Mr. Kee reported that the applicant is applying for a use permit to allow on -sale
beer and wine at a delicatessen located next to the movie theatre in The Pruneyard.

Chairman Meyer declared the public hearing open and invited anyone in the
audience to _peak for or against this item.
No one wishing to speak, it was moved by Commissioner Fairbanks, and seconded
by Commissioner Kasolas, that the public hearing be closed. Motion carried
with a vote of 6-0-1.
RESOLUTION NO. 2134 It was moved by Commissioner Kasolas, and seconded by
Commissioner Howard, that the Planning Commission adopt
Resolution No. 2134 approving UP 82-18 subject to the
conditions listed in the Staff Comment Sheet Motion
carried with V* following roll call vote:

Director, proponents, and opponents, the hearing was closed (UP t2-18).
After due consideration of all evidence presented, the Commission did find
as follows:
That the establishment, maintenance, and operation of the
proposed use will not b detrimental to the health, safety,
peace, morals, comfort, or general welfare of persons
resid'ng or working in the neighborhood of such use, or be
detrimental or injurious to the property and improvements
in the neighborhood or the general welfare of the City.
Based on the above findings, the Planning Commission does hereby grant
the requested use permit.
The applicant is notified that he shall comply with all applicable Codes or
Ordinances of the City of Campbell which pertain to this development and are
herein specified.

STAFF RECOMMENDATION
That the Planning Commis -ion adopt a resolution approving this application.
STAFF DISCUSSION
The applicant is applying for a use permit to allow on -sale beer and wine at a
delicatessen. Attached is a letter from the applicant explaining the request.
The deli is located next to the movie theatre in the Pruneyard.
The Police Department has no comments regarding the liquor license.
Staff does not anticipate dny problems regarding this use, and therefore is
recommending approval.

to provide pastries and gourmet soups and sandwiches
to the public. It has become obvious that many patrons
would like bee- or wine with their food in addition to
the coffee we serve. We therefore have made application

mises and thus this application for a use permit.
