PUBLIC HEARINGS
UP 70-7 This being the time and place for public
Baker Trailer hearing on the application of Baker Trailer
Sales Sales for a Use Permit to allow the use of a
building originally designed for residential
purposes to be used for general office pur-
poses in accordance with the Campbell Muni-
cipal Code requirements, said property located
at 2106 South Bascom Avenue in a C 2-S Zone,
Chairman Grim asked the Planning Director for
his report.
Mr. Kee reported that this is the first application under the
recently adopted ordinance revision allowing the conversion of
residen-cial structures. He stated that the staff is of the
opinion that with a proper redesign the building would be
appropriate for office uses in accordance with requirements of
the zoning code. Therefore, it is recommended that the applica-
tion be approved subject to five conditions, including the re-
quirement for architectural and site approval for the proposed
changes.
Commissioner Healey asked Mr. Kee if the many zoning violations
on this property have been corrected. Mr. Kee stated that they
have not.
Commissioner Lyons ques+.Aoned the advisability of acting on the
request since the city attorney is not present.
After discussion, it was decided to hold the public hearing and
reserve the right to not act on the matter until after checking
with Mr. bonacina.
Chairman Grim declared the public hearing open and asked for ccm-
ments from the applicant.
Attorney James Gansinger, representing the owner, Mr. Beardsley,
stated that they are asking to continue the use which has extrted
for many years. He presented a drawing which showed the proposed
modifications to the structure.
Commissioner Pack asked if they would agree to completing the
landscaping and fencing which had been previously required.
Mr. Gansinger stated that they had no objections to complying
withithe staff recommendations.
Commissioner Paul asked if the ordinance was intended to be used
for this type of office. It was decided by the commission that
this application was proper under the ordinance.

With no one further to speak on this matter, Commissioner Scott
moved to close the public hearing, seconded by Commissioner Lyons
and unanimously adopted.

Resolution five conditions listed by staff and the
No. 10).5 addition of condition No. 6, allowing for
review by the city attorney. Motion seconded
by Commissioner Pack. Motion adopted by

Baker Trailer Sales for a Use Permit to allow the use of a
Sales building originally designed for residential
purposes to be used for general office purposes
in accordance with the Campbell Municipal Code
requirements. Said property located at
2105 South Bascom Avenue in a C-2-S Zone.
STAFF RECOMMENDATION:
Approval, subject to the following conditions:
1. Plans to be submitted for architectural approval.
2. Applicant shall comply with all conditions as required by
approval.
3. The Use Permit shall become null and void one (1) vear from the
date of its granting if construction has not begun in accordance
with approved plans.
4. Applicant to post faithful performance bond in the amount of
$5,000 to assure completion of landscaping, fenci-og and necessary
alterations at the time application is made for a building permit.
5. Existing building shall be made to comply with building_ codes
for an office building.
STAFF DISCUSSION:
At the time of annexation proceedings of this property to the City
of Campbell, Mr.James Baker located his business office and residence
on the subject property. The storage of travel trailers, as well as
rental and sale, was also established.
On December 23, 1963, Use Permit 1963-6 anu "S" 60-51 were granted
to Mr. Baker subject to obtaining necessary permits for a new
commercial building which had been constructed on the site and sub-
ject to removal of the existing, residential building. A bond for
removal of the residence was posted and has since expired.
On January 8, 1964, Variance 63-7 was granted to Mr. Baker allowing
him the use of the R-1 zoned property at the rear of the main opera-
tion to be used for the storage of trailers. The use was conditioned
upon approval of fencing or landscaping of the entire area and sub-
ject to approval by the City staff.

After a considerable period of time conditions of the original
approvals had not been completed and default proceedings were
started. However, the zoning code was amended during this period
of tame to permit residentially constructed buildings located in
commercial zones to be converted to office uses subject to securing
a use permit and an application has now been made for that purpose.
The staff is of the opinion that with a proper redesign the building
would be appropriate for office uses in accordance with requirements
of the zoning code. A copy of the code related to this subject is
attached and particular attention is directed to Section 9328.7-3.

SECTION 9328.7 USE OF RESIDENCE IN P-0, C-1, C-2 AND C-3 ZONES
SUBJECT TO SECURING A CONDITIONAL USE PERMIT

No residential structure existing at the time of the adoption
of this ordinance shall be hereafter structurally altered, expanded,
changed or enlarged except for the following uses:
1. Offices: subject in all cases to approval in accordance
with the provisions of Section 9316.
A. Administrative or Executive Offices: Iffice Manage-
ment operation, the direction of entexorises, and
similar uses but not including merchandising or
sales service.
B. Professional Offices: Offices devoted to the practice
of the professions and arts, including, but not limited
to architecture, dentistry, engineering, law and medicine,
but not including the sale of drugs or prescriptions
excapt as incidental to the principal use and where
there is no external evidence of such incidental use.
C. Mi3cellaneou.-� Offices: Other office uses as approved
by the Commission, excluding merchandising.
2. The conversion of any residential building shall be made
to comply with all building and fire code requirements
for the type of occupancy and shall comply with all other
applicable codes of the City of Campbell.
3. Exterior appearance of buildingRrrfROlM dconverted to office
uses shall be related in appearance to buildings designed
for office purposes.
a. Provide on -site park°ng as required by Section 9319
of the Campbell Municipal Code.
b. Meet setback requirements for the zoning district ir,
which said use permit is requested.
4. Any use permit grant-d under this section shall apply only
to the use requested and shall not be deemed to be a con-
tinual use permit for any other office use. Any subsequent
change of use shall require application and approval of a
use permit prior to such change or occupancy of said
building.

EXISTING IMPROVEMENTS
On the property described as Parcely'.34t-4AR-ftfI&
j6.7, bordered in the East by South Bascom Avenue and in the
West by Michael Drive, Local Imnrovement District #18, there
currently exists three buildings used in the operation of
Baker Trailer Sales. The first of these buildings is the
main office and management building for the comnany. This is
a two story structure situated close to South Bascom Avenue.
The second structure on the premises is a one
story service shoo and Parts store.
The third existing building is a one story Parking
garage.
In addition to the three existing buildings,
approximately one and one half to two acres of the five acre
total area is paved over for use as client parking and
trailer storage.

PROPOSED IMPROVEMENTS
Baker Trailer Sales proposes to make improvements
to the large two story general office buildinv already
existing. The proposed improvements, designed to improve
both the outward appearance of the building as well as
facilitate the use of the offices already in existence,
include the installation of a door on the left side of the
front office section, the installation of sliding glass panel
doors on the front, and the installation of a redwood deck
immediately adjacent to the front of the building.
In addition to the nroposed structural improvements,
the applicant also intends to comnletel,y repaint the building,
outside and in, and retrim the outside.
The estimated cost of the nroposed imnrovements
is approximately $10,000.90.

JUSTIFICATION
Baker Trailer Sales wishes to make the improvements
described on page 7 in order to improve the appearance of
the property and to facilitate the use of the already
existing offices. The installation of a second door in
addition to the one already existing on the right front
section of the building will facilitate access to and from
the offices by both clients and office personnel. The
sliding glass doors on the front of the building will improve
both the appearance of the building and lightinv in the
front offices. Installation of the redwood deck is designed
essentially to increase the aesthetic quality of the building.
