UP 81-09 This is the time and place for a public hearing
Moser, N. to consider the application of Ms. Nancy Moser
on behalf of Mr. Steak #94 for a use permit to
allow an on -sale beer and wine place in an
existing restaurant on property known as
2201 S. Bascom Avenue in a C-2-S (General
Commercial) Zoning District.
Mr. Kee stated that Staff is recommending approval of this use permit, subject
to the conditions listed in the Staff Comment Sheet, to allow on -sale beer and
wine in an existing restaurant. He further noted that this application had
been referred to both the Fire and Police Departments.
Chairman Kasolas opened the public hearing and in0 teo anyone in the audience
to speak for or against this application.
Ms. Nancy Moser, applicant, appeared before the Commis to explain that
after taking surveys of other restaura,rts the chain, it was determined
that business would increase substantially >hould they be allowed to sell
beer and wine.
No one else wishing to speak, Commissioner Meyer moved that this public
hearing be closed, seconded by Commissioner Pack and unanimously adopted.
Commissioner Dickson announced at this time that he would be abstaining
on this application since he is opposed to this for moral reasons.
RESOLUTION NO. 2003 Commissioner Kotowski moved that the Planning
Commission adopt Resolution No. 2003 approving
the application of Ms. Nancy Moser on behalf of
Mr. Steak #94 for a use permit to allow an on -
sale beer and wine eating place in ar. existing
restaurant on property known as 2001 S. Bascom
Avenue in a C-2-S (General Commercial) Zoning
District, seconded by Commissioner Meyer and
adopted by the following roll call vote:
AYES: Commissioners: Pack, Kotowski, Campos, Meyer, Fairbanks, Kasolas
NOES: Commissioners: None
ABSENT: Commissioners: None

RESOLUTION NO. 2003
After notification and public hearing as specified by law on the application
of Ms. Nancy Moser on behalf of Mr. Steak 494 for a use permit to allow an
on -sale beer and wine place in an existing restaurant on property known as
2201 S. Bascom Avenue in a C-2-S (General Commercial) Zoning District,
as per application filed in the Office of the Planning Director on
April 24, 1981, and after presentation by the Planning Director, proponents
and opponents, the hearing was closed (UP 81-09).
After due consideration of all evidence presentee, the Commission did find
as follows:
That the establishment, maintenance, and operation of the proposed
use will not be detrimental to the health, safety, peace, morals,
comfort or general welfare of persons residing or working in the
neighborhood of such use, or be detrimental o, injurious to the
property and improvements in the neighborhood or the general
welfare of the City.
Based on the above findings, the Planning Commission does hereby grant the
requested use permit subject to the following conditions:
A. Remove locking assembly from interior of front door.
B. Repair rear exit so that it opens smoothly.
The applicant is notified that he is required to meet all conditions in
accordance with Ordinances of the City of Campbell and Laws of the State
of CaliTornia.
The applic:^.t is notified that he shall comply with all applicable Codes
or Ordinances of the City of Campbell which pertain to this development
and are not herein specified.
PASSED AND ADOPTED this 19th day of May, 1981 by the following roll call
vote:

STAFF DISCUSSION
The applicant is applying for a use permit to allow on -sale beer and wine
in an existing restaurant.
As the Commission is aware, a recent amendment to the Zoninq Ordinance
requires the approval of a use permit prior to approval of any new liquor
license in the City of Campbell.
Staff eras referred this application to the Police and Fire Departments
for their comments. The Fire Department has recommended two conditions
of approval as listed on the attached sheet, and the Police Department
had no commcnt on this application.
Staff is recommending approval of this application, subject to the
attached zondit;ons.
