Mr. Kee reported that Staff is recommiending approval of this request, and
noted that the Police Department had no comments regarding the use.
Chairman Dickson opened the public hearing and invited anyone in the
audience to speak for or against this item.

After notification and public hearing as specified by law on
the application of Elliott and Janis Bowman for a use permit to allow
on -sale beer and wine in an existing restaurant on property Known as
1875 S. Bascom, 0
152 The Pruneyard, in a C-2-S (General Commercial)
Zoning District, as per application filed in the Office of the Planning
Department on October 2, 1984, and after presentation by the Planning
Director, proponents and opponents, the hearing was closed (UP 84-16).
After due consideration of all evidence presented, the Commission
did find as follows:
That the establishment, maintenance, and operation of the
proposed use will not be detrimental to the health, safety,
peace, morals, comfort, or general welfare of persons
residing or waking in the neighborhood of such use, or
be detrimental or injurious to theproperty and improve-
ments in the neighborhood or the general welfare of
the City.
Based on the above findings, the Planning Cowission does hereby grant
the requested use permit.
The applicant is notified as part of this application that he/she
is required to comply with all applicable Codes and/or Ordinances of the
City of Campbell and the State of California which pertain to this
development and are not herein specified.
PASSED AND ADOPTED this 23rd day of October, 1984 by the following
roll call vote:

subject to the attached conditions.
STAFF DISCUSSION
The applicant is requesting approval of a use permit to allow on -sale beer
and wine in an existing restaurant (Bake N Serve Sandwich Boutique). The
restaurant has approximately 30 seats and primarily serves lunch for
shoppers and business people located in the Pruneyard Towers. Hours of
operation are indicated as 6 A.M. to 8 P.M. weekdays and 9 A.M. to 6 P.M.
weekends.
The Police Department has no comments regarding the application. Staff is
recommending that the Commission find that the use rill not be detrimental
to the immediate area or to the City as a whole, and approve the use permit
