Mr. Kee briefly reviewed this application, noting that adjacent property owners as well as the Police Department have been nctified of this application. The Police Department has responded with "no comments". Since this is a commercial use proposed for an existing commercial center, Staff is recommending that the Commission adopt a resolution approving this applicaticn, subject to the conditions and the mandatory findings as indicated in the Staff Comment Sheet. Commissioner Dickson noted that he was uncomfortable with the issues of health and safe�v for this application. Is an approval of this nse permit saying that the use is safe and healthy? He asked how other cities handled a request of this type. Mr. Kee responded that the issue of tanning studios being an allcwable use in shopping centers was previously discussed by the Commission. The result was -he requirement of a use permit which would allow the Commission '.he opportunity of placing conditions on the use. Chairman Fairbanks opened the public hearing and invited anyone in the audience to speak for or against this item. �.M j- Mr. Kurt Anderson, 1resentinq the applicant, respov✓'d to questions from the Commission, ind —tinR that the only permit requi d for this type of use is the standard City permit. Additionally, all the machiies uses are UL approved. Mr. Anderson continued chat a client will typically spend 15-30 minutes each visit, at a c?st of approximately $10 per visit. Booths are sterilized after each use. Mr. Dempster stated that the Commission is not making a determination that the :anninq procedures are healthy. It is not possible for the Commission to have the resources or the ability to check the instrumentations for safety. The Commission is deciding if the location of the tanning studio is detrimental to the community and other planning issues such as traffic, parkin¢, etc. Commissioner Dickson asked how this type of use is looked at to see that it is being operated without degradation of morals. Mr. Dempster responded that this would be a Police Department matter. M/S: Olszewskf, Kasolas - That the public hearing on UP 85-09 be closed. Motion carried unanimously (7-0-0). M/S: Toshach, Perrine - That the Planning Commission adopt a Resolution approving UP 85-09 subject to condiclons of approval and findings as indicated in the Staff Comment Sheet (attached hereto). Motion carried with the following roll call vote: Commissioner Dickson stated that he would be voting against this item in that it has not been demonstrated to his satisfaction that the use will not be detrimental. Chairman Fairbanks stated that she would also be voting against this application in that she is inclined to believe that tanning is not healthy per reports from the FDA. Based on the above finding, the Planning Commission does hereby grant the requested use permit, subject to the following conditions: A. Applicant to obtain all necessary permits from the Building Departnent. B. Applicant to obtain City approval of any signs. The applicant is notified as part of this application that he is required to comply with all applicable codes and/or ordinances of the City of Campbell and the State of California which pertain to this development and are not herein specified. STAFF DISCUSSION The applicant is proposing to establish a tanning salon in a portion of the Pruneyard Shopping Center. Plans submitted with the application in- dicate that there will be a total of 9 tanning rooms in addition to a reception/waiting area. As the Commission may recall, the City Council approved a text amendment to the Zoning Ordinance, in 1980, which established tanning studios as an allowable use in the C-2-S (General Commercial) zoning subject to ap- proval of a Use Permit. Staff has notified adjacent property owners and the Police Department of this pending application and public hearing. The Police Department has responded with "no comments" regarding the application. A tanning salon is an establishment that provides a series of rooms with tan- ning beds for use by its clientele. Maximum time in the tanning bed is 30 minutes after the client has become sensitized to the bed. The clientele can be a member or can use the salon on a one-time basis. Average use by a client is twice weekly visits. There are several establishments in the surrounding area and have been very successful.
