conversion of a restaurant to a discotheque on pro-

the Outlook) ir. a C-2-1 (General Commercial) Zoning
District.
Mr. Kee reported that a eommnicatioh has been received from the applicant
asking that this application be withdrawn, therefore Staff is recommending
denial without prei:hdice.
Chairman Fairbanks opened the public hearing and invited anyone in the audience
to speak for or against this item.
No one wishing to speak, it was moved by Commissioner Meeyer, and seconded by
Commissioner Dickson, that the public hearing he closed. Mbtion carried
unanimously (4-0-2).

Planning Director, proponents and oppoients, the hearing was closed.

After due consideration of all evidence presented, the Planning Commission
took action to deny without prejudice IIP 83-18 based on the request of the
applicant that this item be removed from the agenda.

STAFF DISCUSSION
As the Commission may recall, at its meting of December 13, 1984 it
denied without prejudice an application for a use permit at the same
location to convert a restaurant to a discotheque. The anplicant
requested that it be withdrawn.
At this tine the applicant is requesting that the restarnant he
converted to the cocktail lounge, thus eliminating the food service.
The restaurant has previously been the Outlook and the Terrace.
Attached is a letter from the applicant.
The restaurant has been illegally converted into a discotheque and
a dance floor added. The Building Dept, has previously indicated
that a dance floor cannot be located on the second story of this
building. The plans submitted with the new application indicate
that the dance floor will be removed and seating installed.
Attached is a memo from the Police Dept. dated November 29, 1983
which opposes the conversion of the restaurant to a discotheque or
nightclub/cocktail lounge. The memo states that the addition of
another nightclub will continue to tax the manpower availability
of the Campbell Police Dept. and would be contrary to the public
health, safety, peace, and welfare of the City. For these
reasons, Staff is recommending denial of this application.

Dear Commissioners,
The undersigned are the tenants of the 8 750 Pruneyard, known as The
Terrace.
Currently, The Terrace operates as a standard restaurant and cocktail
lounge under licenses issued by the agencies having jurisdiction over such
services.
The Terrace is zoned C-2-S (General Commercial)
Since there are several very fine restaurants operating in the immediate
neighborhood, we feel that the Terrace may be best developed to operate as
cocktail lounge for serving the public. For this reason alone, we request
that the food serving requirement to be removed from our business operating
conditions.
Kindly note that we do intend to maintain the same occupancy capacities
which are stipulated by the Fire Department at the present time and not
request an increase in our occupancy conditions.

Applicant also owns the Lariat Discotheque nightclub at the Factory,
93 S. Central Avenue, Campbell, which has been, in part, the source of
police -community problems in our City for a number of years.
The State of California, Department of Alcoholic Beverage Crntrol has
filed four (4) formal accusations against applicant's liquor license at
the Lariat; the last of which, although on appeal, requires a 35 day
suspension of the license. Of the four (4) accusations filed by A.B.C.
against the Lariat, two (2) have involved battery upon patrons by employees,
resulting in the above suspension order.
It appears from the information that we have at this time that the
applicant is attempting to sell the Lariat Club.
If the suspension is activated by the A.B.C., there is a possibility
that this office will move for cancellation or a suspension of the live
entertainment permit for the Lariat.
:he applicant also owns a discotheque -nightclub known as Studio 47,
47 Notre Dame, San Jose, Ca. The A.B.C. has filed three (3) formal
accusations against applicant's liquor license at this location - the most
recent occurring last month involving charges of discrimination, lewd conduct,
and free drinks.
We in the Police Department oppose the conversion of the restaurant -bar
at the Pruneyard to a discotheque, and would oppose a re -application for a
live entertainment permit for this revised type of function.
The addition of another discotheque -nightclub to Campbell will continue
to tax the manpower availability of the Campbell Police Department and would
be contrary to the public health, safety, peace, and welfare of our City.

On November 7, 1983, the Planting Director advised H$E Association, Inc.,
that apnroval of a Conditional Use Permit would be required to change the
liquor license for the business establishment known as The Terrace. In
addition, HF,E Association, Inc., was also advised that a Conditional Use
Permit would be required to change the use from a restaurant to a cocktail
lounge. Bo `u the change in the liquor license and the change in use of
the property could be considered under one Use Perma application.
Subsequent to this letter, an application for a Use Permit (UP 83-18) was
filed with The City on November 18, 1983. This Use Permit application was
denied without prejudice by the Planning Commission on December 13, 1983
as a result of a letter requesting that the application be withdrawn.
Similarly, a second Use Permit application (UP 83-23) for the same property
was filed with the City on lecember 15, 1983. On January 24, 1984, this
application was removed from the Planning Commission's agenda pursuant to
another request that the application be withdrawn.
It has been brought to our attention that The Terrace is in fact being
converted to a cocktail lounge. These conversions are violations that
must be corrected by either obtaining a Conditional Use Permit, or re-
moving whatever improvements were required to convert to a cocktail lounge.
You have a choice of contacting the Planning Office within 5 days of receipt
of this letter and applying for the necessary permits; or, in the alternative,
you leave the Ci+.y no choice older than to pursue their legal remedies in
prier to hying about compliance with City codes.
It would be appreciated if you would contact the Planning Department within
the specified 5 days, on or before July 20, 1984.

Fair for May 23 through May 28, 1984. We are requesting a
renewal of the special permit required by the City of
Campbell to hold such an event in order to stay within the
city ordinances.

will not have to attend the City Council Meeting scheduled
for Tuesday, May 15, 1934, but instead our request for the
permit will appear on the agenda and the Council will approve
my request without my attendance.

The undersigned are the tenants of the N750 Pruneyard , known as The Terrace.
Currently The Terrace provides food, dancing and intertainment to the
general public under licenses issued by the agencies having jurisdiction
over such services.
The Terrace is zoned C-2-S (General Commercial)
In conformance with the zoning and since there are several very fine
restaurants operating in the immediate neighborhood, we feel The Terrace
can be best developed for public dancing and intertainmet use in its entirety.
Consequently, we request that the food serving requirement to be removed
from our business operating conditions.
Enclosed please find our proposed floor plan alterations which shows
the removal of the kitchen facilities and pronides additonal toilet.in Iieu
of the kitchen soace allocation.
