• Applicant is requesting approval of a Sign Application to allow three wall signs
with a total of 98 square feet of sign area.
• Ordinance allows one 50 square foot wall sign and one 50 square foot
freestanding sign for up to 100 square feet in signage per business.
• Applicant's proposal redistributes the allowable 100 square foot sign area.
• Applicant originally sought three 48 square foot signs but has modified request
based on the SARC recommendation. The new request is for one 48-square foot
sign for the front of the restaurant and two 25-square foot signs for the eastern
and western side elevations.
• The proposed sign area does not exceed that allowed under the Sign Ordinance.

Mr. John Pinches, representing Matilda Management, provided photographs to

DISCUSSION
Applicant's Request: As described in the project data above, the applicant is requesting
approval of three wall signs identifying a restaurant use located at the Pruneyard in lieu of
one wall sign and identification on a freestanding sign. The building is located at the
westerly end of the Pruneyard Shopping Center on Campbell Avenue, between Union
Avenue and S Bascom Avenue. The signs consist of an individual sign illuminated letters
under the gable element of the building on the east, west and south elevations. Based
upon the applicant's statement and site photographs, it appears that motorists have limited

visibility ofthe restaurant from the eastbound and westbound approach Additionally, the

The Site and Architectural Review Committee considered the applicant's request for three
wall signs at its meeting of June 13, 1996 At the time that the proposal was presented to

APPLICANT BACKGROUND
Outuack Steakhouses are dinner houses operated by regional franchise groups in locations
throughout the United States. This "Australian" theme restaurant concept as been so well
accepted by the American public that Outback Steakhouse can boast that not one location
has failed since it's beginning in 1987. Last year the chain was proclaimed as "the most
successful restaurant franchise in the United States" by both Restaurant News and Inc.
Magazines. Each of the over 330 locations employ 75-80 employees with above -average
industry earnings.
Currently there are five locations operational in Northern California. These locations are in
the cities of; Pleasant Hill, Cupertino, Fresno, Bakersfield and Modesto. In the very near
future, the Sacramento location will open. All six of these locations utilize the Outback
Steakhouse trademarked graphics program as submitted in this application.
It should be noted that the management relies very heavily on "word of mouth" advertising
and that new patrons are visiting for their first time based upon verbal directions from other
individuals. Because of this fad, Outback Steakhouse management is very concerned that
each restaurant location has adequate signage so as to not frustrate new customers
attempting to locate the restaurant upon their first visit to the restaurant.
LOCATION SPECIFIC DATA
Marketing demographics for the Campbell, CA location predict that clientele will visit this
location from as far away as 20 miles. Many of whom may not be familiar with this
secondary street location even though it is located at the Pruneyard Mall location. It should
be noted that the average number of customers served per year is 156,000.
The building is located upon a freestanding C-3 zoned pad with Pruneyard Mall ingress and
egress driveways along both the East and West property lines. A Pruneyard Mall parking area
runs along the North property line and Campbell Avenue is along the South property line.
OVERVIEW
The applicant feels that this application is still not an optimum solution to a very poor
signage visibility problem for this project. However, we feel that the application serves to
make the best of a bad situation in terms of signage visibility.
Causes of the signage visibility problem are the density of nearby physical obstructions and
the building's physical location upon the property. These conditions are not easily rectified
by signage design changes In view of the physical nature of this property.
Further, the applicant would like to point out that the physical location of the building was
changed from the original design of facing west to being located facing south directly against
the south property line. This placement of the building was necessitated because of
structural design changes to the roof slope required by the planning department. While this
did not create all of the problems discussed below, it did eliminate viable design solutions
for the visibility issue.
In keeping with the applicant's spirit of cooperation with the City of Campbell during this ,
project, we ask for careful consideration of the issues discussed below.

CAUSES FOR SIGN ORDINANCE EXCEPTION APPLICATION
The current application for exception proposes three (3) forty-eight (48) square foot wall
signs in lieu of the allowable two (2) (when the location is viewed as a corner property).
The substantiating reasons for this application for exception are as follows;
A.) There are four hardships in regard to visibility of the building's signage locations.
1) The current Pruneyard Mall center signage (located East of the applicant's
property) presents a complete visibility obstruction for Westbound motorists at
35(+/- ) feet or greater from the mouth of the Mall's ingress driveway (see
photograph #1). Therefore, it is reasonable to predict that many motorists
attempting to locate the restaurant will not identify the proposed East elevation
wall sign and may only identify the proposed South elevation wall sign. This will
result in motor vehicle traffic making ingress at the Pruneyard Mall entrance
located along the west property line.
2) Eastbound motorists' line -of -sight to the proposed West elevation wall sign is
completely obstructed by the tree foliage of three existing trees along Campbell
Avenue (see photograph #2). Therefore, it is reasonable to predict that many
motorists attempting to locate the restaurant will not identify the proposed West
elevation wall sign and will only identify the proposed South elevation wall sign
sometime within 80 feet of the Pruneyard Mall's entrance located along the east
property line of the restaurant.
3) The proposed South elevation wall sign suffers a hardship itself, due to the
placement of the building adjoining the South property line. The South wall sign's
face sets back only an approximate 14 feet from the face -of -curb along Campbell
Avenue (see photograph #3 and site plan). This short setback greatly diminishes
the line -of -sight and, thus, the visibility time for motorists traveling 35 miles an
hour in the westbound lanes of traffic (sre photograph #4). Therefore, one South
elevation wall sign will not adequately identify the restaurant; especially for
Westbound motor vehicle traffic.
Note: Due to the limitations off the sign ordinance in regard to a projecting sign's
encroachment over a public sidewalk and the design limitations in respect to the
layout of the trademarked Outback Steakhouse graphics program, a projecting
sign is not feasible for this sign location. A freestanding stand is also not feasible
due to the structure's roof extending completely to the south property line and,
thereby, creating an obstruction.

4) Location identification requirement is not restricted to motor vehicle traffic on
Campbell Avenue. It is greatly anticipated that many new restaurant patrons will
utilize other entrances of the Pruneyard Mall from the north, east and west
seeking to locate the restaurant. Therefore, signage is required along the East and
West building elevations to adequately identify the restaurant for motorists within
the Pruneyard Mall (see photograph #5).
B.) The application's proposed graphics program ifor this units architecture type) is utilized
in numerous locations throughout the United States and does not deviate from the
"standard" Outback Steakhouse graphics program which is commonly accepted among
municipalities. Therefore, the applicant is not seeking any unusual amount or type of
sign elements.
C.) The City of Campbell sign ordinance allows for only one (1) wall sign except in the
instance of the property adjoining two public streets; whereby, two (2) wall signs will be
allowed. The applicant asks the board to determine that the Pruneyard Mall's two (2)
ingress/egress driveways adjoining the applicant's property (see site plan) constitute
"public streets" and that three (3) walls signs are found to be permissible. Especially since
one of the two driveways' traffic is controlled by a City of Campbell traffic control
apparatus.
D.) Although there are no other similar "pad" located structures within the Pruneyard Mall's
property lines, there are at least three (3) instances of similar sign ordinance exception
precedence nearby. These three instances of precedence are;
1.) HICKORY PIT RESTAURANT - 980 E. Campbell Avenue
(see photograph #'s - 6,7,8)

faced illuminated monument sign.

GROUNDS FOR APPROVAL OF APPLICANT'S SIGN ORDINANCE
EXCEPTION APPLICATION
The applicant asks the Planning Board to approve the application "as is" based upon the
following grounds among any others deemed proper by the board;
A.) That Outback Steakhouse is a valuable addition to the community and will be an
establishment enjDyed by many citizens of the City of Campbell.
B.) That tt-,y success of Outback Steakhouse is of concern to the community in terms of
sales tax income and above average restaurant industry paying job creation.
C.) That Outback Steakhouse will draw many new visitors to the city each year and further
bolster the city's commercial economy.
D.) That the continued commercial development of the Campbell Avenue corridor relies
on the success of businesses situated there.
E.) That the above discussed visibility issues are present and that they do wrongfully impair
the business' ability to properly identify itself.
F.) That the applicant is not seeking any unusual types or amounts of signage.
G.) That without the number and type of signs proposed motorists would not have a safe
amount of time or distance to egress from Campbell Avenue into the Pruneyard Mall;
thereby, creating a public hazard.
H.) That all properties directly surrounding the applicant's property are zoned commercial
and, therefore, the application does not present any aesthetic: issue with
private residences.
I.) That the fact that the property is a freestanding structure adjoined by two heavily
trafficked roadways meets the spirit of allowing one (1) sign per adjoining public street.
J.) That there are numerous past exceptions to the sign ordinance with similar conditions
that grant more signage and other exceptions granted with less merit than this
application.
K.) That if the board found against this application for exception, it would be unfair
treatment under the law and denial of the substantial property rights of the owner.

Note: Due to the limitations off the sign ordinance in regard to a projecting sign's
encroachment over a public sidewalk and the design limitations in respect to the
layout of the trademarked outback Steakhouse grdphx s program, a prolvding
sign is not feasible for this sign location. A freestanding Bland is also not feasihke
