planning Commission's decision denying the freestanding sign. Attached is his letter of appeal explaining his reasons. COST Not applicable. Bascom Ave. in a C-2-S (General Commercial) Zoning District. Commissioner Perrine reported that this application was considered by the Site and Architectural Review Committee. The applicant would like an opportunity to address the Commission. No recommendation is being made by the Site Committee. Mr. Kee reported that the applicant has subsequently met with Staff and has indicated that he would agree to bring the signing into conformance with the sign regulations, if the Planning Commission would approve the existing signing for a period of two years. If the Planning Commission chooses to approve the an! feant's request for a two year period, Staff is recommending that th% :pn.'icant . bmit ar, agreement satisfactory to the City Attorney which woui, p_ovidt for the removal of these signs within two years. Kee responded that the City is requiring conformance when signing is changed. Mr. Frank Clarizio, applicant, noted that See's Candy store blocks his busiress coming south. He would like to replace the sign at the television store; and, he would replace the subject sign in two years. Discussion of Motion Commissioner Olszewski felt that there was a hardship on this business because of the setbacks on the See's building; and, he was in agreement that the free-standing sign should not be approved as presented, and that the wrll sign be approved. Chairman Kasolae asked what changes had been made on the sign; and, if a change in the lettering makes a difference. obo wr-{ ® 0 Mr. Kee responded that the lettering and text of the sign had been changed; and, the change of lettering requires compliance under the signing ordinance. Vote on Motion Motion carried unanimously (5-0-2). Mr. Kee explained the appeal procedure to Mr. Clarizfo. Bascom Ave. in a C-2-S (General Commercial) Zoning District. Commissioner Olssewski reported that this item was considered by the Site and Architectural Review Committee. '"he Committee is in agreement with Staff's recommendation for denial. A continuance was discussed with the applicant, however, it was the aepllcant's wish that the issue be brought before the Commission. Additionally, the Committee is of the upinion that landscaping on this site should be discussed. Mr. Kee indicated that there were existing signs when this property was annexed into the City, and the lettering of those existing signs has been changed which, under the ordinance, constitutes a new sign. Commissioner Fairbanks asked if it was clear to the Site Committee if the applicant understood the signing ordinance. Commissioner Olazewski noted that the sign ordinance was explained a number of times during the meeting. Mr. Prank Clarizio, applicant, stated that he was told he could keep his sign when the site was annexed intc the City ten years ago. He continued that a sign company indicated to him that the plastic part of the sign which contains the lettering is not the "sign", but rather the "facing". He changed the "facing" -- not the "sign. Mr. Kee noted that the sign could be kept as it was; however, it has beer changed - the lettering is different. According to our ordinance, the sign has been changed. Unfortunately, it is not the sign company who defines a sign, but rather the City's ordinance. Commissioner Olszewskl asked the record to show that the applicant was Informed of the City's signing policy, as just stated by Mr. Kee, at the Site and Architectural Review Committee meeting. If the applicant so desires, an opinion from the City Attorney may be obtained. Mr. Clarizio stated that he had asked the City Attorney. The City Attorney told him that it became a new sign when it was changed. Mr. Clarizio noted that he did not take anything down, he just changed the letters. Commission Fairbanks asked if the Planning Commission chooses to deny this request, and the applicant chooses to return the sign to the way it was when 1t was grandfathered in, would he be able to do that. 0 Mr. Seligman stated that if the sign were returned to it's original state at this point, it would now have to be approved in wnatever form it has been changed. Mr. Kee indicated that the Planning Commission would have the authority to approve the sign going back to it's original state. Commissioner Dickson noted that the Commission would be approving a non -conforming sign if this was done. There was additional ulscu>sion regarding the possibility of returning the sign to its original state; the relocating of the subject business; and the possibility of a continuance. Mr. Clarizio stated that he would like a continuance in order to work with Staff on a revised signing proposal. Commissioner Olszewski suggested that the applicant incorporate the concerns from the Site Committee, as well as those stated this evening, in the re -design of his signing. That the Planning Commission adopt the attached findings and deny the applicant's signing request; or 2. If approved, subject to the attached conditions. STAFF DISCUSSION The Planning Commission, a. its previous meeting of April 22, 1986, continued the consideration of this signing request so that the applicant could meet with Staff to discuss possible signing alternatives. The applicant has subsequently met with S.aff and has indicated that he would agree to bring the signing into conformance with the sign regulations, if the Planning Commission would approve the existing signing for a period of two years. If the Planning Commission chooses to approve the applicant's request for a two year period, Staff is recommending that the applicant submit an agreement satisfactory to the City Attorney which would provide for the removal of these signs within two years. Staff is of the opinion that the applicant's signing request is not justified as discussed in the previous Staff Comment Sheet. CONDITIONS OF APPROVAL 1. WHEREAS, CLARIZIO is the owner of two parcels of commericial real property located at 2230 & 2250 Bascom Avenue, Parcel Vs 288-06-004 and 288-06-005, Campbell, California; and on the effective date of this agreement there stood on those two parcels of real property owned by CLARIZIO, two free standing signs which are not in compliance with the signing ordinances of the City of Campbell; and WHEREAS, the City of Campbell Planning Commission has heretofore ordered that the sign on Parcel 288-06-004 located at 2250 Bascom Avenue be removed and brought into compliance with the signing ordinances of the City of Campbell; and WHEREAS, CLARIZIO had appealed said order and decision of the Planning Commission to the City Council; and WHEREAS, the City Council by majority vote on July 15, 1986, has granted CLARIZIO the privilege of using the existing sign on Parcel 288-06-004 located at 2230 Bascom Avenue, in its present state of condition for the term of one (1) year and nine (9) months from July 15, 1986; IT IS AGREED AS FOLLOWS; 1. CLARIZIO shall remove forthwith, and in no event later than ten (10) days from execution of this agreement, that free standing sign on Parcel 288-06-005 at 2250 Bascom Avenue, Campbell, California. Anv new sign to be erected upon said premises shall be in full compliance with the signing of the City of Campbell. 2. WHEREAS, CLARIZIO is the owner of two parcels of commericial real property located at 2230 & 2250 Bascom Avenue, Parcel is 288-06-004 and 288-06-005, Campbell, California; and on the effective date of this agreement there stood on those two parcels of real property owned by CLARIZIO, two free standing signs which are not in compliance with the signing ordinances of the City of Campbell; and WHEREAS, the City of Campbell Planning Commission has heretofore ordered that the sign on Parcel 288-06-004 located at 2250 Bascom Avenue be removed and brought into compliance with the signing ordinances of the City of Campbell; and WHEREAS, CLARIZIO uad appealed said order and decision of the Planning Commission to the City Counc_1; and WHEREAS, the City Council by majority vote on July 15, 1986, has granted CLARIZIO the privilege of usinq the existing sign on Parcel 288-06-004 located at 2230 Bascom Avenue, in its present state of condition for the term of one (1) year and nine (9) months from July 15, 1986; IT IS AGREED AS FOLLOWS: 1. CLARIZIO shall remove Forthwith, and in no event later than ten (10) days from execr' >n of this agreement, that free standing sign on Parcel 28b-06-005 at 2250 Bascom Avenue, Campbell, California. Any new sign to be erected upon said premises shall be in full compliance with the signing of the City of Campbell. 2. CLARIZIO shall remove the existing free standing siqn located on Parcel 288-06-004 at 2230 Bascom Avenue, Campbell, California no later than April 15, 1988. Any new siqn to be erected on the premises thereafter shall be in full compliance with the City of Campbell signing ordinances. 0 0 3.
