Mr. Stafford stated that this application meets all the
req•.;iremer.ts of the present ordinance, and until such

resporsibility of staff to pass its recommendations
based cn the curent ordinance. Mr. Stafford noted that
th, issue of setbacks has been continued to the September
11, 1964 Flanning Commission Meeting.
Following discussion, Cnester Mallory, 1073 Lucot Way,
Campbell, appeared before the Council and requested trat
this application be postponed until such time as the
issue of setback requirements has been resolved. Mr.
Mallory presented to the Council a Petition for Reasonable
Setback and Building Height Restrictions signed by the
residents in the San Tows area.
Jim Lyle, Pacific Design GrouF, appeared before the
Council on behalf cf the applicants and spoke in favor
of the application. Mr. Lyle stated that this
application meets all of the criteria under the present
ordinance and should be apl.roved or, that basis.
Lee Peterson, 1156 Audrey Avenue, Campbell, appeared
before the Council and expressed concerns regarding
the existing setback requirements and spoke in favcr
of establishing stricter setback requirements.

That the City Council uphold the decision of the Planning Caawission
approving the application of Mr. George Favre for a use permit and
approval of plans and elevations allowing the construction of a
secondary living unit, 2-car garage, and carport on the rear of the
property known as 1102 Audrey Avenue.

At its meeting of June 26, 1984 the Planning Commission adopted Resolution
No. 2274 approving the applicant's request to allow the construction of a
secondary living unit on the subject property. This decision has subse-
quently been appealed by neighboring property owners. A letter of appeal
is attached for the Council's review.
On July 19, 1983 the Council adopted an o.dinance to allow additional
living units on single family lots under specified conditions. A copy
of this ordinance is attached for the Council's review.
This application (UP 84-07) is the first since the ordinance was adopted.
The applicant is proposing t,) construct a 640 sq.ft, detached living unit
to the rear of the existing single family hare. The unit will be on the
second story with a separate workshop, 2-car garage, and carport for a
motor hone below. The setbacks for the structure are 10' from the rear
property line, 16' from the side property lines, and 50' from the rear
of the existing house. The parcel size is 13,188 sq.ft.
Building materials are indicated as T-111 siding and shake shingles for
malls with a tar and gravel roof. The structure should not be visible
from Audrey Avenue. An existing garage will be removed. The nearest
adjacent residential structure is approximately 4C' array.
Under the ordinance, the Planning Commission may consider traffic i�act,
utility capacity, impact on adjacent neighbors, and impact on the nergh-
borhood. It is the opinion of the Commission that the impact on these
factors would be minimal.
The Commission found that the establishment, maintenance, and operation
of the use would not be detrimental to the health, safety, peace, morals,
comfort or general welfare of persons residing in the neighborhood, or

LOT 21 APPEAL THIS DECISION OF THE PLANNING COMMISION AND
RESPECTFULLY REQUEST A PUBLIC HEARING ON THE IMPACT TO THE
NEIGHBORHOOD OF THIS PROPOSED CONSTRUCTION.
WE HAVE TWO MAJOR CONCERNS REGARDING BOTH THE SIZE AND
THE PLACEMENT OF THE BUILDING:
1- LACK OF ADEQUATE BUILDING SETBACKS:
2- BUILDING HEIGHT IS INCONSISTENT WITH NEIGHBORHOOD
DWELLINGS:
WE FEEL THE CUMULATIVE AFFECTS OF THE PROPOSED STRUCTURE

21.19.010 Purpose. This chapter is designed to provide for, and
regulate the establishment of additional living units in the single family
district. The purpose of permitting additional living units is to allow
more efficient use of the City's existing housing stock and to provide the
opportunity for the development of small rental housing units designed to
meet the special housing needs of individuals and families, while preserving
the integrity of the single family neighborhood.
21.19.020 Definitions. An additional living unit is a separate complete
housekeeping unit with kitchen, sleeping and full bathroom facilities which is
a part of or an extension to an existing structure originally designed for
occupancy by a single family. Under certain conditions, specified in this
Chapter, an additional living unit amy be a detached unit.
21.19.030 Location. Additional living units shall be allowed in all
R-1 Sing a Famt y es ddential Zoning District,subject to the provisions of
this Chapter.
21.19.040 Pro ert Develo ment Standards. The following property
development standards shal app y tc a 1 an and structures in the zones
which permit additional living units:
(1) On R-1 lots having a minimum lot area of 12,000 square feet:
(a) Zoning Requirements: All yards, building height distance
between buildings, setback%, and lot coverage standards of
the zone in which the property proposed for conversion shall
appl,.
(b) L_ivin9 Unit Sizse - Attached: The floor area of the existing
main dwe ng a not be expanded more than 10% to accommodate
an additional living unit.
(c) Livin Unit Size - Detached: The total floor area of an addi-
t ona v ng unit sha no more than 640 square feet. The
detached additional living unit shall have no more than one
bedroom.
(d) Design: The additional living unit shall be designed so that
the appearance of the building remains that of a single family
residence. all new entrances shall be located so as not to be
visible from any public street.
Chapter 21.19 -2- OPR Additional Living Units
(e) Off-street parking: A single family unit containing an
additional lng unit shall be provided with 4 parking
spaces, 2 of which must be covered. The spaces may be
permitted in tandem in the driveway of a 2-car garage
if the garage meets minimum setbacks and the lot con-
figuration precludes placement elsewhere on the property.
(f) Occupancy: No more than one dwelling unit on the parcel
s-Tull be rented or leased. The City shall require recorda-
tion of a deed restriction setting forth this occupancy
requirement.
(2) On R-1 lots having a minimum lot area of 250% of the minimum
required for the district in which it is located. Nherc a
lot has an area equivalent to two hundred and fifty percent
(250±) the minimum lot size <,equired by the zoning district
in which it is located, but without the required frontage to
create a separate parcel, a second detached dwelling unit may
be permitted. Such additional dwelling unit shall not be bound
by the dwelling unit size provision of Section 21.19.040(1)(c).
21.19.050 Use Permit - Architectural A roval Required. The construction
of an additional iving unit sha 1 be permitted only after approval of a con-
ditional use permit and architectural approval by the Planning Commission. The
requirements for a use permit are set forth in Chapter 21.64 of this title and
are incorporated in this chapter by reference.
The requirement for architectural approval are set forth in Chapter 21.42
of this title and are also incorporated in this chapter by reference. Prior
to making a decision, the Planning Commission may consider traffic impact,
utility capacity, impact on adjacent neighbors, and impact on the neighborhood.
21.19.060 Restrictions.
(a) Additional living units shall not be allowed on R-1
zoned parcels on which more than one living unit is
presently located.
(b) ilo subdivision of land nor air rights shall be allowed.
(c) Additionalliving units must comply with all applicable
building and fire codes.

After notification and public hearing as specified by law on the
application of George and Dolores Favre for a use permit and approval
of plans and elevations to allow the construction of a secondary living
unit, 2 car garage, and carport on the rear of the property known as
1102 Audrey Avenue in an R1-10 (Single Family Residential, 10,000 sq. ft.
minimum lot size) Zoning District, as per application filed in the Office
of the Planning Department on May 31, 1984, and after presentation by
the Planning Director, proponents and pponents. the hearing was closed
(UP 84-07).
After due consideration of all evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, mLrals, comfort, or general welfare of persons
residing or working in the neighborhood of such use, or
be detrimental or injurious to the property and improve-
ments in the neighborhood or the general welfare of the
City.
Based on the above findings, the Planning Commission does hereby grant
the requested use permit, subject to the conditions attached hereto as
Exhibit A.
The applicant is notified as part of this application that he/she
is required to crnry>ly with all applicable Codes and/or Ordinances of the
City of Campbell and the State of California which pertain to this
development and are not herein specified.

Commissioner Howard reported that this item was cons dered by the Site and

Architectural Review Committee. It is the opinion of the Committee that
the protect. is extremely well done and meets all the requirements of the
City; therefore, the Committee is recommending approval, subject to con-
ditions as indicated in the Staff Comment Sheet.
Conmissioner Fairbanks asked about the condition requiring the installation
of street improvement across the frontage of this property, noting that the
majority of Audrey Avenue is without improvements. She asked if this condi-
tion could be changed to read "install street improvements in accordance
with Council policy pertaining to alternative street improvements."
Mr. Helms indicated that Staff had no objection to the re-v,ording of this
condition, and noted that Audrey Avenue is one of the streets listed in
the Circalation Element which is recommended for alternative street im-
provements.
!n response to a question regarding the "workshop" indicated u., the plans,

1 Commissioner Howard noted that this workshop is solely for personal or
hoCDy use.
Mr. Jim '.yle, 150 E. Campbell Avenue, appeared before the Commission to
answer any questions,_cn behalf of the applicants.
Mr. Lee Petersen, 1156 Audrey Avenue, handed out a compar'son of setbacks
for Campbell and other cities, and expressed his concern that approval of
this secondary 'iv'ng unit would set a precedent in this area. Mr. Peter-

sen continued that he felt the neighborhood had expressed its feelings
about this type of development during all the neighborhood hearings. He
spoke in favor of establishing stricter setbacks for larger lots, and noted
that he was not in favor of this application.
Mr. Kee stated that the City Council adopted an ordinance, in July 1983,
specifying guidelines for secondary living units, or "granny flats". This
ordinance was adopted in response to State legislation. This application
is the first request for a secondary living unit thet has come before the
Commission. Under the pvesent ordinance, this proposal meets all the re-
quirements set forth; and, until such time as the Council changes this
policy, it is Staff's responsibility to pass it's recommendations upon
that policy. Therefore, Staff is recommending approval of UP 84-07. Mr.
Kee noted that the issue of setbacks is agendized for the Planning Com-
mission meeting of July 10, 1984.
Mr. Peterser stated that Campbell, until recently, has never had 10,000
sq.ft. minimum lot sizes; and, he felt that the setbacks should be changed
to be in line with these larger lot sizes.
Commissioner Fairbanks asked how close this structure would be to the near-
est structure to the south.
Mr. Kee indicated that the nearest stricture would be 45'.
Chairman Dickson expressed his concerr for proper separation in anv neigh-
borhood, and indicated that he felt this application has quite a bit of
separation.
M/S: Howard, Fairbanks - No one else wishing to speak, that the public
hearing on UP 84-07 be closed. Motion carried
unanimously (5-0-1).
M/S: Howard, Campos - That the Planning Commission adopt RESOLUTION NO.

(e) Off-street parking: A single family unit containing an
additional livi.ig unit 0all be provided with 4 parking
spaces, 2 of which must be covered. The spaces may be
permitted in tandem in the driveway of a 2-car garage
if the garage meets minimum setbacks and the lot con-
figuration precludes placement elsewhere on the property.
(f) Occu anc No more than one dwelling unit on the parcel

rented or leased. The City shall require recorda-
tion of a deed restriction setting forth this occupancy
requirement.
(2) On R-1 lots having a minimum lot area of 250% of the minimum
required for the district in which it is located. Where a
lot has an area equivalent to two hundred and fifty percent
(250s) the minimum lot size required by the zoning district
in which it is located, but without the required frontage ',
create a separate parcel, a second detached dwelling unit nay
be permitted. Such additional dwelling unit shall not be bound
by the dwelling unit size provision of Section 21.19.040(1)(c).
21.19.050 Use Permit - Architectural Approval�Re wired. The construction
of an additional iT-T'ving unit sha�T peke rmitted only after approval of a con-
ditional use permit and architectural approval by the Planning Commission. The
requirements for a use permit are set forth in Chapter 21.64 of this title and
are incorporated in this chapter by reference.
The requirement for architectural approval ore set forth in Chapter 21.42
of this title and are also incorporated in this chapter by reference. Prior
to making a decision, the Planning Commission !aay consider traffic impact,
utility capacity, impact on adjacent neighbors, and impact on the neighborhood.
21.19.060 Restrictions.
(a) Additional living units shall not be allowed on R-1
zoned parcels on which more than one living unit is
presently located.
(b) No subdivision of land nor air rights shall be allowed.
(c) Additionalliving units must comply with all applicable
building and fire codes.

application of George and Dolores Favre for a use permit and approval
of plans and elevations to al -ow the construction of a secondary living
trait, 2 car garage, and carport on the rear of the property (sown as
1102 Audrey Avenue in an R1-10 (Single Fariiy Residential, 10,000 sq. ft.
minimum lot size) Zoning District, as per application filed in the Office
of the Planning Department on May 31, 1984, and after presentation by
the Planning Director, proponents and opponents, the hearing was closed
(UP 84-07).
After due consideration of all. evidence presented, the Commission
did find as follows:
That the establishment, irtaintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort, or general welfare of persons
residing or working in the neighborhood of such use, or
