Pursuant to Sections 21.40.010, et seq., of the Campbell
Municipal Code, Fred N. Sahadi is hereby granted a Special
Development Permit to construct a ten -story office building
on property 'located at 1999 South Bascom Avenue. Said property
being more particularly described in an application filed in
the office of the Planning Department on November 29, 1971.
Said approval subject to the following conditions:
1. Property to be fenced and landscaped as indicated
and as added in "red" on plans.
12. Landscape plan indicating type of plant material,
location of hose bibs or sprinkler system and type
of fencing to be submitted for approval of the Planning
Director at time of application for building permit.
All planter areas to be enclosed within 4" to 6"
raised curbs.
3. Landscaping shall b. maintained in accordance with the
approved landscape plan.
4. Faithful performance bond in the amount of �,S,OOC to
be posted to insure landscap-ng, fencing and striping
of parking area within three (3) months of completion
of construction, or applicant may file written agree-

Code. All parking spaces to be provided with appropriate
curbs or bumper guards.
6. Underground utilities to be provided as required by
Section 20.16.070 of the Campbell Municipal Code.
7. Plans submitted to the building department for plan

tions for underground utilities including water, sewer,
electric, telephone and television cables, etc.
8. Sign application to be submitted it accordance with pro-

RECOMMENDATION:
Approval eubject to the attached conditions (6-0 vote,
1 absent).
After considerable discussion concerning the merits and k
compatibility of the 10-story building, existing and
proposed parking, and landscaoing, the Planning Commission
-unanimously voted for approval of the proposed use. (1 absent)
The following comments are related to the subject proposal.
The 10-story building is proposed to have a gross floor
area of 123,200 square feet and a height of 140 feet on a
site that has 138,000 square feet of undeveloped area. }
It is the applicant's intent, however, to combine the 10-
story building site with the 18-story building site and j
have both on one parcel. The resulting narking ratio of number, {f
of spaces to gross floor area would be in accordance with
the original site approval, "S" 68-65, approved by the Planning
Commission in 1968. The ratio approved at that time was one
space for each 300 square fe:t of gross floor area. Specif°.c
comments by the Commission were made that a relatively large
amount of floor area was taken up with elevator shafts and
stairways that would not be found in one and two-story office
structures.
A summary of the parking situation is as follows:
Existing 18-story building 1/300 ratio 100,000 sq. ft. 333 spaces
Proposed 10-story building 1/300 ratio 123,200 sq. ft. 410 spaces

The plans indicate a total of 830 parking spaces on the
total site, which results in a parking ratio of one space
for each 283 square feet of gross floor area.
It should be noted that the applicant has submitted a
survey indicating existing square footage of occupied floor
area in the 18-story building by tenant, number of employees
and number of cars. The results indicate that 77,840 square
feet are occupied, total number of employees are 415. Floors
9, 12, 17 and 18 are unoccupied.

Commissioner Pack was concerned about the distanca between the
eighteen and ten -story buildings. Mr.Kee advised it would be
approximately 300 feet.

Commissioner Hebar°. seated he did not understand the figures that

Chairman Scott stated that these zr.a cers owned by people who are
employed in the center. It does not necessarily mean that taey are
there eight hours a day. They are for the most part in and out
of the center.
Mr. Kee advis-=d that a high percentage of the employees work out
of the building but are for the most part in the field. Staff
was concerr.ad and asked the applicant for a survey and these surveys
have been presented to the Ccmmission.
Commissioner Hebard stated that if there is not enough packing
available, it is not going to create a problem for anyone else -
only for t..e development. He stated that he was not opposed to
this building, Lut they are being asked to give approval to
another tall building in Campbell without any statement from the
community in terms of the Ceneral Plan or any other manner of the
community's attitude towa_d tall buildings. He addec that they
have not asked the community in public hearirgs fir an opinion
on what the community wants in terms of high rise :aildi.ngs.
He statod they had an application for another tall building on
the other side of town and he was of the opinion that they
might be speaking for the community without hearing from them.
Commissioner Paul stated that if there is one development in
Campbell that has received praise, it is the Prune Ya.^d. In a
public hearing a few weeks ago people from the commmunity exprecscd
their acceptance of Mr. Sahadi's development. fie stated that he
has never heard anyone say they didn't want an eighteen -story build-
ing. He thought the ten -story building would be very compatible
with the surrounding area.
Commissioner Pack stated that the last issue of the Campbell Press
had an article on this agenda and no one has appeared at the
hearing to oppose this proposal.
Chairman Scott also stated that at the last Planning Cummission
meeting people in the audience praised the Prune Yard development
and he wan of th•e opinion that they were talking about the whole
concept of the development.
Commissioner Stewart stated that 'f here is any location in
Campbell that would be compatible to receive another high risa
building, this would be the area. He a.kel Mr. Kee about the
landscape requirements for this development.
Mr. Kee stated that 10% of the area vo••.Lih a to be in lendscz.ping.

Enclosed herewith please find a survey of tenants, the square footage
that they occupy, the absolute number of employees working out of that
space and the number of automobiles that use the lot per space on a
daily basis, together with the name of the person from whom the infor-
mation was acquired insofar as each individual tenant is concerned.
In addition, please find a certification by Jay Cross, of my staff,
for the number of automobiles actually parked in The Towers parking
lot at 11:00 a.m. and 3:00 p.m. on Tuesday, November 23, and Wednesday,
November 24. An interesting corollary to the number of cars actually
in the parking lot is the number of vacant spaces unoccupied which is
set forth in Mr. Cross's study. In addition to the enclosed, we will
run the parking lot occupancy survey for one Hill week commencing
Monday, November 29, and running through Friday, December 3.
In support of the above information, some points of clarification may
be of interest. The Towers office building is a classical example of
high rise suburban office space, which is a relatively new concept in-
sofar as office space is concerned nationwide. By far the great

majority of high rise office space is built in downtown core areas
where the cost of land is so great that the only economic basis +or
development is building vertically. In every instance, and all of the
national averages are based on this type of occupancy, the tenants

occupying the space work and reside daily in the leased premises and
all of their customers and business clients visit the office. The

for Towers II is better, if that is possible, than the parking provided
for Towers I, which parking has proven to be far in excess of actual
parking requirements. With the investment that myself and my Joint
venturer will have in Campbell and in the Towers I and II development,
please be assured that we are as interested, if not more inter-sted,
in providing adequate parking to maintain the integrity and value of
both buildings over a period of time. We feel that the application
submitted herewith does Just that. Needless to say, I would be pleased
to furnish you with any additional information that you mey require.

heavy not only insofar as the tenants and tenants' employees are
concerned, but the parking problems are further compounded by the
tenants' clients and customers who also conduct their business on the
p- -es.
In char, contrast to the above mentioned type of tenant and uses, yno.
fi-- the Towers office building and all high rise suburban office
sp- generally. The pattern in The Towers, almost without exception,
is a type of occupancy where the great majority of all of the people
operating out of the tenants' space go elsewhere to conduct their busi-
ness and, in fact, very seldom attend the home office. The desira-
bility of said space is couched not on the '_cation but primarily on
the ease of access as it affects the tenants' employees and virtually
no consideration is given to business visitors. Examples of this in
The Towers are all of the executive offices of the large, national
insurance companies such as New York Life, Equitable. Life Assurance
Society, Metropolitan Life, Royal -Globe Insurance, Pacific Mutual
Life, Provident Mutual Life, and Aetna Insurance. In addition, another
good example is the Vintage Investment Properties realty office which
employs 35 people, but which actually occupies :.ess than 5 parking
spaces on a day to day basis. The Towers and the image that The Towers
represents, without exception, has primarily drawn very low density
users such as attorneys and small executive offices on the one hand,
and the large national insurance companies or divisions of large
national companies with a small permanent 3tnff ana a large outside
staff conducting all of their business off the prem:.ses. Conspicuously
absent from The Towers is a classification of tenants such as national
accounting firms, who not only have a high census per square foot but
also enjoy traffic from their cun!Dmers and clients. ':'hese users tend
to locate in downtown areas close to their clients as opposed to the
type of users that occupy suburban office space. It is abundantly clear
that all of the national averages insofar as parking space per square
foot of occupancy have been based, up to this point in time, on the
high census, heavy traffic, downtown users such as the national account-
ing firm type tenant above referred to.
The enclosed analysis, then, is offered in support of the parking ratios
applied for to complete The PruneYard development insofar as Towers II
is concerned. A careful analysis will indicate that the parking provided

Pursuant to Sections 21.40.010, et seq., of the Campbell
Municipal Code, Fred N. Sahadi is hereby granted a Special
Development Permit to construct a ten -story office building
on property located at 1999 South Bascom Avenue. Said property
being more particularly described in an application filed in
the office of the Planning Department on November 29, 1971.
Said approval subject to the following conditions
1. Property to be fenced and landscaped as indicated
and as added in "red" on plans.
,2. Landscape plan indicating type of plant material,
location of hose bibs or sprinkler system and type
of fencing to be submitted for approval of the Planning
Director at time of application for building permit.
All planter areas to be enclosed within 4" to 6"
raised curbs.
3. Landscaping shall be maintained in accordance with the
approved landscape plan.
4. Faithful performance bond in the amount of $5,000 to
be posted to insure landscaping, fencing and striping
of parking area within three (3) months of completion
of construction, or applicant may file written agree-
ment to complete landscaping, fencing and striping of
parking area prior to final building department clear-
ance.
5. All parking and driveway areas to be developed in com-
pliance with Section 21.50.010 of the Campbell Municipal
Code. All parking spaces to be provideu with appropriate
curbs or bumper guards.
6. Underground utilities to be provided as required by
Section 20.16.070 of the Campbell Municipal Code.
7. Plans submitted to the building department for plan
check anall indicate clearly the location of all connec-
tions for underground utilities including, water, sewer,
electric, telephone and television cables, etc.
8. Sign application to be submitted in accordance with pro-
visions of the sign ordinance for all signs. No sign to
be installed until application is approved and permit
issued by the building department.
9. Applicant to process and file parcel map for minor

Plans shall show compliance with all state laws and

Building at 761 East Campbell Avenue
in a C-2-0 Zone.
RECOMMENDATION:
Approval subject to the attached conditions (6-0 vote,
1 absent).
DISCUSSION:
After considerable discussion concerning the merits and
compatibility of the 10-story building, existing and
proposed parking, and landscaping, the Planning Commission
unanimously voted for approval of the proposed use. (1 absent)
The following comments are related to the subject proposal.
The 10-story ',wilding is proposed to have a gross floor
area of 123,200 square feet and a height of 140 feet on a
site that has 138,000 square feet of undeveloped area.
It is the applicant's intent, however, to combine the 10-
story building s4.te with the 18-story building site and
have both on one Parcel. The resulting, parking, ratio of number
of spaces to gross floor area would be in accordance with
the original site approval, "S" 68-65, anpr,,ved by the Planning
Commission in 1968. The ratio approved at that time was one
space for each 300 square feet of gross floor area. Specific
comments by the Commission were made that a relatively large
amount of floor area was taken up with elevator shafts and
stairways that would not be found in one and two-story office
structures.
A summary of the parking situation is as follows:
Existing 18-story building 1/300 ratio 100,000 sq. ft. 333 spaces
Proposed 10-story building 1/300 ratio 123,200 sq. ft. 410 spaces
Future wing building 11300 ratio 6,000 sq. ft. 20 spaces
Future wing building 1/300 ratio 6,000 sq. ft. 20 spaces
TOTAL 235,200 sq. ft. 783 spaces

The plans indicate a total of 830 parking spaces on the
total site, which results in a parking ratio of one space
for each 283 square feet of gross floor area.
It should be noted that the applicant has submitted a
survey indicating existing square footage of occupied floor
area in the 18-story building by tenant, number of employees
and number of cars. The results indicate that 77,840 square
feet are occupied, total number of employees are 415. Floors
9, 12, 17 and 18 are unoccupied.
An additional survey was also made concerning use of the
existing parking area by date, time, and number of filled
and vacant parking spaces. An average for the seven day
survey follows:

SECTION 21.40.020 PER'
REQUIRED. No use shall be estab-
lished upon property in any zoning district with which the "0"
district is combined unless a special development permit is first
issued by the City Council.
SECTION 21.40.030 USES TO COMPLY WITH PERM17 .
Following issuance of a permit.
a. No use shall be established or any building er
structure constructed or altered, upon property in any district
with which an "0" district is combinedi except in strict conformity
with the permit.
b. No use sb^ll be established or changed, or any
building or structure �.ructed or altered, in a manner which
would not comply with _ rel;ulntions of the zoning district with
which the "0" district is combined except for the modification
specifically authorized by the "0" district regulations, in strict
conformity with the permit issued and all conditions or require-
ments attaclied thereto.
SI:CTIOti21.40.040 PERMIT CONDITIONS.
In connection with the issuance of any special development
ppermit, the City Council may attach such conditions or requirements
in addition to those expressly provided for in this chapter, the
o Subudivisi, chapter, or other nnplicable provisions of the Camppbell
Municipal Code, as the City Council finds necessary to attain tlne
objectives and purposes of this section, or to insure that the
general appearance or the buildings or structures, or the uses
to be made of the property to which the application refers, will
not imoair either tine orderly deve-:,pnent of, or the existing uses
being made of adjacent properties.
SECTION 21.40.050 PERMIT: APPLICATION.
Applications for a special development permit shall be filed
With the Planning Department on forms furnished for this purpose,
and shall be accompanied by payment of the fee of $2S.00.
SECTION 21.40.060 SODIdISSION OF PLAN: CONTFINTS.
A site development or similar plan shall be submitted in
connection with each :-iplication of such scale and in such number

of copies as may be required containing sufficient information to
identify the following:
a. Each proposcJ use.
b. Location and type of:
1. Proposed buildings and structures including
height, exterior elevations, and types of
exterior materials and colors;
2. traffic and pedestrian ingress and egress and
circulation;
3. oj:f-street parking and loading facilities;
4. casements;
S. signs may be erected in accordance with the
provisions of Section 9330 through 9330.8;
6. landscaping including tree pres-rvation;
7. exterior lighting;
S. walls and fences or other devices used for
screening or separation;
9. property boundary lines; and
10. proposed reshaping of the earth, together with
any other supporting data required by the
Director of the Planning Department.
ARCHITECTURAL REVIEW COMNITTLE, PLANNING
COMMISSION AND CITY COUNCIL.
The architectural review c,mmittec shall consider each appli-
cation, together with a report thereon from the Director of the
Planning Department and shall report its findings and recommendations
concerning each application to the Planning Commission. The
Planning Commission shall report its findings and recommendations
to the City Council prior to the date upon which the City Council
shall hear and determine such application.
SECTION 21.40.070WHEN USE PERMIT NOT REQUIRED: VARYING
CERTAIN RLQUIRLNENTS: NOTICE PUBLICATION
AND POSTING REQUIRED.
.a. No Use Permit, otherwise required by the regulations of
the zoning district with which an "0" District is combined, shall

be required for uses, or buildings or structures, permitted in
an approved special development permit.
b. At the time of approving a special development permit
the City Council may allow lot area, lot width, open space and
ye-d, height, and parking space requirements varying from and
different than those which would otherwise apply in the zoning
district with which the 110" district is combined.

e. Notice of the time and place of any public hearing in
connection with the granting or revocation of a special develop-
ment permit shall be given by one publication at least ten (10)
days prior to such hearing, in a newspaper of general circulation
in the City designated for that purpose by the City Council, and
notice of the application shall be posted on the property to which
the application applies, ten (10) days prior to said hearing.
SECTION 21.40.ng0 PERMIT; iiI11iN VOID.
An approved special. development permit shall expire and
become null and void if the permit leas not been used within one
(1) year after the date such permit was approved. Commencement
of construction of the buildings or structures, or the establish-
ment of the use, which are the subject of the permit, shall consti-
tute commencement of the use of the permit, but such commencement
must be brought to completion within one year from issuance of
the permit unless th_ time is cx tended by the Ctiy Council on
showing of good cause.
SECTION 21.40.090 PER;111'; REVOCATIO`
A special development permit may be revokes' by the City Cow,cil
after a public hearing thereon when the City Council finds a
violation of, or a non-compliance with the conditions, or any of
them of the granting of the permit.
SECTION 21.40.100 EXCEPTIONS
An exception to any or all of the conditions or requirements
of the "0" District may be recommended by the Planning Commission
and granted by tine City Council upo;, the written application of
the owner of property in any zoning district with which an "0"
District is combined, provided that the Planning Commission and
the City Council each find and determine that the special conditions
and situations no longer exist which resulted in the addition of an
overlay district designation _o the zoning distri,-t in which the
property was placed, that the exception is necessary for the preser-
vation and enjoyment of a substantial pronerzy right of the appli-
cant, and the granting of the exception will not be materially detri-
mental to the public welfare or injurious to other property,
improvements or uses within the immediate vicinity of and within
the same zoning district as the property which is the subject of
the application.
