STAFF DISCUSSION
At its meeting of April 9, 1985, the Planning Commissior adopted
Resolution No. Z326 approving the applicant's request f-, a use permit
to allow the establishment of ar oriental -style billiards room. A
copy of the adopted resolution is attached.
Condition 10 of that approval required a six month review of this use
permit by the Planning Commussion.
Staff has contacted the Police Department regarding this operation and
they have indicated that there have not been any problems with this
use. Consequently, Staff is recommending that this report be noted
and filed.

After notification and public hearing as specified by law on the
application of Ms. MyunK Sik Lee for a use permit to allow the
establishment of an oriental -style billiards room on property known
as 2079 S. Bascom Ave. in an C-2-S (General C,)mmercial) Zoning
District, as per application filed in the Office of the Planning
Department on March 11, 1985, and after presentation, proponents and
opponents, the hearing was closed (UP 85-03).
After due consideration of all evidence presented, the Commission did
find as follows:
That the establishment, maintenance, and operation of the
propose,i use will not be detrimental to the health, safety,
peace, morals, comfort, or general welfare of persons
residing or workf.ng in the neighborhood of such use, or
be detrimental or injurious to the property and improve-
ments in the neighborhood or the g±neral welfare of the City.
Based on the above findings, the Planning Commission does hereby
grant the requested use permit, subject to the conditions attached
hereto as Exhibit A.
The applicant is notified as part of this application that lie/she is
required to comply with all applicable Codes and/or Ordinances of the
City of Campbell .nc the State of California which pertain to this
development and are not her±in specified.

STAFF RECOMMENDATION
That the Planning Commission adopt the attached findings and modify
Condition No. 7 of the approved use Permit 85-03 to extend the closing
time from 12 midnight to 2:00 a.m. for a period of 6 months. The
Commission to hold a review of the project at its meeting of September 9,
1986, at which time it will determine whether or not to extend the clo0:1g
time to 2:00 a.m. for an indefinite period. All other previous conditions
to remain in effect.
STAFF DISCUSSION
At its meeting of April 9, 1985 the Commission approved a use permit to
allow the establishment of an oriental -style billiard room. Condition No.
7 of that approval limited the hours of operation to 12 noon - 12
midnight. At this time, the applicant is requesting a change in the
condition to extend the hours of operation until 2:00 a.m. Attached for
the Commission's review is the following:
1. A letter from applicant dated February 7, 1986 explaining the
reasons for the extended hours of operation.
2. Resolution No. 2326 approcinq this project, with conditions.
3. Minutes of the Planninq Commission of April 9, 1985.
4. Staff Comment Sheet of April 9, 1985 which describes the use.
Staff originally recommend,:d that the business close at midnight instead
of 2:00 a.m. because it was concerned that noise might disturb the nearby
residential uses. However, to date, this Department has received no
complaints regarding tte business. Alsr. the Police and Fire Departments
comments that they ha•e had no problem:, with the business or complaints
regarding noise. A ,ix -month review vas held by the Planning Commission
on October 22, 198S/rand no concerns were expressed. In liqnt of the fact
that this business has not presented problems, Staff would recommend that
the hours of operation he extender' to 2:00 a.m. for a period of six
months. A six-month review would then be held by the Commission and if no
problems occurred, then the 2:00 a.m. closing time could be granted for an
indefinite period.

However, your staff recommended and subsequently granted that business
hours be between 12:00 (noon) to 12:00 (midnight) on a trial basis for
six months.
For the past six months, there has not been any single violation of
Chapter 5.28 of the Campbell Municipal Code which regulates pool and
billiard halls or, for that matter, any complaining from the residents
residing nearby.
Therefore, it is requested that the business hours be extended by two
hours from 12:00 (noon)-12:00 (midnight) to 12:00 (noon)-2:00 (a.m.)
as it was requested in the original application.
.Again, I will absolute;y make sure that no alcoholic beverages shall
be served in, or outside the billiards hall, and my business will

Mr. Kee reviewed this application, noting that Staff is of the opinion
that the use as proposed should net create a disturbance or be detriuental
to persons working or residing in the area. With the conditions as listed
in the Staff Comment Sheet, Staff is recommending approval.
Commissioner Kasolas asked about Condition No. 2, noting that he would
assume that a chz.nge to Anerican style billiards would require a separate
and new use permit.
Commissioner Dici.son asked about Condition No. 8, asked if there is an
environment present with this use that lends itself to restricting the ace
group. Commissic-ner Dickson added that he has a problem with this
condition in that he is sorry to ee a restriction on the age for this
use.
Mr. Kee indicated that this condition I-.-s its origin from the applicant's
statement, also attached to the Staff Comment Sheet.
Commissioner Christ asked about the hours of operation, noting that the
applicant has requested to stay open until 2:00 a.m.
Mr. Kee respor:.ied that Staff is recommending the operation stay open no
later than 12:00 nidnight, thereby restricting the number of vehicles
Arour.i the project in the early morning hours.
Mrs. Anne Casey, property owner on Michael Drive, spoke against this c+se,
noting that -he proposed billiard center is only a fey, feet from her back
yard, with bedroom windows facing the proposed use. She felt that there
would be a noise problem.
Mr. Ferrari, owner of 960 t 962 Michael Drive, also spoke against this
use, citing the same potential problems as Mrs. Casey.
Mrc. Myunk Sik Lee, applicant, responded to questions and concerns, noting
that you could not see into the bedrooms of tha apartments from the
commercial buil-ling; Mar. will be no beer and vine, therefore no drunks;
the use is located in the center of the building and is over 50 feet from
the nearest building; the age is restricted to those over 18 because
people under that age do not know how to play the oriental -style
billiards.

STAFF DISCUSSION
The applicant is requesting approval of a use permit to allow the
establishment of an oriental -style billians room. Attached are two
statements by tle applicant describing the use.
The proposed use would occupy 1500 sq.ft. of a 10,000 sq.ft. retail
building. The use would be located towards the rear of the building.
Other uses currently in this building include a rien's clothing store, a
video rental shop, hair design studio, office use, and cone unleased
space.
The applicant has indicated the placement of 6 billiard tables. Hours of
operation are indicated as 12:00 noon to 2:00 a.m. No alcohol will be
served on the premises.
The Police Department has reviewed the application and states that it is
an acceptable use as long as it complies with Chapter 5.28 of the Campbell
Municipal Code which regulates pool and billiard halls.
The property is bound by the following cses:
SOUTH: Lincoln Properties office complex under construction.
NORTH: Residential uses and small office building.
EAST: Commercial.
WEST: Apartment building.
The residential uses to the north are opposite the front door of the
proposed billiards hall with a 5 foot masonry wall separating the uses.
Consequently, any noise late at night could disturb the tenants.
Staff is of the opinion that the use as proposed should not cause a
disturbance or be detrimental to persons working or residing in the area.

Subject: Oriental Style Billiards
Summary of Project:
Oriental Billiards is somewhat different than American Billiards. First of
all the tables have no pockets. Secondly, tnere is only a use of 4 cr 9 balls in
any given game. Points are then accumulated, and then added together to find the
proper winner. The scores w1.11 be kept on a computer readout board and then
displayed for all to see. There will be six tables at which un to 4 players each
could play. This lends fun and entertainment for friends and family.
Business hours will be from 12:00 noon till 2:00 a.m. There will be
absolutely no alcoholic consumption in or on the property. There will be a
minimum charge of $1.00 per 10 minutes, or $6.00 per hour.
We see the need in this area for a recreation of this manner. At the
present time in the Los Angeles area, there are more than 20 different Billiard
Rome in operation at thla time. Even now there are a few opening in the San
Francisco and Monterey areas.

M 89-05(UP 85-03) Public hearing to consider the application of Mr.
Namkoong, P. Paul Namkoong for ;approval of a modification of a
previously approval Use Permit to allow the expansion
of a billiard parlor on property known as 2097 S.
Bascom Ave. in a C-2-S (General Commercial) Zoning
District. (Planning Commission action is final unless
appealed.)
STAFF RECOMMENDATION
That the Planning Commission ADOPT a RESOLUTION, incorporating the attached
findings, APPROVING the applicant's request, subject to the attach=d conditions.
DISCUSSION
Background: The Planning Commission, at its meeting of April 9, 1985, approved an
oriental -style billiards room for approximately 1,500 sq.ft. of an existing retail
business. The approved Condf.-ional Use Permit allowed the placement of 6 billiard
tables at this location.
The applicant, a new owner, a this time is requesting approval of a modification t�
the previous approval to allo the expansion of this use from 1,500 sq.ft. to 3,450
sq.ft. and an increase in the lumber of tables from 6 to 14.
Project site: The applicant's proposed tenant spa-e is situated towards the
interior of an existing single story retail building. The site is surrounded by the
following land uses:
North: Retail building. South: Office building.
East: Retail. West: Apartments.
An aerial photo is attached depicting these uses.
Hours of operation: The applicant has indicated his intent to operate f�-m 10 a.m.
to 2 a.m.
Parkins: The proposed use will occupy 3,450 sq.ft. of a 10,000 sq.ft. retail
building. This building was approved with the provision of 50 parking spaces, of
whlcn 17 would be allocated to this use. The provided parking is adequate, in
Staffs opinion, due to the tenant makeup at this retail center and the parking
demand periods for this use which should be in the evening.
Garage parkins: An inspection of this site indicated that the parking provided
beneath this buiiding was not available and appeared to be used for storage. Staff
is recommending that this parking area be made available during business hours and
that it be secured during evening hours with appropriate lighting.
Police Department: The Police Department has reviewed this request and has
Indicated that it has no specific objection to this modification.

Chairman Kasolas noted correspondence (attached hereto) pertaining to this
item from Tirs. Patricia Figueroa, and requested the Recording Secretary to
read this letter of opnositfon. Chairman 1Casolas asked the applicant if
they wished a continuance in order to review the contents of the subject
letter.
.It. I:in, representing, the applicant, explained the request for extended
hours of o, e.atfon. He continued that the extended hours would mean
approximately 16 people in the late evening, with approximately 4 cars.
The applicant would be agreeable to making these late evening customers
park near the business, rather than in -he rear parking lot next to the
apartments.
Commissioner Olszewski asked about the income statement presented by the
applicant, and how much additional income could be anticipated by
increasing the ho,.irs of operation.
?It. Kim indicated that additional income would be approximately $36 a day.
Chairman I'asolas asked that the discussion be limited to the Commission's
char,te of grantin? or modifying a use permit.
Commissioner Stanton askec if there had been any other complaints, other
than the presented letter from ',rs. Figueroa.
Mr. Woodworth responded that the police and Fire Department have had no
conplaints; and, he explained the 6-month review condition as well as the
controls allowable under a use permit.

to extend the closing time from 12
midnight to 2:00 a.m. f ,r a period of 6
months. The Commission to hold a review

September 9, 1986, at wh-ch time it will
determine whether or not to extend the
closing time to 2:00 a.m, for an
indefinite period. All other previous
conditions to remain in effect.
Discussion of Motion
Commissioner Perrine stated that he is favor of the motion, in that it
seems to be a quiet operation.
Commissioner Fairbanks acknowledged the letter from Mrs. Figueroa, noting
she appreciates her concerns. Commissioner Fairbanks thought that Staff
has responded to these concerns by requiring the change to be reviewed in
six months.
Vote on Motion
Motion carries with a vote of 5-1-1,
with Commissioner Olszewski voting "no",
and Commissioner Dickson being absent.

I have met with Mr. Namkoong and discussed his proposed operation
which would include the sale and consumption of beer and wine.
The Police Department would not object to the use permit with the
following provisions:
1. Sale of alcoholic beverages to commence at 8:00 p.m. and
cease at 12:00 midnight.
2. No person under the age of 21 allowed on the premise
during these hours.
Mr. Namkoong has proposed that he partition the business to separa—
the alcohol area from those under the age of 21 years.
At this time, the City ordinance does not allow for this and
specifically proh::bits the sale of alcoholic beverages where persons
under the age of ^.1 are permitted to enter [CNC 5.28.040(c)).

After notification and public hearing as specified by law on the application of
Mr. Paul Namkoong for a Use Permit and approval of modification to expand a
billiard parlor on property known as 2097 S. Bascom Avenue in a C-2-S (General
Coamercial) Zoning District., as per the application filed in the Planning
Department on May 18, 1989; and, after presentation by the Planning Director,
proponents and opponents, the hearing was closed.
After due consideration of all evidence presented, the Planning Commission did
find as follows:
1. Health/Safety: The establishment, maintenance or operation of the use

Billiard parlors are now becoming more popular everywhere as more
recreational and free time becomes available to the general population.
Billiards over the years have riot land in some cases deservedly so)

(reference: UP 85-05) , we requested yorr permission for business hours
from 12:00 (noon) to 2:00 (a.m.).
However, your staff recommended and subsequently granted brat business
hours be between 12:00 (noon) to 12:00 (midnight) on a trial basis for
six months.
For the past six months, there has not been any single violation of
Chapter 5.28 of the Campbell Municipal Code which regulates pool and
billiard halls or, for that matter, any complaining from the residents
residing nearby.
Therefore, It is requested that the business hours be extended by two
hours from I2:00 (noon)-12:00 (midnight) to 12:00 (noon)-2:00 (a.m.)
as It was requested in the original application.
Again, 1 will absolutely make sure that no alcoholic beverages shall
be served in, or outside the billiards hr.rl, and my business will
continuously be operated within the boundaries of the Chapter 5.28 of
the Campbell Municipal Code.
Majority of my customers who visit to play billiard come after they
finish working and have dinners, therefore, in fact, our practical
business hour starts around 8:00 (p.m.) resulting in four (4) hours of
business time allowance, causing a major problem in maintaining our
business.
