Bascom Avenue Dear Mr. Reedy, The ';ommunity Development Department is in receipt of your the letter dated July 1 i, 1996 regarding the neon accent on the above referenced building. In light of your concerns, I have discussed this matter with the project planner, Mr. Darryl Jones and the Community Development Director. After reviewing the approved building plans, it appears that a recessed neon strip was identified on the approved building plans. The element was indicated however, as an exposed element within the fascia board and not the encased feature proposed with the rreviousty approved sign application. Mr. C3r1 Hays and 1 met on July 17, 1996 to clarify this issue and are in agreement about the application of the neon. I explained to Carl that if architectural changes were requested, that a site and architectural modification would be required. I also indicated to Carl that a refund of the application filing fee ($960) would be forthcoming. Thank you fcr bringing this issue to our attention. Bascom Avenue - Outback Steakhouse Dear Ms. Sctara: This office represents Carl Hays and the cutback Steakhouse Restaurants of which he is a principal. Based on your letter of June 2b, 1996 and your discussions with Mr. Hays, we are extremely concerned that we may get caught up in substantial additional approval time from your department, which we were not anticipating. Your letter indicates that the Outback Steakhouse sign application has been approved, but the attached conditions of approval, in particular I(b) states that the "Neon accent is not approved as part of the sign proposal or on the building." Subsequent to our original submission of elevations for the building, we were required by architectural review to resubmit amended elevations making changes to the tile roof (barrel type), the slope of the roof line and the stucco adjacent to the siding of the building. Both the original and the amended elevations clearly articulate, both visually and in narrative format, the location and color of the "recessed red neon strip." It is clearly not part of our signage, and more importantly, it was approved without objection. The neon strip is a basic architectural element of our prototypical Outback building and used universally in our buildings as part of our concept. When the Planning Department approved the release of our revised plans for building permits on March 8, 1996, we planned our time accordingly for our anticipated opening on August 14, 1996. Major opening parties involving hundreds of people have been planned for that weekend. We would ask for assurances from your department that the elevations containing the neon strip architectural feature were approved as evidenced by our s(amped set of plans, and that no further action regarding this design element is necessary.
