SUBJECT: Use Permit
Purpose:
I wish to apply for a Use Permit to install additional video
games (more than 10) in my present restaurant/entertainment estab-
lishrent, located in the Hamilton Plaza Shopping Center, Campbell,
California.
Present Operation:
Our present operation was started in the fall of 1971. The
format was and remains quality food (pizza, salads, sandwiches,
beverages) and entertainment. Entertainment is in the form of
organ music played by some of the finest professionals in the
country, on the Mighty Wurlitzer Theatre Organ, otherwise referred
to as the "one man band." When video game technology surfaced
3-4 years ago, a couple of games were added. At this time I would
like to expand this part of our family entertainment format to in-
clude additional video games. Overall operation remains the same.
Our hours are 11:30 a.m. to 10:00 p.m., Sunday through Thursday,
and 11:3C a.m. to 11:00 p.m., Friday and Saturday. Organ music is
played 6 uighta a week. Monday is excluded.
Proposed Chan es•
Attac e s a floor plan designating approximately 800 square
.feet as a video game area. This area is in the main room and would
be enclosed by a six foot free standing partition to confine the
noise. Additionally, carpeting will be installed for the same pur-
pose. Total number of games would be approximately twenty to forty.

The video game area is visable to the dining room, kitchen and bar.
areas. Employees will be assigned game room supervision respon-
sibility during peak family trade hours. Loitering will not be tol-

will be positioned in front of this establishment. No other exter-
ior changes are anticipated. It is my desire to provide an envir-
onment conducive to family fun and entertainment.

STAFF COMMENT SHEET - PLANNING COMMISSION MEETING OF JANUARY 12, 1982
UP 81-19 Public hearing to consider the application of
Peterson, R. Mr. Robert Paterson on behalf of Pizza and
Pipes, Inc. for a use permit to allow an
arcade in an existing restaurant on property
known as 1690 S. Bascom Avenue in a C-2-S
(General Commercial) Zoning District.
STAFF RECOMMENDATION
That the Planning Commissi3n adopt a resolution granting the requested
use permit, subject to the attached conditions.
STAFF DISCUSSION
The applicant is proposing to establish an arcade in the existing Pizza
& Pipes restaurant. The proposed use will occupy approximately 800 sq.ft.
of the restaurant. Attached for the Commission's review is a letter from
the applicant explaining the request and a diagram indicating the area to
be used for the arcade.
This item is before the Commission because the establishment of an arcade
in a C-2-S Zoning District requires a conditional use permit. The con-
sideration for a use permit allows the Commission the opportunity to
determine if the proposed location is appropriate and to set specific
conditions as it deems necessary as part of an approval. It should be
noted that only three arrades are allowed in Campbell. Two arcades
presently exist, thus approval of this application will constitute
the third and final arcade.
The restaurant is located in the Hamilton Plaza Shopping Center. Adjacent
businesses are a beauty salon and Dad's Moustache. The hours of operation
are listed as 11:30 a.m. to 10:00 p.m., Sunday through Thursday; and
11:30 a.m. to 11:00 p.m., Friday and Saturday. Because the arcade will be
located in an existing restaurant, Staff believes problems, if any, should
be minimal.
This application has been referred to the Police Department, whose investi-
gation thus far has revealed no problems. Furthe? investigation will be
undertaken prior to Council action on this application.
For the reasons listed above, Staff is recommending approval of this
application.

quality family entertainment center for Campbell residents for

UP 81-19 This is the time and place for a public hearing
Paterson, R. to consider the application of Mr. Robert Paterson
on behalf of Pizza and Pipes, Inc., for a use
permit to allow an arcade in an existing restaurant
on property known as 1690 S. Bascom Avenue in a
C-2-S (General Commercial) Zoning District.
Mr. Kee ;tated that Staff is recommending approval of this application
subject to the conditions Misted in the Staff Comment Sheet. He noted
that two arcades presently exist in Campbell and a total of only three
are allowed; thus, approval of this application would constitute the
third and final arcade. He noted that a copy �f the Police Chief's memo
to the City Manager regarding this applicat' , dated January 8, 1982,
had been placed at each Commissioner', stat,on. A copy of this memo is
attached hereto and made a part of these minutes.
Commissioner Kasolas inquired as to why this application is being recommended moo,
for approval, as compared to the application for an arcade in the shopping
center at Winchester and Latimer which was denied. He expressed concern
about approving this application and not approving the previous application.
Mr. Kee responded that the tenants of the shopping center had opposed the
use stating that it was not compatible with the other uses in the center.
Chairman Meyer opened the public hearing and invited anyone in the audience
to speak for or against this application.
No one wishing to speak, Commissioner Kotowski moved that the public hearing
be closed, seconded by Commissioner Fairbanks and unanimously adopted.
RESOLUTION NO. 2081 Commissioner Howard moved that the Planning
Commission adopt a Resolution approving UP 81-19
subject to the conditions listed in the Staff
Comment Sheet, seconded by Commissioner Fairbanks
and adopted by the following roll call vote:
AYES: Commissioners: Dickson, Howard, Kotowski, Fairbanks, Campos, Meyer
NOES: Commissioners: Kasolas
ABSENT: Commissioners: None

RESOLUTION NO. 2081
After notification and public hearing as specified by law on the application
of Mr. Robert Paterson on behalf of Pizza 6 Pipes, Inc., for a use permit to
allow an arcade in an existing restaurant on property known as 1690 S. Bascom
Avenue in a C-2-S (General Commercial) Zoning District, as per application
filed in the Office of the Planning Department on December 8, 1981, and after
presentation by the Planning Director, proponents and opponents, the hearing
was closed (UP 81-19).
After due consideratio,. of all evidence presented, the Commission d.d find
as follows:
That the establishment, maintenance, and operation of the propised
use will not ts detrimental to the health, safety, peace, morals,
comfort, or general welfare of persons residing or working in the
neighborhood of such use, or be detrimental or injurious to the
property and improvements in the neighborhood or the general
welfare of the City.
Based on the above findings, the Planning Commission does hereby grant the
requested use permit subject to the following conditions:
FIRE DEPARTMENT
1. All elor., rical wirinq to video games and existing organ chamber
shall be enclosed in metal conduit with approved outlet boxes.
An electrical permit shall be obtained from the Building
Department prior to installation.
2. Illuminated exit signs shall be provided at all exit doors and
at doorway to game area from dining room.
3. Post Room Capacity sign - 155 persons.
PLANNING DEPARTMENT
4. Applicant to obtain all necessary permits from the Building
Department.
The applicant is notified that he shall comply with all applicable Codes or
Ordinances of the City of Campbell which pertain to this development and are
nct herein specified.
PASSED AND ADOPTED this 12th day of January, 1982 by the following roll
call vote:
