The Planning Commission finds as follows with regard to File No. SA 98-14.
1. The proposed 64 square foot round logo sign and the expanded "Market" sign below the "Whole
Foods" sign are architecturally compatible wits existing approved signs on the building and with
other signs within the shopping center, and are consistent with the approved Sign Prograrr for the
Hamilton Plaza Shopping Center.
_. The proposed size of the signs are proportional to the building.
3. The proposed lob' sign and expanded "Market" sign promote the economic viability of the Citv by
providing adequate i-em.fication and visibility of the recently expanded business. and would also
best serve the public welfare and be in keeping with the principles and purposes of the Cin 's sign
ordinance.
4. The subject site would best be served by the additional sign and sign area to allow additional
visibility of the market given the 280 foot distance of the market from S. Bascom Avenue.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes that
1. The proposed logo sign and expanded "Market" sign are consistent with the General Plan and ironing
designations for the site with approval of a sign exception.
2. The grocery market use would not be adequately identified without approval of the additional logo
sign and expanded "Market' sign.
3. The proposed signage will not be detrimental to the public welfare or persons in the neighborhood or
the City as a whole.
4. The proposed signage will n�� unnecessarily detract from the public health, safety and welfare and
are not indecent or offaisive to the senses.

BEING A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CAMPBELL APPROVING A MODIFICATION (M 97-15) TO
A PREVIOUSLY -APPROVED CONDITIONAL USE PERMIT (UP 94-
03) TO ALLOW THE EXPANSION OF AN EXISTING GROCERY
STORE ON PROPERTY LOCATED AT 1690 S. BASCOM AVENUE,
IN A C-2-S (GENERAL COMMERCIAL) ZONING DISTRICT.
APPLICATION OF WHOLE FOODS.. FILE NO. M 97-15 (UP 94-03).
After notification and public hearing, as specified by law, and after presentation by the
Community Development Director, proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did find as follows
with respect to application M 97-15 (UP 94-03)
1. The grocery store was established prior to the requirement for a use permit and is considered
a non -conforming use. The approval of the Modification to Use Formit 94-03 makes the
grocery store a conforming use.
2. The grocery store use is similar to other retail users in the shopping center.
3. The proposed use will operate consistent with the previously a7,proved use permit for the
property allowing off -sale beer and wine sales, outdoor seating, and operational hours to
10:00 P.M.
4. The proposal is consistent with the General Plan and Zoning designations which indicate a
commercial land use for this property.
5. The existing parking and circulation will adequately serve the proposed and existing uses on
site.
Based on the foregoing findings of fact, the Planning Commission further finds and concludes
that:
I. The proposed project will aid in the enhancement and the harmonious development of the
immediate area. The establishment, maintenance, or operation of the use will not be
detrimental to the public health, safety, peace, morals, comfort or general welfare of persons
residing or working in the neighborhood of such proposed use.
2. The proposed site is adequate in size and shape to accommodate the proposed use Rnd site

the approved project plans prepared by Suitt Associates and dated 9/2'97. Other uses
permitted under UP 94-03 allowing on -gale beer and wine sales, 20 outdoor seats, and
operational hours to 10 00 p.m. are permitted to continue
2. Building Permits. The applicant shall obtain all necessary Building permits prior to
construction of am improvements.
3. Noise Compliance. The applicant shall provide a noise report or sufficient information to the
Community Development Department, venfying the decibel level of the compressor unit that
will serve the refrigeration system for the proposed use. The decibel levels shall not exceed,
acceptable noise levels for evening hours identified at the Noise Eleinant of the General Plan
at the eastern property line adjacent to residential uses.

• The applicant, Whole Foods, previously known as Bread of Life, is seeking the :Modification
of a previously -approved Conditional Use Permit to allow the existing grocery store to be
expanded by ^„000 square feet by expanding into adjacent retail space as well as a 1,300
square foot expansion to the rear of the build.ne to accommodate warehouse'refrigeration
uses. Additionally, the application is proposing a minor facade change by replacing two
storefront windows with glass doors.
• Staff is supportive of the project as presented.
• The proposed use does not represent an intensification so additional parking is not required.
• SARC reviewed this project on October 16, 1997.
Commissioner Lowe presented the Site and Architectural Review Committee report as follows:
• SARC met on October 16. 1997, and was supportive of the project as presented.
Commissioner Gibbons asked what was being displaced by the 1,300 square foot addition at the
rear of the building.
Ms. Gloria Sciara replied that nothing will be displaced. At the rear of the building there is an
access roadway which will not be obstructed by this addition.

cellular antenna on an existing PG&E transmission tower
located on properry at Hamilton Avenue and Creekside Way
in a PF (Public Facilities) Zoning District. This project is
Categorically Exempt.
Ms. Gloria Sciara, Planner 11. presented the staff report as follows:
• The applicant is seeking approval to install four cellular antennas on an existing PG&E
substation located at Creekside and Hamilton Avenues.
• The site consists of four acres which are surrounded by commercial and office uses as well as
Highway 17.
• The proposed antennas would reach a total of 93.5 feet from the ground.
• A chain link fence with redwood slats would be installed around the equipment cabinets.
• Laidscaping exists on the site but staff feels that all areas are not properly screened.
Therefore, additional landscaping is proposed by staff.
• Staff finds that the placement of these antennas can be integrated on this site and that this is
an appropriate site for these antennas.
• With additional landscaping, staff is supportive. Staff will work with the applicants on the
placement of trees.
• SARC reviewed this project on October 16, 1997,
Commissioner Gibbons asked if this would be the tallest element around.

M 97-15 Public Hearing to consider the application of Whole Foods for approval
(UP94.03) of a Modification to a previously approved Conditional Use Permit to
Cullinan, M. allow a 9.000 square foot expansion, and a rear building addition, and
minor facade alteration on property ]mated at 16% S. Bascom Avenue
in the C-2-S (Neighborhood Commercial) Zoning District.
STAFF RECOMMENDATION
That the Planning Commission take the following action:
Adopt a resolution, incorporating the attached findings. approving a modification to a
previously approved Conditional Use Permit allowing a 9,000 square foot interior
expansion, a rear building addition, and minor alteration to the building facade, subject to
the attached conditions of approval.
ENVIRONMENTAL. DETERMINATION
This project is Categorically Exempt in accordance with Section 15301, Class I(a) of the
California Environmental Quality Act (CEQA). No further environmental action is
required.

DISCUSSION
Applicant's Request: The applicant is seeking approval of a modification to a previously
approved use permit to include the existing grocery store use, a 9,000 square foot interior
expansion (into the adjacent tenant space), a 1.300 square foot exterior warehouse
addition, and minor alteration to the front elevation.
Background: On May 24, 1994 the Planning Commission approved a Conditional Use
Permit allowing off -sale beer and wine sales, outdoor seating, and operational hours to
10:00 p.m. in conjunction w.:h an existing 12,352 square foot grocery store. At the time
that the use permit was approved, grocery stores were classified as a permitted use in the
C-2 (General Commercial) zoning district. The zoning ordinance has since been
amended to require conditional use permits for grocery stores in the commercial zoning
districts.
The current status of the grocery store is considered legal and non -conforming. In order
to expand an existing non -conforming use, the property must meet all current standards of
the zoning district. Therefore, the grocery store use, and the proposed expansion will

be included in approval of the modification of the existing use permit
ANALYSIS
General Plan and Zoning Consistency: The General Plan Land Use Map indicates
commercial land uses for the subject property, and is zoned C-2-S (General Commercial).
The proposal is a commercial use and is consistent witt. the General Plan, and with the C-
2-S zoning district, subject to approval of the modification to the previously approved use
permit by the Planning Commission.
Proiect Description: As described in the project description contained in the attachments.
the grocery store will continue to operate consistent with the previously approved use
permit (beer and wine sales/outdoor seating/operational hours to 10:00 p.m.). The
changes to the building and use will consist of the following:
• 9,000 square foot expansion into the adjacent tenant space.
• 1,300 square foot building expansion at the rear of the building for storage purposes.
• Replacement of 2 storefront windows of the adjacent tenant space with 2 automatic
sliding glass door units.
The plans indicate that building materials associated with the addition, and paint colors
will be consistent with existing materials and colors of the shopping center.
Parking: All uses on site operate under a shared parking arrangement under the previous
site approvals. The tenant space that the tenant proposes to occupy was previously
occupied by a retail use. Therefore, the proposed expansion does not result in an
intensification of the existing use and does not require additional parking.
SITE AND ARCHITECTURAL REVIEW
The Site And Architectural Review Committee (SARC) meeting was held on October 16,
1996. The Committee was supportive of the installation of the proposal as presented.

The following is the response to our telephone conversation on
October 6, 1997.
Nt Noise level of new roof top equipment:
We ere In the designing stage now. It is too early to know the total
equipment needs for the entire project. When all of the eauiN-lent is
finally decided upon we will make sure that the noise level at the
property line will be at or under that allowed by the toning ordinance.
This will be achieved by whatever means necessary. The equipment
uperates 24 hours at day.
#2 Trash compactor:
There is no trash compactor at the site now. There is only a trash
container. This container will be located inside the new warehouse
area.

Supplemental Application
PtaPOSE
A Use Permit allows for spacial consideration of certain
specified was which may be mmpstible with an area
depmdlrq on the spanks of the prtkviar crass. The Us
Permit proms is designed to provide the City sufficient
flexibility to determine whether a specific led use on a
certain site will be compatible with Its envlrom and the
Cneal Plan.
PROCESS
Prolect Consideration f; =polication Review: In
reviewing a use permit application, the staff and Planning
Commission will evaluate such items as building plscemmt
and sin, traffic generation, polar, hours of operation,
adequacy of puking, circulation, drop-off facilities and
overall compatibility of use with adjoining properties. It is
recommended that the applicant submit a preliminary
proposal to the Planning Department prior to submission of
the formal application. This will allow the Planning staff
to review the requrs and inform the applicant of possible
concerns minted to the proposal.
Filing of Apillication: The applicant should submit a
completed application, filing fee, a written statement and
other required information to the Planning Department. A
planet will be assigned to review the material to make sure
all the required information is providel. The applicant will
be notified within 30 days as to whether the application is
that additional information is required.
Epylronmental Review: Typically, use permits are
categorically avempt from the environmental review procass.
Site • d Architectural Review Committee (SARC): Use
permit applications Involving exterior modifications require
review by SARC. The Committer reviews the application
for site layout and building design and then forwards a
recommendation to the Pinning Gomrmlaston
Staff Review: The Planning staff -III revises the
application and conduct a site investigation to determine ine the
relationship of the request with the Clty's Cereal flan, and
10 sorely» lard uak traffic, site plat, and othr impaus or
concern of the proposal project. A wrftien staff report will be
prepared for the Planning Comurrission 000 that include;
atafrs recommendations and a description of the developowd
proposal. A copy of this report will be sent to the applicant
during the week prior to the PC hearing on the application.

Public Notice: All use permit applications require a public
haring, which is Kid durt:.g the Planning Commission
meeting. At laws ten days prior to the mseting, property
owners within 300 feet of the site will be notified by mail of
the public having and a notice will be published In the
Campbell E press.

report and recommendation for your application. This
presentation will be followed by testimony from the
applicant and then by any Intenssted persons who may wish
to comment on the application. The Planning Commission
may then cos the public hawing and make a derision
approving or conditionally approving the request, denying
the request, or postponing the decaren to a War dew Unless
an appeal Is filed, the Planning Commission's decision will
become final unless ratification Is required by the City
Use Permits do not go to the City Council unless the Planting
Commission's decision Is appealed within tm calendar days.
