After due consideration of all evidence presented, the Corriission did find as follows: 1. Mr. Kee advised that the staff recon-ez:6ation is that this item be removed from the agenda or continued until the applicant has submitted a subdivision map which complies with the subdivision ordinance of the City of Campbell. Chairman Hebard declared the public hearing open and asked if anyone wished to be heard. Mr. rred N. Sahadi, applicant, stated t?.at there is a question in his mind as to whcther or not the ordinance in question, which Mr. Kee has referred to as the basis for the continuance recommen- dation, applies. lie did not think that it is something that should take the Commission's time. There is some language in the ordinance to indicate that it does apply and sons that it does not apply. The parcels were created to accommodate the tax assessor's office and have no other purpose. He asked that the Commission consider the parking, structure and the Planning :)irector, City Attorney and other department heads could meet and resolve this problem. This would save the matter from coming back to the Commission again. He stated that he would be agreeable to having the matter continued, however, he did not think that it should require a whole lot of activity. Ile stated that they could approve it or deny it subject to the City Attorney, Building Official, and Planning Director being satisfied. In his opinion, it was merely an interpretation of the language of the code. Mr. Kee stated that the staff is prepared to recoum.end approval of the parking structure. The plans he-.- been circulated to the various departments, but their comments have not been included in the staff report. Chairman Hebard stated that he was concerned with the parking structure -12- and he asked how the Commissioners .nit about it. STAFF RECOMMENDATION: That this item be removed from the agenda or continued until the applicant has submitted a subdivision map wllicll complies with the subdivision ordinance of the City of Campbell. STAFF DISCUSSION: This proposal is for a one-story parking structure which would cover approximately 78,000 square feet of the existing parking area at the northwest corner of the Prune Yard development just north of the Towers. The proposal would provide for approxi- mately 238 additional parking sPacts. It is the staff's opinion that the parking structure is desirable, particularly when viewed in relation to the successful nature of this commercial center. The staff connot recommend approval, however, due to the fact that some fourteen parcels have been created according to the assessor's maps since 1969 without meeting requirements of the Campbell Municipal Code; specifically, the subdivision ordinance which requires city approval for the creation of such parcels. In regard to this project, Section 20.041.030 of the Subdivision Ordinance reads in part as follows: ..No building permit or any other kind of permit issued by the City shall be issued to any applicant to be used in connection with or pertaining to any premises or portion thereof which has at any time been subdivided in violation of this title and not corrected as provided in ibis title. Central Avenue Campbell, California 95008 Dear Art: Pursuant to our last conversation, I have undertaken an invest . - tion of a redesign of the proposed deck for The PruneYard - Towers. It appears that the redesign program is materially more involved than I had originally anticipated and as a result, I will have to have an additional amount of time to pursue that alternative. Compounding that problem has been the fact that I have been ill almost continually for the last thirty days with whatever the flu is that seems to be around, one day up, one day down, and have gotten very little accomplished. To further compound the problem, the new proposed Environmental Protection Agency's rules and regulations would absolutely place us in baLkruptcy and the proposed deck would, of course, compound that problem. For the above reasons, I will ask that you continue our public hearing on the proposed deck for ninety days so that the design studies may be completed and the new elevations prepared and sub- mitted to the planning director and the building department for review. With tho holidays coming up, nothing ever seems to get done, as you well know. A review of the City's records and earlier Assessor's Rolls indicates that the shopping center area has apparently been divided into several parcels without adhering to the City and State regulations regarding subdivisions of land. Accordingly, it would seem that the City should take the necessary actions to insure conformity with these regulations. The records indicate that as a condition of Special Development Permit No. 7 granted in November, 1971, a parcel map was required to define the proposed lines in the v..cinity of the ten -story building. Proposed buildings and structures including height, exterior elevations, and types of exterior materials and colors; 2. traffic and pedestrian ingress and egress and circulation; 3. off-street parking and loading facilities; 4. easements; S. signs may be erected in accordance with the provisions of Section 9330 through 9330.8; 6. landscaping including tree preservation; 7. exterior lighting; S. walls and fences or other devices used for screening or separation; 9. property boundary lines; and 10. proposed reshaping of the earth, together with any other supporting data required by the Director of the Planning Department. ARCHITECTURAL REVIEW COMMITTEE, PLANNING COMMISSION AND CITY COUNCIL. The architectural review eonmittee shall consider each appli- cation, together with a report thereon from the Director of the Planning Department and shall report its findings and recommendations concerning each application to the Planning Commission. The Planning Commission shall report its findings and recommendations to the City Council prior to the dates upon which the City Council shall hear and determine such application. SECTION 21.40.070MILN USE PERMIT NOT REQUIRLD: VARYING CERTAIN REQUIREMENTS: NOTICE PUBLICATION AND POSTING REQUIRi:U. II a. No Use Permit, otherwise required by the regulations of the zoning district with which an "0" District is combined, shall -2- J be required for uses, or buildings or structures, permitted in an approved special development permit. b. At the time of aplroving a special development permit the City Council nay allow lot area, lot width, open space and yard, height, and parkinE space requirements varying from'and different than those which would otherwise apply in the zoning district with which the "0" District is combined. e. Notice of the time and place of any public hearing in connection with the granting or revocation of a special develop- ment permit shall be given by one publication at least ten (10) days prior to such hearing, in a newspaper of general circulation in the City designated for that purpose by the City Council, and notice of the application shall be posted on the property to which the application applies, ten (10) days prior to said hearing. ,SECTION 21.40.0.80 PERMIT; WHEN VOID. An approved special development permit shall expire and become null and void if the permit has not been used within one (1) year after the date such permit was approved. Commencement of construction of the buildings or structures, or the establish- ment of the use, u-hich are the subject of the pernit, shall consti- tute commencement of the use of the permit, but such commencement must be brought to completion within one year from issuance of the permit unless the time is ex tended by the Ctiy Council on showing of good cause. SECTION 21.40.090 PERMIT; REVOCATION A special development permit may be revolved by the City Council after a public hearing thereon when the City Council finds a vioJation of, or a non-compliance with the conditions, or any of them of the granting of the permit. SECTION 21.40.100 EXCEPTIONS An exception to any or all of the conditions or requirements of the "0" District may be recommended by the Planning Conmission and granted by the City Council upon the written aPplfcat. of the owner of property in any zoning district with which an "0" District is eonbined, provided that the Planning Commission and the City Council each find and determine that the special conditions and situations no longer exist which resulted in the addition of an overlay district designation to the zoning district in which the property was placed, that the exception is necessary for the preser- vation and cnjoyrient of a substantial property right of the appli- cant, and the granting of the exception will not be materially detri- mental to the public welfare or injurious to other property, improvements or uses within the immediate vicinity of and within the same zoning district as the property which is the subject of the application. -3- L� J ■ Cla:'I'3'f.
