UP 81-08 This is the time and place for a public hearing
Perrone, C. to consider the application of N.r. Clement
Perrone for a use permit to allow the estab-
lishment of a cocktail lounge and approval of
an on -site liquor permit for property known
as 1"77 S. Bascom Avenue in a C-2-S (General
Comsercial) Zoning District.
Mr. Kee explained that the applicant is applying for a use permit to serve
alcoholic be,,erages in a proposed cocktail lounge. The proposed lounge is
located within an existing commercial building and will occupy approximately
4,400 square feet.
Staff has referred this application to the Police and Fire Departments
for their comments. The Fire Department has recommended four conditions
of approval and the Police Department had no comment on this application.
He stated Staff is recommending approval of this application, subject to
conditions listed in the Staff Comment Sheet.
Chairman Kasolas opened the public hearing and invited anyone in the
audience to speak for or against this application.
Mr. Leonard Licardo, representing the applicant, appeared before the Commission
to answer any questions. He noted that the owner had hoped to make this a
quasi -private club, with possibly a door charge.
Commissioner Campos inquired as to what would constitute a member.
Mr. Licardo responded that the owner hoped to have a pre -paid door charge,
with reservations being made in advance.
M.. Bob Miller of Ortho Mattress appeared before the Commission to explain
that he is not in favor of this proposed use. He noted that one of the uses
his company tries to avoid being adjacent to is cocktail lounges. He further
noted that he felt there might be a parking oroblem. He stated they are open
five nights a week .ntil 9 p.m. He also felt there would be a problem with
the loud music.
Mr. Licardo stated that it is the intent of the owner to not have any live
music until after 9 p.m., and he did not feel there would be any conflict
whatsoever.

No one else wishing to speak, Commissioner Meyer moved that the public
hearing be closed, seconded by Commissioner Pack and unanimously adopted.
At this time Commissioner Dickson announced that he would be abstaining
on this application since he is morally opposod to this type of use.
RESOLUTION NO. 2002 Commissioner Meyer moved that the Planning
Commission adopt Resolution No. 20C2 approving
a use permit to allow the establishment of a
cocktail lounge and approval of an on -site
liquor permit for property known as 1777 S.
Bascom Avenue in a C-2-, (General Commercial)

RESOLUTION NO. 2002
After notification and public hearing as specified by law on the
application of Mr. Clement Perrone for a use permit to allow the estab-
lishment of a cocktail lounga and approval of an on -site liquor permit
for property known as 1777 S. Bascom Avenue in a C-2-S (General Commercial)
Zoning District, as per application filed in the Office of the Planning
Department on April 7, 1981, and after presentation by the Planning Director,
proponents and opponents, the hearing was closed (UP 81-08).
After due consideration of all evidence presented, the Commission
did find as follows:
That the establishm?nt, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort or general welfare of persons residing
or working in the neighborhood of such use, or be detrimental
or injurious to the property and improvements in the neighborhood
or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby gran,
the requested use permit subject to the following conditions:
A. Sign application to be submitted in accordance with provisions
of the Sign Ordinance for all signs. No sign to be installed
until application is approved and permit issued by the Building
Department. (Section 21.68.030 of the Campbell Municipal Code.)
B. Room capacity sign to be installed adjacent to front door.
Sign to read "Room Capacity 230".
C. Install an emergency lighting system (battery pack).
D. Obtain a Permit to Operate a Place of Assembly 50-300, from
Fire Department.
E. Provide two "2H-IOBC" fire extinguishers.
The applicant is notified that he is required to meet all conditions
in accordance with Ordinances of the City of Campbell and Laws of the State
of California.
The applicant is notified that he shall comply with all applicable
Codes or Ordinances of the City of Campbell which pertain to this development
and are not herein specified.

STAFF RECOMMENDATION
Approval, subject to the attached conditions.
STAFF DISCUSSION
The applicant is applying for a use permit to serve alcoholic beverages
in a proposed cocktail lounge. A description of the proposed operation
is attached for the Commission's review. The proposed lounge is located
within an existing commercial building and will occupy approximately
4,400 square feet.
As the Commission is aware, a recent amendment to the Zoning Ordinance
requires the approval of a use permit prior to approval of any new
liquor license in the City of Campbell.
Staff has referred this application to the Police and Fire Departments
for their comments. The Fire Department has recommended four conditions
of approval as listed on the attached sheet and the Police Department
had no comment on this application.
Staff is therefore recommending approval of this application, subject
to attached conditions.

UP 81-08 This is the time and place fog a public hearing
Perrone, C. to consider the application of Mr. Clemant
Perrone for a use permit to allow the estab-
lishment of a cocktail lounge and approval of
an on -site liquor permit for property known
as 1777 S. Bascom Avenue in a C-2-S (General
Commercial) Zoning District.
Mr. Kee explained that the applicant is applying for a -is- Dermit to serve
alcoholic beverages in a proposed cocktail lounge. The propcsed lounge is
located within an existing commercial building and will occupy approximately
4,400 square feet.
Staff has referred this application to the Police and Fire Departments
for their comments. The Fire Department has recommended four conditions
of approval and the Police Department had no comment on this application.
He stated Staff is recommending approval of this application, subject to
conditions listed in the Staff Comment Sheet.
Chairman Kasolas opened the public hearing and invited anyone in the
audience to speak for or against this application.
Mr. Leonard Licardo, representing the applicant, appeared before the Commission
to answer any questions. He noted that the owner had hoped to make this a
quasi -private club, with possibly a door charge.
Commissioner Campos inquired as to what would constitute a member.
Mr. Licardo responded that the owner hoped to have a pre -paid door charge,
with reservations being made in advance.
Mr. Bob Miller of Ortho Mattress appeared before the Commission to explain
that he is not in favor of this proposed use. He noted that one of the uses
his company tries to avoid being adjacent to is cocktail lounges. He further
noted that he felt there might be a parking problem. He stated they are open
five nights a week until 9 p.m. He also felt there would be a problem with
the loud music.
Ftr. Licardo stated that it is the intent of the owner to not have any live
music until after 9 p.m., and he did not feel there would be any conflict
whatsoever.

No one else wishing to speak, Commissioner Meyer moved that the public
hearing be closed; seconded by Commissioner Pack and unanimously adopted.
At this time Commissioner Dickson announced that he would be abstaining
on this application since he is morally opposed to this type of use.

Commission adopt Resolution No. 2002 approving
a use permit to allow the establishment of a

After not`fication and public hearing as specified by law on the
application of Mr. Clement Perrone for a use permit to allow the estab-
lishment of z, cocktail lounge and approval of an on -site liquor permit
for property known as 1777 S. Bascom Avenue in a C-2-S (General Commercial)
Zoning District, as per application filed in the Office of the Planning
Department on April 7, 1981, and after presentation by the Planning Director,
proponents and opponents, the hearing was closed (UP 81-08).
After due consideration of all evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort or general welfare of persons residing
or working in the neighborhood of such use, or be detrimental
or injurious to the property and improvements in the neighborhood
or the general welfare of the City.
Based on the above findinns, the Planning Commission does hereby grant
the requested use permit subject to the following conditions:
A. Sign application to be submitted in accordance with provisions
of the Sign Ordinance for all signs. No sign to be installed
until application is approved and permit issued by the Building
Department. (Section ,'1.68.030 of the Campbell Municipal Code.)
B. Room capacity si5n to be installed adjacent to front door.

C. Install an emergency lighting system (battery pack).
D. Obtain a Permit to Operate a Place of Assembly 50-300, from
Fire Department.
E. Provide two "2A-IOBC" fire extinguishers.

in accordance with Ordinances of the City of Campbell and Laws of the State
of California.
The applicant is notified that he shall comply with all applicable
Codes or Ordinances of the City of Campbell which pertain to this development
and are not herein specified.
